OF THE UNITED NATIONS ON REFUGEES
Thursday, 7 November 2002 Mr. Chairman, Once again, the Holy See welcomes the Report of the United Nations High Commissioner for Refugees and adds its voice to those who commend the office of the High Commissioner for its fine work in promoting and protecting the rights and well being of the some of the world’s most vulnerable persons. My Delegation is pleased to note that, in the words of the High Commissioner, "Slight reduction from 21.1 million in 2000 to 19.8 million at the end of 2001", of persons of concern to the High Commissioner. With all that the people of the world have witnessed in the past twelve months, any decrease in the number of persons separated from home and family is a welcome sign of the unbreakable spirit which binds all people into one family. At the same time, my Delegation is distressed that the Report states that some people found borders that were closed to many or suffered violence, xenophobia and the denial of fundamental rights. Once again, the Holy See realizes that the world has gone through many changes in the past year. At the same time, however, it is those very changes and the situations that have risen that should focus on the reasons for the existence of the Office of the High Commissioner for Refugees. In December 2000, the United Nations celebrated the Fiftieth Anniversary of the Statute of the Office of the United Nations High Commissioner for Refugees. As it has done for more than these fifty years, since before the formal establishment of the Office of the High Commissioner, the Holy See continues to lend its support and take its place, within the world community to provide care and protection to those who have been forced from their homes, no matter what the reason.

G.A. res. 428 (V), annex, 5 U.N. GAOR Supp. (No. 20) at 46, U.N. Doc. A/1775 (1950). CHAPTER I. - GENERAL PROVISIONS 1. The United Nations High Commissioner for Refugees, acting under the authority of the General Assembly, shall assume the function of providing international protection, under the auspices of the United Nations, to refugees who fall within the scope of the present Statute and of seeking permanent solutions for the problem of refugees by assisting governments and, subject to the approval of the governments concerned, private organizations to facilitate the voluntary repatriation of such refugees, or their assimilation within new national communities. In the exercise of his functions, more particularly when difficulties arise, and for instance with regard to any controversy concerning the international status of these persons, the High Commissioner shall request the opinion of an advisory committee on refugees if it is created. 2. The work of the High Commissioner shall be of an entirely nonpolitical character; it shall be humanitarian and social and shall relate, as a rule, to groups and categories of refugees.

The second Nobel Peace Prize for the United Nations went not to an individual but to one of its specialized agencies: the Office of the United Nations High Commissioner for Refugees (UNHCR). Seen as a bridge between the community of States, as reflected by the institution of the United Nations, and the world community of individual men and women, many of whom are stateless, UNHCR focuses global attention on those who find themselves living outside known boundaries and subject to prejudice, persecution and poverty. The Office of the High Commissioner for Refugees was established after the First World War by the League of Nations as a result of the initiative of Fridtjof Nansen, a Norwegian explorer, scientist and statesman, who was awarded the 1922 Nobel Peace Prize for his "leadership, vigour and spirit" in the service of refugees. After his demise, the "Nansen Office" continued his work and was similarly honoured in 1938 with the Nobel Peace Prize.

It is quite remarkable that the definition of a refugee, formulated in 1950 in an essentially European context and marked by the traumatic experience of the Second World War and the period of the cold war, should still apply today to situaLions which ... could not have been foreseen 30 years ago." Thus spoke Poul Hartling, in his Nobel Lecture of 11 December 1981, as Head of the Office of the United Nations High Commissioner for Refugees (UNHCR). The UN refugee agency was honoured for the second timehaving the unique distinction of winning the Nobel Peace Prize twice in less than three decades, in 1954 and in 1981. The agency has evolved and seen its focus shift from its initial post-Second World War mandate to the suffering generated by tire often violent birth of new nations. Uneven power developments worldwide, resulting in increased tensions, disturbances and conflicts, continue to cause massive upheavals in populations. Tire sheer increase in the numbers of refugees forced to flee injustice, persecution, oppression and even extermination in their native land, leaving behind familiar cultures and peoples, has forced UNHCR to adapt to new situations, adding to its mandate the voluntary repatriation and rehabilitation of refugees in their country of origin.

Distinguished delegates, ladies and gentlemen, it is a great pleasure to be invited to provide a presentation on civil-military cooperation in peacekeeping and humanitarian operations at this NATO-Croatia seminar here in Florence. There is a long-standing tradition of military forces assisting civilian actors. The military are after all recruited from civil society, and although additional laws may apply while they are serving, they remain members of civil society when not in uniform. During national emergencies, the military are called upon to assist in maintaining law and order if the situation exceeds the response capacity of the police. They are often used for natural, technological or environmental disaster response. Their standing response capacity and unique skills can also exceptionally be called upon when strikes disrupt public services or utility supplies. In these circumstances, as well as during their use in conflict, they remain responsible to their civilian masters – their government. Given the existence of strong European regional institutions and alliances, national military forces can also be called upon to assist in multinational, regional or international disaster response. The 1994 Oslo Guidelines provide a mechanism for this consensual use of military and civil defence assets. In ideal circumstances, a regional response should provide a quicker, more culturally-sensitive response.

Commission on Human Rights Hears Update on Kosovo, Completes Debate
on Advisory Services and Technical Cooperation Programmes
High Commissioner for Human Rights Mary Robinson told the Commission on Human
Rights this afternoon that the number of refugees and displaced persons in the Kosovo conflict was still growing. In her weekly update on the situation in the Balkans, Mrs. Robinson said human-rights violations in the Federal Republic of Yugoslavia had not ceased, and again urged responsible authorities there to work in concert with the international community to reach a peaceful resolution to the conflict. Her comments came after the Commission completed the debate on its agenda item on advisory services and technical cooperation in the field of human rights. Mrs. Robinson described a number of aspects of the conflict, including increased flows of

Whereas the Office of the United Nations High Commissioner for Refugees (hereinafter referred to as "UNHCR") is entrusted with responsibilities for refugees by its Statute annexed to General Assembly Resolution 428 (V) of 14 December 1950 and with responsibilities for displaced persons in refugee-like situations under subsequent resolutions of the General Assembly; and Whereas the International Labour Organisation (hereinafter referred to as "ILO") is entrusted with the promotion of social justice for working people everywhere and the improvement of their working and living conditions through the framing of standards, research and policy formulation and technical co-operation, in accordance with its Constitution;and Whereas in regard to standards for the treatment of refugees as well as assistance to refugees there are areas of common concern in which the present co-operation between the two organisations should be further strengthened and developed. Now therefore UNHCR and the ILO have agreed on the following: International protection 1. In the exercise of its international protection function, UNHCR is called upon to ensure that refugees are treated in accordance with recognised international standards, including standards concerning economic and social rights which are defined, inter alia, in the 1951 United Nations Convention relating to the Status of Refugees. Under Article 35 of this Convention, States are called upon to facilitate the duty of UNHCR to supervise the application of the provisions of the Convention. A corresponding provision is to be found in Article II of the 1967 Protocol relating to the Status of Refugees.
