UICC GLOBAL ink The International Tobacco-Control Network Selected documents NEIL FRANCEY Barrister- at-Law Sydney, Australia Tobacco Control is essentially a public response to a social issue. The public policy underpinning that response can be influenced by the reality of the social issue involved and the perception of the social issue involved. The perception of the need for tobacco control, and therefore the public policy response, however, has been distorted by decades of manipulation by the international tobacco industry. The deceit of the tobacco industry is now being exposed, largely through public inquires and litigation. As a consequence, the public policy response to the tobacco issue is increasingly being recognised as urgent and important and is increasingly more reflective of the real underlying social issue involved. The WHO FCTC is an example at the pan-global level. This APACT conference is an illustration at the regional-international level. Inevitably, however, policies must be implemented on a country by country basis. Just as trans-national tobacco companies have operated at an international, regional and national level to distort the truth and impede tobacco control, their efforts need to be exposed at all levels in order to ensure that their conduct does not continue to influence tobacco control efforts, and so that the tobacco industry can be made accountable for its actions. Litigation and public inquiries can assist to this end and there are numerous examples, illustrations and suggestions for future action, including:

Partnerships Between Attorneys and Public Health Professionals to Support Local Tobacco Control Efforts Overview: Historically, the greatest deterrents to local tobacco control efforts have been 1) lack of policy guidance; and 2) tobacco industry legal intimidation. To overcome these obstacles, in 1995, the Massachusetts Tobacco Control Program brought together the Community Assistance Statewide Team "CAST "), a group of public health professionals and municipal trade associations working in partnership with attorneys. The central purpose of CAST has been to provide policy guidance and legal education support to boards of health and community-based tobacco control programs. Meeting as a sub-group of CAST, the attorney members of CAST analyze local tobacco control initiatives to make sure that they are 1) enacted in a legally valid manner, and 2) drafted so as to withstand probable tobacco industry challenge. Background Documents uncovered in the Minnesota Attorney General's lawsuit show that, in 1992, the tobacco industry specifically targeted community-based tobacco control efforts in Massachusetts. Unfortunately, the tobacco industry and its allies executed this once secret plan. During the last five years, the tobacco industry has coordinated a well-orchestrated campaign against community-based tobacco control efforts in Massachusetts, using campaign contributions to state and local politicians, and acting through industry proxies/astro-turf roots groups like the New England Convenience Store Association and the Massachusetts Restaurant Association.
