JAMIE CHARLES SPANGLER AND ROBERT ALBERT MERRIFIELD, 95 CV 814-A (W.D.N.Y.) The Securities and Exchange Commission announced that on December 2, 1996, the Honorable Richard J. Arcara, United States District Judge for the Western District of New York, entered a Final Judgment of Permanent Injunction against defendant Robert Albert Merrifield ("Merrifield"). The Final Judgment, to which Merrifield consented without admitting or denying the allegations of the Complaint, orders that Merrifield: (1) be permanently enjoining from committing violations of Section 17(a) of the Securities Act of 1933 and Section 10(b) of the Securities Exchange Act of 1934 and Rule 10b-5 thereunder; and (2) pay disgorgement of $28,746.45, which represents the amount alleged by the Commission to be his gains from the conduct alleged in the Complaint. The Final Judgment provides, however, that payment of disgorgement and prejudgment interest is being waived and that no civil penalty is imposed, based upon Merrifield's demonstrated inability to pay. The Commission's Complaint, filed on September 20, 1995, alleged that between February 1991 and June 1992, Merrifield and Jamie Charles Spangler fraudulently solicited nearly $500,000 from twenty-four unsophisticated investors, almost all of whom were elderly retirees, in the Buffalo, New York area. The Complaint further alleged that, in connection with the offer and sale of securities of First Legal and Financial Services Ltd. and Prime Holdings of New York, Inc., Merrifield made material misrepresentations and omitted to state material facts about the use of investors' funds, the risks of the investment, diversion of funds for personal use, the return on investments, predictions about the companies' future expansion and revenues, the persons who owned and controlled the companies, and the companies' financial condition. On January 27, 1994, Spangler was sentenced to 22 months in prison, three years probation and ordered to pay restitution of $227,686 to eleven of the investors he defrauded. USA v. Jamie Spangler, 93-CR-195-A. As against Defendant Merrifield, the injunctive action was settled on November 27, 1996, when final judgment on consent was entered by the Court.     Charles Babbage and Howard Aiken. How the Analytical Engine influenced the IBM Automatic Sequence Controlled Calculator aka The Harvard Mk I
    Technology In 1936, [Howard] Aiken had proposed his idea [to build a giant calculating machine] to the [Harvard University] Physics Department, ... He was told by the chairman, Frederick Saunders, that a lab technician, Carmelo Lanza, had told him about a similar contraption already stored up in the Science Center attic. Intrigued, Aiken had Lanza lead him to the machine, which turned out to be a set of brass wheels from English mathematician and philosopher Charles Babbage's unfinished "analytical engine" from nearly 100 years earlier. Aiken immediately recognized that he and Babbage had the same mechanism in mind. Fortunately for Aiken, where lack of money and poor materials had left Babbage's dream incomplete, he would have much more success. Later, those brass wheels, along with a set of books that had been given to him by the grandson of Babbage, would occupy a prominent spot in Aiken's office. In an interview with I. Bernard Cohen '37, PhD '47, Victor S. Thomas Professor of the History of Science Emeritus, Aiken pointed to Babbage's books and said, "There's my education in computers, right there; this is the whole thing, everything I took out of a book."     Born July 21, 1921
    Robert Bruce Merrifield came to UCLA as a transfer student from Pasadena City College . After earning his bachelor's degree in chemistry, he worked for a year before returning to UCLA for graduate school. He received his PhD in 1949. Merrifield then married and moved to New York to work for the Rockefeller Institute for Medical Research, later Rockefeller University. In 1997, the UCLA Alumni Association honored Merrifield as Alumnus of the Year.

    SCOPE AND CONTENT NOTE
    This addition to the Lillian Witmer Papers consists mainly of correspondence relating to the history of the University of North Dakota. A majority of the correspondence dates from the Webster Merrifield Presidency. Various subjects are discussed, including salaries, campus improvements, student disciplinary action, and faculty positions, to name a few. Among the correspondents are Amos Alonzo Stagg, famous football coach at the University of Chicago (Box 6, Folder 24), polar explorer Vilhjalmur Stefansson (Box 6, Folder 16), prominent North Dakota politician and lawyer, William Lemke (Box 6, Folder 53), Judge Charles Amidon (Box 6, Folder 30 and Box 7, Folder 1) and George Winship, founder of the

ORGANIZATION: Organized in three series. Series I: Title examinations for properties in Middlesex, Norfolk, and Suffolk Counties, [ca.1880]-1901; Series II: Notes on properties, land, and roads in Concord, Massachusetts, [ca.1875]-1897 includes one bound volume and four folders of loose sheets; Series III: Letters from Horace R. Hosmer to Charles H. Walcott, 1889-1892. BIOGRAPHY: Concord in the Colonial Period in 1884 and Sir Archibald Campbell of Inverneill in 1898. SCOPE AND CONTENT: Series I consists of eleven manuscript volumes containing title examinations for properties in Middlesex, Norfolk, and Suffolk Counties, Massachusetts [ca. 1880]-1901 (but relating to property transactions going much farther back in time than the date span of compilation reflects). Volumes include many properties in Concord as well as properties in Acton, Bedford, Boston, Cambridge, Carlisle, Chelmsford, Chelsea, Dedham, Lexington, Lincoln, Littleton, Lowell, Marlborough, Maynard, Medford, Melrose, Sharon, Somerville, Stow, Sudbury, Waltham, Watertown, and elsewhere. Series II contains one bound volume and one folder of loose sheets of notes on properties, land, and roads in Concord [ca. 1875]-1897, and three folders of loose notes on roads. Loose notes are also available as a typewritten transcript (1978).
