Extractions: Introduction to the Basic Documents The Basic Documents of the Permanent Court of Arbitration (PCA) are presented here in a single volume: its conventions, procedural rules, model clauses and other important documents. It is hoped that this compilation will be of interest and use to the international community. The 'Decade of International Law,' proclaimed by the United Nations General Assembly in 1989, has proven to be a decade of intensive revitalization for the PCA, and the fruits of this revitalization constitute the bulk of this volume of basic documents. Now, on the eve of the PCA's centennial, its two constitutive Conventions are accom-panied by no fewer than six sets of optional procedural rules for international dispute resolution, all adopted in the period from 1992-1997. Establishment of the Permanent Court of Arbitration The PCA was established by the Convention for the Pacific Settlement of Inter-national Disputes, concluded at The Hague in 1899 during the first Hague Peace Conference. The Conference was convened at the initiative of Tsar Nicholas II of Russia 'with the object of seeking the most effective means of ensuring to all peoples the benefits of a real and lasting peace, and above all, of limiting the progressive develop-ment of existing armaments.' The most important achievement of this Conference was the establishment of the PCA: the first global mechanism for the settlement of inter-State disputes. The 1899 Convention, which provided the legal basis for the PCA, was revised at the second Hague Peace Conference in 1907.

The ancient society did not seem to have weapons, soldiers, fortifications or all the other evidence of patriarchy that we are familiar with. It was a perfect context for our workshop on new thinking on international security. The group established seven methods for bringing about change in the very large and apparently inaccessible international systems: Build support and trust in small groups. Get key "insiders" on your side. Start small with a human - size tasks and then increase the numbers. Have a clear truthful statement exposing the "official story." Refuse all collaboration with the military. Communicate information in ways people experience directly and enjoy. Use your unique assets, as women or partnerships, as a response to force.

Our hope is that individual citizens and citizen groups will increasingly become active as vital elements in the implementation of international exchange and cooperation activities. @As the first city in human history to fall victim to an atomic bomb, the City of Hiroshima has continually expended a great amount of effort towards the eradication of all nuclear weapons and the realization of permanent world peace. Individual citizens, groups, businesses and governmental bodies of Hiroshima have each come to view the contribution towards world peace and an international society as a personal concern and have become active in its pursuit. The deepening of mutual understanding between the people of Hiroshima and those from other countries in turn becomes an avenue for sharing the Spirit of Hiroshima with the world at large.

As the United Nations' main judicial body, the court has been asked by the World Health Organization and the U.N. General Assembly to deliver an advisory opinion on the issue. (443.4381) Colin Archer - This is supported by the World Court Project, which is an international alliance of citizens' groups. It was founded in 1992 with the aim of bringing the legality of nuclear weapons before the International Court of Justice at The Hague. The co-founding organizations are the International Peace Bureau (IPB), The International Association of Lawyers Against Nuclear Arms (IALANA) and International Physicians for the Prevention of Nuclear War (IPPNW). The Court is now considering whether the threat or use of nuclear weapons is permitted under international law. It is expected to make its ruling early in 1996. Peter Weiss, one of the lawyers working with the World Court Project, believes that nothing but good can come from this historic hearing: "If a majority of the Court says that nuclear weapons are not totally illegal, there will be a tremendous push to get a convention outlawing them like the treaties abolishing chemical and biological weapons. If a majority say they are totally illegal, as they should, there will be an equally strong movement for such a convention to implement the Court's opinion."

Extractions: by Dorrie Weiss The United Nations is active in many areas, but their media image depends largely on the success or failure of the peacekeepers as they carry aid to besieged people, or are themselves besieged. Peacekeeping has become the most public function of the UN; the missions have increased in number and complexity. Between 1945 and 1987 only 13 peacekeeping operations had been instituted. In July of 1995, 17 were functioning simultaneously. There are about 70,000 military and civilian personnel serving under the UN flag. Increasingly, the military presence must be supplemented by police, by civilians who monitor human rights or humanitarian aid, and by non-governmental organizations (NGOs). Peacekeping is a method of last resort. The root causes of dissent should be addressed before conflict begins. Once the fighting starts, a peace must be made before it can be kept . Secretary-General Boutros Boutros-Ghali, in "An Agenda for Peace," has laid out four stages of UN involvement: preventive diplomacy, peacemaking, peacekeeping, and post-conflict peace building. Preventive diplomacy involves confidence-building, fact-finding, and humanitarian and economic aid. It may include the establishment of a demilitarized zone or preventive deployment of personnel on a disputed border. Because the UN is pledged to respect the sovereignty of its members, assistance is supplied at the request of the contending states.

Extractions: Mr. Chairman, History has been clearly demonstrated that there can be no peace without justice, that is to say justice is an indispensable component of lasting peace. Starting from that premise, the Republic of Hungary holds the view that all those who commit war crimes and crimes against humanity must be held personally responsible and accountable. We are convinced that bringing to justice those who commit the most heinous international crimes is an important contribution to the maintenance of international peace and security and to the protection of human rights. The timeliness of implementing this principle is shown by the war crimes and other grave violations of international humanitarian law which have been committed during the last few years in many parts of the world. Hungary, being a country neighbouring one of those areas where such dreadful crimes have occurred, welcomed the decision of the Security Council, acting under Chapter VII of the Charter, to set up ad-hoc Tribunals for the prosecution of crimes committed in the territory of the former Yugoslavia and Rwanda and has constantly given its full support to their activities. As the Minister for Foreign Affairs of Hungary emphasized in the statement which he delivered during the general debate of this session of the General Assembly, and I quote: "It is our legitimate expectation that all persons indicted by the Tribunals will be brought to justice and, conversely, failing to cooperate fully with the Tribunals will not remain without consequences."

Extractions: Born the Countess Kinsky von Chinic und Tettau in Prague, then Austria (now the Czech Republic), the posthumous daughter of an Austrian army field marshal, Suttner spent the first half of her life accepting the military traditions which she would later try to subvert. As a young girl, Suttner studied languages and music and traveled. At age thirty, she decided to strike out on her own to relieve her mother of the financial burden of her care. She took a position as a governess for four girls in the Viennese Suttner household where she met her future husband, a younger son of the family. In 1873 she left briefly for a sojourn in Paris where she worked as Alfred Noble's secretary. They would remain life-long friends and correspondents. Bertha returned to Vienna to marry Baron Arthur Gundaccar von Suttner over the objections of his family. The newlyweds left immediately for the Caucasus where they remained for nine years, often earning a precarious living by giving lessons in languages and music and eventually, and more successfully, by writing. In 1885 the Baron's family relented and the couple returned to Austria. Suttner became increasingly active in the campaign against the arms race. Continuing her correspondence with Noble, Suttner often expressed her fears that his invention would lead to increasingly deadly wars. Inspired by her work, Noble provided for the Noble Peace Prize in his will to honor a person "who shall have done the most or the best work for fraternity between nations, for the abolition or reduction of standing armies and for the holding and promotion of peace congressess."
