Section 3: Commission Rules and Enforcement.
A violation of Rules of the Public Company Accounting Oversight Board ("Board") is treated as a violation of the '34 Act, giving rise to the same penalties that may be imposed for violations of that Act. Section 101: Establishment; Board Membership.
The Board will have five financially-literate members, appointed for five-year terms. Two of the members must be or have been certified public accountants, and the remaining three must not be and cannot have been CPAs. The Chair may be held by one of the CPA members, provided that he or she has not been engaged as a practicing CPA for five years. The Board's members will serve on a full-time basis. No member may, concurrent with service on the Board, "share in any of the profits of, or receive payments from, a public accounting firm," other than "fixed continuing payments," such as retirement payments. Members of the Board are appointed by the Commission, "after consultation with" the Chairman of the Federal Reserve Board and the Secretary of the Treasury.

United States House of Representatives June 11, 1997 Mr. Chairman, distinguished members of the committee: My name is Roger Pilon. I am a senior fellow at the Cato Institute and the director of Cato's Center for Constitutional Studies. I want to thank you, Mr. Chairman, for inviting me to testify before the committee on H.R. , the Civil Asset Forfeiture Reform Act of 1997. Your recent book on forfeiture, which I am pleased to have edited and the Cato Institute is proud to have published, is a refreshing call for reform. You are to be commended for having written it, for having introduced this bill, and, more generally, for having taken up the issue of forfeiture reform when so many in Congress have ignored it. That the state of our forfeiture law today is a disgrace is hardly in question. A body of "law" that enables law enforcement personnel to stop motorists and seize their cash on the spot, to seize and sometimes destroy boats, cars, homes, airplanes, and businesses in often fruitless drug searches, and even to kill and maim in the course of seizure operations is out of control. Even lawyers who come upon this area of the law for the first time are taken aback by the injustice and utter irrationality of it all. About the only people who defend forfeiture law today are those in law enforcement who benefit from it, either as a "tool of their trade" or, more directly, by keeping the goods they seizea conflict of interest so stark that it takes us to another age. In fact, that is just the problem with modern forfeiture law: in practice as well as in theory, its roots are in notions that have no place whatever in our legal system, animistic and authoritarian notions that countless people have died over the ages to bury and replace with the rule of law.

Thursday, April 29, 2004; Page A17 The American Civil Liberties Union disclosed yesterday that it filed a lawsuit three weeks ago challenging the FBI's methods of obtaining many business records, but the group was barred from revealing even the existence of the case until now. The lawsuit was filed April 6 in U.S. District Court in Manhattan, but the case was kept under seal to avoid violating secrecy rules contained in the USA Patriot Act, the ACLU said. The group was allowed to release a redacted version of the lawsuit after weeks of negotiations with the government. "It is remarkable that a gag provision in the Patriot Act kept the public in the dark about the mere fact that a constitutional challenge had been filed in court," Ann Beeson, the ACLU's associate legal director, said in a statement. "President Bush can talk about extending the life of the Patriot Act, but the ACLU is still gagged from discussing details of our challenge to it." A Justice Department spokesman declined to comment on the case.

What's hot for fall of 2003? Well, the USA Patriot Act , for one thing. Although it passed in Congress almost without dissent in the aftermath of Sept. 11, it's suddenly being revisited, and this time around some of the folks holding opinions have actually read the thing . Among its detractors are 152 communities, including several major cities and three states, that have now passed resolutions denouncing the Patriot Act as an assault on civil liberties . More than one member of Congress has introduced legislation taking the teeth out of its most invasive provisions. And in a huge shock to the Justice Department, in July the so-called "Otter Amendment"—which de-funded the act's "sneak-and-peek" provision—passed in the House by a vote of 309-118. Introduced by a conservative Republican congressman from Idaho, C.L. "Butch" Otter, the amendment revealed the extent to which the Patriot Act engenders jitters across the political spectrum. Then there are the lawsuits, including one filed recently by the ACLU, urging the court to invalidate provisions of the act that threaten privacy or due process. All these reforms are wending their way through the system and the national consciousness as Americans start to take a sober second look at what the act really unleashed.
