This is the defendant's automatic, direct appeal to the Arizona Supreme Court. AGGRAVATING CIRCUMSTANCES: (G) (3) (Grave Risk of Death to Others) - REVERSED
The defendant murdered his pregnant girlfriend. The trial court found this aggravating circumstance based on the grave risk of death to the fetus. The Court found that this aggravator did not exist because the defendant acted with intent to kill the fetus. (G) (6) (Heinous, Cruel or Depraved) - UPHELD Cruel: Upheld.
Mental Anguish: Found. "Cruelty is defined as the infliction of pain and suffering in a wanton, insensitive, or vindictive manner." 170 Ariz. at 501. The Court found that the victim was told she was going to be killed and a forty-five minute struggle ensued, throughout which the victim was conscious. Consciousness was demonstrated by the victim's resistance to the attack. The Court found that the victim must have experienced "anguish and terror" during the struggle, knowing that defendant planned to kill her. 170 Ariz. at 501.
Physical Pain: Found. During the attack, which the victim resisted in every possible way, defendant beat, strangled, pounded on, and threw the victim. Defendant bashed her head against a wall, attempted to break the victim's arms by smashing them against a dresser, tried to gouge out her eyes, causing severe eye damage in the assault. Defendant bit the victim multiple times, bruised most of her body, and prevented her attempted escape. Defendant finally choked the victim three times until he believed she was dead. "The victim's ordeal, moreover, was sufficiently prolonged and painful to warrant a finding of cruelty." 170 Ariz. at 501-502. The medical examiner testified that the injuries suffered by the victim would have inflicted enormous pain, particularly the eye injury.

The Society's racing season began, as always, with the Surgent Spring Regatta, held at the home of George and Marla Surgent. Unfortunately, the un-official reporter for the Society (Frank Pittelli) was unable to attend and, therefore, details and photos are non-existent. Port Urbanna Regatta - May 17, 2003
The Society was asked to participate in the First Annual Port Urbanna Regatta, held in Port Urbanna, Virgina. The regatta had great turn-out for its first occurrence, with schooners and skipjack races held throughout the day. The weather was overcast and cold, but otherwise good for sailing. Unfortunately, the un-official Society reporter was unable to attend because of a broken leg, so no details or photos are available. Nonetheless, the following results were recorded by Herb Jones:

Atwood's Machine The Rev. George Atwood (1746-1807) was a tutor at Trinity College, Cambridge when he published A Treatise on the Rectilinear Motion and Rotation of Bodies, with a Description of Original Experiments Relative to the Subject in 1784. According to Thomas Young, he "materially contributed to the progress of science, by multiplying the modes of illustration, which experimental exhibitions afford for the assistance of the instructor." Atwood's name is forever attached to the pulley-wheel arrangement shown at the right (from the apparatus collection of Kenyon College). Endless generations of students have solved the problem of the massless, non-stretching string passing over the pulleys with masses M and m on the ends. The acceleration of the masses is, they show, Atwood's original illustration for the machine showed the axle of the light pulley carrying the string supported on the rims of four other wheels with similarly small moments of inertia, and every early machine I have ever examined follows this pattern. In his book Atwood described a series of twelve demonstration experiments to be done with his apparatus. All of these involve timing. When I tried out these experiment in 1984 with the apparatus above, I used photogates and millisecond timing, technologies not available to Atwood two centuries earlier. Instead, he used a pendulum which ticked off the seconds, and adjusted the distances of fall to make the times of fall integral numbers of seconds.

This lucidly written and cogently argued work is the next step in the development of intersubjectivity theory. In particular, it is a clinically grounded continuation of Stolorow and Atwood's Contexts of Being (TAP, 1992), which reconceptualized four foundational pillars of psychoanalytic theory the unconscious, mind-body relations, trauma, and fantasy from an intersubjective perspective. Working Intersubjectively expounds and illustrates the contextualist sensibility that grows out of this reconceptualization. Like preceding volumes in the Psychoanalytic Inquiry Book Series by Robert Stolorow and his colleagues, it will be theoretically challenging and clinically useful to a wide readership of psychoanalysts and psychoanalytically informed psychotherapists.

Glenn Zaske Dr. George Atwood III an alumnus, recipient of numerous awards from New Mexico Tech, and longtime supporter of the institute, passed away peacefully at home on Jan. 8, 2002. The youngest of eight children, he was born in Savannah, Ga., on July 21, 1918, to Mary Jane McIntosh Atwood and Jules Epping Atwood. He grew up with a love for the beautiful Georgia coast, but his interest in rocks and minerals drew him west at the age of 17 to the New Mexico School of Mines, where he earned a bachelor's degree in metallurgical engineering in 1939 and a master's degree in the same field in 1945. He completed the advanced management program at Harvard Business School in 1965, and was awarded an honorary doctorate in engineering by New Mexico Tech in 1968. George began his career in 1939, working in the potash industry in Carlsbad, N.M. In 1950, he joined Duval Corporation, where he served as chief engineer in the design and construction of the Duval Potash Mining and Refining Plant. In 1957, he and his family relocated to Tucson, Ariz. He was named resident manager of Duval Corp. in 1972 and served as chairman of the board and chief executive officer until h is retirement in 1983. He also was a director of Duval's parent company, Pennzoil Corp., for that same period.
