A Refutation of Anti-Perfectionist or ‘Neutralist’ Liberalism by David Thunder th November 1999 Back to articles Return to homepage A Refutation of Anti-Perfectionist or ‘Neutralist’ Liberalism B oth advocates and opponents of the political ideal of ‘value’ neutrality, or neutrality between conceptions of the good, will agree upon one thing: the neutralist or ‘anti-perfectionist’ view of the moral limitations of laws and state interventions has exerted a tremendous influence upon the course of debate within political philosophy in the latter quarter of this century. The ideal of neutrality, though undermined in certain respects by communitarian and perfectionist critiques, is far from dead, and continues to shape the contemporary perfectionist/anti-perfectionist debate engaged in by many political theorists, including Joseph Raz, John Finnis, William Galston (on the ‘perfectionist’ side), Charles Larmore, John Rawls, and Ronald Dworkin (generally associated with the ‘anti-perfectionist’ side) to name but a few. In this essay, I will argue that neutralist theorists both violate their own neutrality injunction, and propose an ideal that, because of basic exigencies of political theory and practice, is impossible to implement. The neutrality which I am attributing to the most dominant thread of contemporary liberalism, and argued for by such thinkers as John Rawls, Robert Nozick, Ronald Dworkin, Bruce Ackerman and Charles Larmore, has come to be known as neutrality between ‘conceptions of the good’. Henceforth, I will refer to this form of neutrality as ‘liberal neutrality’. Neutrality is not a free-standing, self-sufficient principle of political morality, but a principle designed to secure certain political goods. In other words, it is an instrumental rather than intrinsic political good. We are not ‘neutral’ among conceptions of the good simply for the sake of being ‘neutral’, but because this (it is argued) is the best, or only way, to secure certain fundamental political values. In other words, neutrality is a second-order rather than first-order value.

John Rawls, the James Bryant Conant University Professor Emeritus , whose 1971 book, "A Theory of Justice" argued persuasively for a society based on equality and individual rights, died Nov. 24 at the age of 81. Rawls is considered by many to be the most important political philosopher of the 20th century and a powerful advocate of the liberal perspective. His work continues to be a major influence in the fields of ethics, law, political science, and economics, and has been translated into 27 languages. Harvard University President Lawrence H. Summers said, "I am deeply saddened by the death of John Rawls. He combined profound wisdom with equally profound humanity. Few, if any modern philosophers have had as decisive an impact on how we think about justice. Scholars in many different fields will continue to learn from him for generations to come."

Indice L'autore Il curatore ... liberalismo Chi per la prima volta s'imbattesse in una nota bio-bibliografica dell'ottantenne filosofo americano John Rawls, resterebbe meravigliato per l'esiguità della produzione uscita da un "cantiere dei lavori in corso" qual è stato il programma rawlsiano di ricerca nell'ambito della filosofia politica e morale, certamente uno dei più influenti del xx secolo e non solo nel mondo anglofono. Infatti, all'orizzonte si stagliano netti solo tre monumenti quali: il trattato basilare A Theory of Justice (1971), quindi la seconda grande opera Political Liberalism (1993) e, last but not least, The Law of Peoples A riprova invece, se mai ve ne fosse stato bisogno, dell'operosità del "cantiere rawlsiano", è stato pubblicato dalla Harvard University Press nel 1999, a cura di Samuel Freeman, il volume Collected Papers nel quale sono raccolti saggi e articoli che per la maggior parte trattano a fondo e forniscono risposte alle innumerevoli questioni sorte a seguito delle critiche e dei commenti suscitati dalle opere maggiori del filosofo di Harvard e che nel complesso, comunque, forniscono un panorama affascinante dello sviluppo del pensiero di Rawls a partire dal 1951 sino al 1998.

The idea of the original position is perhaps the most lasting contribution of John Rawls to our theorizing about social justice. The original position is a hypothetical situation in which rational calculators, acting as agents or trustees for the interests of concrete individuals, are pictured as choosing those principles of social relations under which their principals would do best. Their choices are subject to certain constraints, however, and it is these constraints which embody the specifically moral elements of original position argumentation. Crudely, the rational calculators do not know facts about their principals which would be morally irrelevant to the choice of principles of justice. This restriction on their reasoning is embodied, picturesquely, in Rawls's so-called veil of ignorance choice

    John Rawls is an American political philosopher whose own version of the social contract theory develops the concept of justice being equivalent to fairness. According to Rawls, the best way to balance freedoms and limit inequality in a society is for people to imagine that they they are setting up the rules from behind a "veil of ignorance." What this phrase means is that, when setting up the rules, people have no idea who or what they will be when enter society. It is possible to be part of any class, race, etc. In this way, people have to devise rules which will be equally beneficial and least harmful to all.     Rawls, John, 1921-, American philosopher and political theorist, b. Baltimore, grad. Princeton (A.B. 1943, Ph.D. 1950). He taught at Princeton (1950-52), Cornell (1953-59), and Massachusetts Institute of Technology before becoming (1962) professor of philosophy at Harvard. Rawls's chief work is A Theory of Justice (1971), in which he attempts, within the social contract tradition of John Locke , Jean Jacques Rousseau, and Immanuel Kant , to offer an alternative to utilitarian political philosophy. His system is developed from two basic principles: Each person has a right to the most extensive basic liberty compatible with like liberty for others; and inequalities in the distribution of wealth and power are just only when they can be reasonably expected to work to the advantage of those who are worst off. For Rawls, justice does not require equality in social position, but it does require that people share one another's fate. By providing the social contract tradition with a formidable philosophic defense, Rawls's book revived interest in systematic political theory.

    John Rawls fue uno de los teóricos políticos más influyentes en la segunda mitad del siglo XX. Desde la publicación de su obra maestra "Una teoría de la Justicia" (1971) se fueron sucediendo oleadas de apoyo y crítica a sus postulados.
    Después de la denominada Crisis de los paradigmas, la filosofía o teoría política padeció un receso tal que parecía anunciar su desaparición del ámbito del debate teórico. A esta situación contribuyó, en no menor medida, la dominación de las teorías utilitaristas en el estudio político y social con un carácter teleológico por un lado así como consecuencialista por el otro. Además, el utilitarismo presenta un atractivo inherente a su utópico devenir, no sólo toma como punto de referencia a individuos “reales” de “carne y hueso” en las decisiones entorno a conflictos sociales, sino que también aparenta basarse en la idea de igualdad al tomar a todos los actores –prima facie– como iguales. Así, la obra de John Rawls aparece como una inminente respuesta al utilitarismo reinante. Es una vehemente y veraz crítica a la falsedad detrás de los apelativos utilitaristas que no necesariamente resultan éticamente correctos y que mientras apelan al principio de mayorías, dejan fuera a muchos agencies sociales (las minorías por ejemplo) lo cual es contraintuitivo en las democracias liberales modernas caracterizadas por el pluralismo y, peor aún, es un acto plagado de injusticia.

    The politics of John Rawls
    This is a political summary of the defects of John Rawls' contractarian liberalism. Rawls Theory of Justice (1971) is the most influential normative work of political philosophy of the last two generations. In 1993 it was followed by a broader work on Political Liberalism. Rawls later work claims that his concerns are not metaphysical, but political: a stable and workable society in the western liberal tradition. In reality, all his work is a justification of liberal societies against others. Worse, it is a justification of the inequality and injustice in those societies, and a model for a conservative future. Rawls died on 24 November 2002. Last update 11 January 2003.
    Objections to the Theory of Justice
    The form of social contract described by John Rawls in A Theory of Justice can be called the 'fictive assembly' type. In another 1970's version, by Bruce Ackerman, the assembly is more explicit - the inhabitants of a planet draw up a social contract on a spaceship ( Social justice in the Liberal State New Haven: Yale University Press, 1980). In both cases, the social contract is the contract which would be confirmed by the entire population, under ideal conditions, after perfect and complete consideration.
