RESOLUTION ON THE USA PATRIOT ACT AND RELATED MEASURES THAT INFRINGE ON THE RIGHTS OF LIBRARY USERS
WHEREAS, the American Library Association affirms the responsibility of the leaders of the United States to protect and preserve the freedoms that are the foundation of our democracy; and WHEREAS, libraries are a critical force for promoting the free flow and unimpeded distribution of knowledge and information for individuals, institutions, and communities; and WHEREAS, the American Library Association holds that suppression of ideas undermines a democratic society; and WHEREAS, privacy is essential to the exercise of free speech, free thought, and free association; and, in a library, the subject of users' interests should not be examined or scrutinized by others; and WHEREAS, certain provisions of the USA PATRIOT Act, the revised Attorney General Guidelines to the Federal Bureau of Investigation, and other related measures expand the authority of the federal government to investigate citizens and non-citizens, to engage in surveillance, and to threaten civil rights and liberties guaranteed under the United States Constitution and Bill of Rights; and WHEREAS, the USA PATRIOT Act and other recently enacted laws, regulations, and guidelines increase the likelihood that the activities of library users, including their use of computers to browse the Web or access e-mail, may be under government surveillance without their knowledge or consent; now, therefore, be it

The Model Drug Dealer Liability Act Homepage: Welcome to the Model Drug Dealer Liability Act (DDLA) website. The DDLA provides a means for parents and others to obtain monetary damages from drug dealers for the injuries caused by drugs to their families and communities. The Model DDLA has now has been adopted by fourteen (14) state legislatures throughout the United States. Under its "market liability" provisions the DDLA provides for civil liability for any drug dealer in a community for the injuries to others by drug users of the same type of drug, during the time period the dealer was dealing in the same community. Under "market liability" a plaintiff need not prove that the particular defendant drug dealer was in the "chain of distribution" to the user that caused the injuries. The Act is Model legislation of the American Legislative Exchange Council which is a bi-partisan organization of over 2,500 legislatures throughout the country. The Model Act was drafted by Daniel Bent with the help of Assistant U.S. Attorney Sharon Burnham and the input of scores of other experienced attorneys. Mr. Bent has twenty-five years experience as a trial lawyer. He was appointed by President Reagan and confirmed by the Senate as a United States Attorney, a position in which he served for 10 years. As a federal prosecutor he tried drug kingpin, drug dealer tax/ money laundering, major fraud, organized crime and other significant cases. He also has years of civil litigation experience. In drafting the Model Act, it was "vetted" by numerous other attorneys, including a distinguished civil rights expert who is now an appellate judge, as well as other experts in economics, commerce, and the illegal drug market itself. This extensive drafting process was to insure that the Model Act provides a lawyer representing a victim of someone's drug use a

Hogan Recent legislative efforts led by the American Hospital Association to reform the civil False Claims Act to establish quantifiable standards of materiality of damages should further encourage defense counsel to defend Medicare and Medicaid overpayment cases by highlighting to the government the lack of material damages caused by alleged misbillings. The proposed False Claims Act reform initiative also may be an indicator to defense counsel that potential jurors will be receptive to arguments of government overreaching in its penalizing of innocent misbilling claims. Materiality and the Wells Case: The Supreme Court Removes Materiality from Section 1014 Prosecutions Contrary to the holdings of the vast majority of circuits, the Supreme Court held that materiality was not an element of a section 1014 violation. In so ruling, the Supreme Court found the plain language of the statute and its legislative history to be controlling. The language of section 1014 nowhere requires that a material fact must be the subject of the false statement. In fact, the statute never even mentions materiality. Materiality and the Criminal False Claims Act: The Impact of Wells Whoever makes or presents to any person or officer in the civil, military, or naval service of the United States, or to any department or agency thereof, any claim upon or against the United States, or any department or agency thereof, knowing such claim to be false, fictitious, or fraudulent, shall be imprisoned . . . .

The US expects a long-term conflict
US President George Bush has said Tuesday's attacks on the World Trade Center and the Pentagon were "an act of war". Speaking from the White House, Mr Bush said the US would rally the world to defeat those who had carried out the attacks.
This battle will take time and resolve, but make no mistake about it, we will win
President Bush Nato ambassadors invoked a mutual defence clause in the organisation's founding treaty for the first time in its history. It envisages a collective response to armed attack against one of its members. "Accordingly, the United States' Nato allies stand ready to provide the assistance that may be required as a consequence of these actions of barbarism," a statement by the Nato council said. FBI Director Robert Mueller told a news conference that several of the hijackers as well as possible associates still in the US had been identified.

Proving the Mid-Acts Framework of Ephesians 4 Trinity Grace Fellowship TGF Home Page Introduction In recent months, some have dismissed the view that the Seven Ones of Ephesians 4 are intended by Paul to be interpreted as contrasted with the Seven Manys of Israel's Kingdom Gospel. This latter view is that espoused by Trinity Grace Fellowship. It is the purpose of these notes to discuss this matter. The view presented here is threefold: (I) That indeed the Seven Ones of Ephesians 4 are to be contrasted with the Seven Manys of Israel and that is Paul's PRIMARY intention, and indeed the Seven Ones cannot be understood apart from this interpretation of the nuts and bolts of the text. As a corollary, those denying that the Seven Ones of Ephesians 4 in context are true only of the Body of Christ are hereby urged to repent and acknowledge Christ (to Christ in private) as the non-ceremonial, non-ritualistic, non-ethnic, resurrected Head of the Body described ONLY in the great mystery given by Christ to Paul. The Act
The events of Sept. 11, 2001, reinforced the need to enhance the security of the United States. Congress responded by passing the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (the Bioterrorism Act), which President Bush signed into law June 12, 2002.   • Introduction Title I National Preparedness for Bioterrorism and Other Public Health Emergencies Title II Enhancing Controls on Dangerous Biological Agents and Toxins Title III Protecting Safety and Security of Food and Drug Supply Title IV Drinking Water Security and Safety Title V Additional Provisions
FDA is responsible for carrying out certain provisions of the Bioterrorism Act, particularly Title III Subtitle A (Protection of Food Supply) and Subtitle B (Protection of Drug Supply).

PROTECT ACT
The “PROTECT Act of 2003” is an historic milestone for our nation's children. The Justice Department will dedicate the full force of our nation’s resources against those who victimize our nation’s youth. Important coordinated law enforcement information, fast law enforcement response, and swift and sure penalties can work to protect our children. The PROTECT Act comprehensively strengthens law enforcement’s ability to prevent, investigate, prosecute and punish violent crimes committed against children. Problem #1: Law Enforcement Had Inadequate Tools to Help Locate Missing Children and Prosecute Offenders. Solution #1: The Act Establishes the AMBER Alert Program, and Provides Significant New Investigative Tools. AMBER Alert programs are a proven tool to help recover abducted children. ·Establishing a national AMBER Alert Program. Building on the steps already taken by the Bush Administration to support AMBER Alert programs, this bill allows for national coordination of state and local AMBER Alert programs, including the appointment of a national AMBER Alert Coordinator and the development of guidance for issuance and dissemination of AMBER Alerts. .On October 2, 2002, the Attorney General designated Assistant Attorney General for the Office of Justice Programs Deborah Daniels to serve as coordinator.

Acts of the Martyrs
In a strict sense the Acts of the Martyrs are the official records of the trials of early Christian martyrs made by the notaries of the court. In a wider sense, however, the title is applied to all the narratives of the martyrs' trial and death. In the latter sense, they may be classified as follows:
  • Official reports of the interrogatories ( acta gesta ). Those extant, like the "Acta Proconsulis" (Cyprian, "Ep. lxxvii ") are few in number and have only come down to us in editions prepared with a view to the edification of the faithful. The "Passio Cypriani" and "Acta Martyrum Scillitanorum" are typical of this class. Of these the former is a composite work of three separate documents showing the minimum of editorial additions in a few connecting phrases. The first document gives an account of the trial of Cyprian in 257, the second, his arrest and trial in 258, the third, of his martyrdom.
  • Documents of a later date than the martyrdom based on Acta of the first or second class, and therefore subjected to editorial manipulation of various kinds. It is this class which affords the critic the greatest scope for his discernment. What distinguishes these Acta from the subsequent classes is their literary basis. The editor was not constructing a story to suit oral tradition or to explain a monument. He was editing a literary document according to his own taste and purpose. The class is numerous and its contents highly debatable, for though additional study may raise any particular Acta to a higher class, it is far more likely as a rule to reduce it.
