In Regard To S. 718 - The Amateur Sports Integrity Act Chairman McCain, Senator Hollings, and members of the Committee, I appreciate your invitation to testify on a matter of deep concern to the entire higher education community - gambling on college sports. My statement is presented on behalf of 16 other national higher education associations. Together, we represent the nation's 3,800 colleges and universities. We believe that S. 718 is the right legislative approach to closing a loophole that tarnishes intercollegiate sports and feeds the rapidly expanding gambling addiction throughout the nation. Right now, federal law prohibits betting on college sporting events in every state except Nevada. However, there is an exemption that allows books in Nevada to accept bets on college sports. This single exemption virtually nullifies the impact of the broader federal prohibition. The justification for this exemption is difficult to fathom as a matter of public policy. Following the logic of Nevada's exemption, should Michigan be exempt from Occupational Safety and Health Act regulations? Florida from the drug interdiction rules? Or Colorado from the Fair Labor Standards Act? Why not exempt California from the Immigration and Nationalization Act?

Who is likely to be affected?
Amateur sports clubs registered with the Inland Revenue as Community Amateur Sports Clubs (CASCs).
General description of the measure
This measure will increase the tax thresholds below which registered CASCs will pay no corporation tax. As a result more clubs will be removed from the requirement to complete a tax return on an annual basis.
Operative date
1 April 2004.
Current law and proposed revisions
The CASC scheme was introduced in 2002. It provides some of the benefits of charitable status, but with a less stringent application process. Registered clubs pay no tax on bank or building society interest and no corporation tax on chargeable gains reinvested in the club. Clubs with trading income or income from property below certain thresholds will also pay no corporation tax.

HMT 3 Support for Community Amateur Sports Clubs
17 April 2002 Following consultation, the Budget introduces a package of tax reliefs to support community amateur sports clubs (CASCs).  The tax package provides an alternative route for CASCs to access tax reliefs on their income and donations from local people, which are similar to the tax reliefs normally given to charities.  It will be available for CASCs who cannot or do not wish to apply for charitable status. In addition to the tax reliefs, the Budget allocates a further £20 million from the Capital Modernisation Fund to renovate and improve community sports facilities. The Charity Commission will publish tomorrow its revised guidelines for applying for charitable status, reflecting the input of the sports sector.  Sports clubs are free to choose to apply either to the Charity Commission for charitable status, and the tax treatment that goes with charitable status, or directly to the Inland Revenue for the tax reliefs specifically for CASCs. Announcing this package of support, Paul Boateng, Financial Secretary to the Treasury, said:
