" BY DAVID WALLECHINSKY In the exotic southeast Asian nation of Burma, a country of 46 million people, a battle of wills of heroic proportions is taking place. On one side is a brutal military dictatorship known as SLORC (State Law and Order Restoration Council). On the other is a slim, 51-year-old mother of two named Aung San Suu Kyi, who is leading her people in a nonviolent struggle for democracy. For six years, from 1989 to 1995, Aung San Suu Kyi (pronounced Awng-Sahn-Soo-Chee) was kept in isolation under house arrest for speaking out against the government, which has used torture and forced labor and which refuses to hand over power, even though it lost a national election. In 1991, still under house arrest. Aung San Suu Kyi was awarded the Nobel Peace Prize. Following her release in 1995, she continued to challenge the junta, every weekend addressing the thousands of followers who congregated in front of the gate to her house and across the street. It had become the only forum for free speech in the country. But since September the government has cracked down on these gatherings. It has amested more than 1000 people usually in the middle of the night And Aung San Suu Kyi is again restricted to her home.

Petitioners claim that Mrs. Aung San Suu Kyi, a prominent political leader and member of the National League for Democracy, has been illegally detained since July 21, 1989. PETITIONERS The Petitioners are International Educational Development, Inc., a non-governmental organization on the Roster (Secretary- General's List), Dr. Myo Thant and Mr. U Sein Win on behalf of Mrs. Aung San Suu Kyi. CONSENT Petitioners allege that Mrs. Aung San Suu Kyi is currently not able to communicate directly to the Working Group due to the nature of her detention, but is presumed to consent to this petition. Dr. Myo Thant and Mr. U Sein Win are both cousins of Mrs. Aung San Suu Kyi and both consent for her. They inform the Working Group that other relatives of Mrs. Aung San Suu Kyi have grave concerns about retaliation should their participation here become known so they are unable to join at this time.

Suu Kyi, 1991 Nobel laureate, is the leader of the National League for Democracy and has been waging a non-violent campaign for peaceful change in Myanmar since 1990, when her party's landslide victory in national elections was overturned by military leaders. She was previously held under house arrest from 1989 to 1995. Besides releasing Aung San Suu Kyi with a promise to not restrict her political or private activities, the military government has also indicated a willingness to release other political prisoners, a move which PEN Canada also welcomes. In particular, PEN Canada urges the military leaders of Myanmar to immediately release Honorary Members Aung Myint, Ko Aung Tun and Myo Htun, as well as the many other prisoners of conscience held in Myanmar. Aung Myint , a journalist, poet and head of the information department of the National League for Democracy (NLD) in Rangoon, was arrested in September 2000 and sentenced to 21 years' imprisonment by a military court apparently for writing and distributing a press release following the latest arrest of Aung San Suu Kyi. Aung Myint's assistant, Kyaw Sein Oo, was also arrested and sentenced to seven years' imprisonment.

"The way that we characterize her status is that she is being held in de-facto house arrest," said Ms. Guest, an American working at Amnesty's London headquarters. "What we mean by de-facto house arrest is that it's not entirely clear whether she is being held under 10-B of the 1975 State Protection Act which allows for up to five years detention without charge, trial or judicial appeal," Ms. Guest said. When Amnesty International asked the regime to allow a meeting with Mrs. Suu Kyi, "we were told the time was not right," Ms. Guest said. "We had no contact with her, direct or indirect."
