Section 504 and IDEA:
Basic Similarities and Differences
S. James Rosenfeld, Esq.
President
EDLAW, Inc.
Although parents of children with disabilities are frequently more familiar with the Individuals with Disabilities Education Act (IDEA), they should also acquaint themselves with Section 504 of the Rehabilitation Act (hereinafter "Section 504"). Knowledge of both statutes, and particularly their implementing regulations, often is necessary to be sure of securing an appropriate education for children with disabilities. Indeed, for some children with disabilities, Section 504 may be more important the only legal mandate requiring education agencies to provide special education or related services to a child with a disability.
This article will familiarize parents with why and how Section 504 impacts the education of children with disabilities; illustrate some of the differences between Section 504 and IDEA; and provide a basic explanation of "how Section 504 works." It is vital to remember, however, that literally volumes have been written on these topics and, therefore, no one should rely solely on this article to undertake legal action. A suitable next step in the learning process might be review of RIGHTS OF PHYSICALLY HANDICAPPED PERSONS (Shepard's/McGraw-Hill, Colorado Springs, Colorado: 1984), a concise but very sophisticated explanation of this area by Professor Laura F. Rothstein of the University of Houston School of Law.

RITALIN IS CHILD ABUSE
in memory of Kurt Cobain 1967-1994
(If you have a gifted child, you should read this (Is It A Cheetah?) at least once!)
There are a number of people who clearly have ADHD or the equivalent to the extent of not being able to adequately function in life. This article is not intended to dismiss the use of Ritalin in all cases. If your child is in that category (or if you are in that category), I'm sure you won't be dissuaded in any case. You'll probably also agree that the drug is being grossly overprescribed to those who do not require drug therapy! Ritalin is a tradename for Methylphenidate hydrochloride, an antidepressant stimulant. There is no generic common name for the drug. Other antidepressant stimulants are real cocaine, novocaine, other cocaine substitutes. Ritalin is not a classic antidepressant in the sense of Prosaic. Street names for Methylphenidate hydrochloride are "r-ball" and "vitamin r." While children are the obvious victims here, the same message applies to adults. If you are the student, please excuse the third party ("your child") language. The message is the same!

Since 1991 prescriptions for all drugs to treat ADHD have quintupled. This year about six million children, roughly one child out of every eight, will take Ritalin or other forms of methylphenidate. The number of stimulants prescribed for children 2 to 4 has increased 200% to 300% between 1991 and 1995. Studies show that stimulants cause especially severe reactions in young children. Since there are no good studies, no one knows what it does to the development of the very young child's brain. First it is important to realize that all of the stimulant drugs prescribed for ADHD/ADD are closely related to some illegal street drugs. These include dextroamphetamine (dexedrine) (street name: "dexies"), methamphetamine (street name: "crystal meth"), and, of course, cocaine. We imprison people for making drugs very similar to the drugs we prescribe to our ADHD children.

Attention Deficit Disorder Discussion Forum. “Enthusiastic student” and “Pleasure to have in class” appeared on my son’s first mid-term report this year, replacing the “Very little effort” and “Missing assignments” comments that chronically plagued past mid-terms and report cards. My son’s seventh grade teachers gave glowing reports of a young man who handed class work and homework in on time, who paid attention and actively participated in class. I am still amazed that this is the same person who, just one year prior, struggled to maintain a “C” average in school, was tested for learning disabilities and received an Attention Deficit Disorder diagnosis ( Causes of ADHD ) after a school career marked with distress and defeat. Then I found hope. I found

Chronic Fatigue Syndrome and its Connection to ADD/ADHD
Preface
After many delays, and revisions, this manuscript represents an attempt to summarize much of the background and current literature to date regarding this confusing phenomenon we call CFS/CFIDS and its potential connection to ADHD in children (and adults).
In writing this, I am attempting to help physicians, patients, educators and others further understand this complex phenomenon. I have attempted to separate what is "accepted" and/or verified by literature publications, versus my "opinions" and "positions."
To all of you reading this, I hope this helps add some insight and understanding of the complex epiphenomena. To all of you who may have and are suffering with this illness, I hope you will soon see an acceleration of our clinical knowledge, such that successful treatment protocols are available in the near future for all.
The question is often asked, "What can be done as patients." With recognition by our medical establishment of the legitimacy of this problem, they are encouragingly on a path to find answers to verify or disprove clinical opinions and further basic science, with an attitude significantly different from even a year ago. This author believes the critical need for patients (via hopefully corporate or private funding sources) is to accelerate steps that will "jump-start" controlled therapies, while our medical establishment searches for all the scientific answers.

"My work as an educator and psychologist in the fields of multiple intelligences, the myth of ADD/ADHD, and the natural genius of kids, has been guided by a belief that all children are gifted children. Each child comes into the world with unique potentials that, if properly nourished, can contribute to the betterment of our world. The biggest challenge for parents and teachers is to remove the roadblocks that keep those gifts from being recognized, celebrated, and nurtured."
