Personal Watercraft: Creating Havoc in their Wake We all have a cherished memory of swimming in our favorite lake, walking along the beach at low tide, sitting at the edge of the river to listen to the birds sing. We flock to our waterways for peace and quiet, to swim and fish and sail, and to observe the wildlife that thrive along the shoreline and in the water. If you have ever heard their high-pitched whine or witnessed riders harass birds and marine animals, you understand the harm that personal watercraft, also known as jetskis, can bring to our waterways and our enjoyment of them. Nearly 100,000 of these so-called "thrillcraft" are sold each year, and more than one million jetskis are currently in use in the United States. They move at speeds that can exceed 65 miles per hour, leaving in their wake a host of environmental and safety problems.
Most personal watercraft are powered by two-stroke engines which dump 25-30 percent of their fuel unburned into the water. A two-hour ride on a jetski can discharge up to four gallons of gas and oil into the water. At Lake Mead in Nevada, the Park Service estimates that on a busy weekend jetskis release 27,000 gallons of gas and oil into the park's waters. Unlike motor boats, jetskis are designed to maneuver into remote, shallow areas where a variety fragile plants and animals live. Studies have shown that jetskis harass waterfowl in their nesting areas, as well as marine mammals such as dolphins, seals, humpback whales, and manatees.

SECTION 13: CURRENT PERSONAL WATER CRAFT REGULATIONS As defined in the Pyramid Lake Paiute Tribe’s Boating Regulations, personal water craft are considered CLASS A motorboats. In addition to the following regulations, all personal water craft are subject to all the regulations, ordinances and sections pertaining to CLASS A motorboats. 13.3 REQUIRED SAFETY EQUIPMENT: Any person that operates a personal water craft on Pyramid Lake shall be required to wear a U.S. Coast Guard approved personal flotation device of Types I, II, III, V. Any person found to be in violation of this code shall be subject to a civil penalty of not less than $150.00 All personal water crafts shall be quipped with at least one (1) fire extinguisher capable of promptly extinguishing burning gasoline. Any person found to be in violation of this code shall be subject to a civil penalty of not less than $100.00. 13.4 OPERATING IN AN UNSAFE MANNER: Any person who fails to abide by the rules and regulations shall be subject not only to civil penalties, but an immediate suspension of Tribal Boating Permit and/or seizure of the vessel.

PERSONAL WATERCRAFT SAFETY
The increased sales and marketing of Personal Watercraft (PWC), particularly over the past several years, has resulted in significant increases in the number of these craft on the water. Along with this growth has come an unfortunate increase in the number of PWC-related accidents tracked by the states and reported to the U.S. Coast Guard (see table below ). It has been easy for critics of PWC to see this as evidence of a safety concern with these craft. While these "raw number" approaches are understandable, they tell only part of the story.
About 11 percent of all registered boats nationwide are personal watercraft. Industry statistics show that although PWC owners typically have substantial boating experience, they share their vessel with an average of three different people on a typical boating day. "Without a doubt an educated boater is a safe boater," states Larry Lambrose, executive director of the Personal Watercraft Industry Association (PWIA). "The personal watercraft industry strongly supports mandatory education for all boaters and the use of personal flotation devices for all passengers and boat operators. In fact, we have provisions for both in our model law and are encouraged that states are seeing such positive results from the legislation." More than twenty-six states have based PWC laws on the PWC Model Safety Act developed and endorsed by the National Association of State Boating Law Administrators (NASBLA). This act addresses minimum operator age (sixteen), prohibits nighttime and reckless operation, requires all operators and passengers to wear U.S. Coast Guard approved life jackets, and requires operators to use the lanyard stop switch (for boats so equipped).

Contact Us P ERSONAL W ATERCRAFT R EGULATIONS Each person operating, riding on, or being towed behind a personal watercraft must wear an approved non-inflatable Type I, II, III, or V personal flotation device. Inflatable personal flotation devices are prohibited. The operator of a personal watercraft must attach the engine cutoff switch lanyard (if equipped by the manufacturer) to his/her person, clothing, or PFD. Personal watercraft may not be operated from ½ hour after sunset to ½ hour before sunrise. Maneuvering a personal watercraft by weaving through congested vessel traffic, jumping the wake of another vessel unreasonably close or when visibility around the vessel is obstructed, or swerving at the last possible moment to avoid collision is classified as reckless operation of a vessel (a first-degree misdemeanor). A person must be at least 14 years of age to operate a personal watercraft in this state. A person must be at least 18 years of age to rent a personal watercraft in this state.

Who Can Operate a PWC?
  • No one under 12 years old can operate a PWC in North Carolina waters.
  • A person at least 12 years old but less than 16 years old, can operate a PWC if: they are riding with a person who is at least 18; or the youth has first successfully completed an approved boating safety education course (proof of age and safety course completion must be carried by the youth during operation of the PWC.)
  • It is unlawful for the owner of a PWC to knowingly allow a person under the age of 16 to operate a PWC unless they have first completed an approved boating safety education course.
  • It is unlawful for a person who has temporary or permanent responsibility for a person under the age of 16 to knowingly allow that person to operate a PWC unless they have first completed an aproved boating safety education course.

Recreational Boating Safety Personal Watercraft A PWC is a craft that is propelled by a motor, has a fully enclosed hull, is designed not to retain water if capsized and is operated by a person who sits, stands or kneels on the craft. Rules which apply to the operation of motor boats also apply to PWCs. Other requirements that apply to PWCs that you need to be aware of are
    • A person must not operate a PWC on any State waters (unless engaged in waterskiing on the River Murray)
        after sunset or 8pm (whichever is the earlier) on any day before 9am on a Sunday or before 8am on any other day.
      Unless zoned otherwise a 4 knot speed limit applies to all PWCs within 200 metres of the metropolitan shoreline (between Outer Harbour southern breakwater and southern end of Sellicks Beach) and the backwaters of the River Murray.

    PERSONAL WATERCRAFT (PWC) RULES
    • Except in an emergency, person under the age of 14 may not operate or be permitted to operate a personal watercraft unless there is another person 18 years of age or older on board. Each person aboard must be wearing a U.S. Coast Guard approved life jacket. If the PWC is equipped with a lanyard type engine cut-off, the lanyard must be attached to the operator's person, clothing, or life jacket. Operation is not permitted between one-half hour after sunset to one-half hour before sunrise unless proper navigation lights are displayed. A U.S. Coast Guard approved fire extinguisher of type B-1 is required. When within 150 feet of any dock, swimmer, swim raft or nonmotorized boat, speed your speed must be slow-no-wake. Slow-no-wake is the slowest possible speed necessary to maintain steerage but in no case greater than 5 mph. It is unlawful to chaise or harass wildlife.
