Canada has it. Massachusetts is expected to get it any day. The Goodridge decision there could set off a legal, political, and cultural battle in the courts of 50 states and in the U.S. Congress. Every politician, every judge, every citizen has to decide: Does same-sex marriage matter? If so, how and why? The timing could not be worse. Marriage is in crisis, as everyone knows: High rates of divorce and illegitimacy have eroded marriage norms and created millions of fatherless children, whole neighborhoods where lifelong marriage is no longer customary, driving up poverty, crime, teen pregnancy, welfare dependency, drug abuse, and mental and physical health problems. And yet, amid the broader negative trends, recent signs point to a modest but significant recovery. Divorce rates appear to have declined a little from historic highs; illegitimacy rates, after doubling every decade from 1960 to 1990, appear to have leveled off, albeit at a high level (33 percent of American births are to unmarried women); teen pregnancy and sexual activity are down; the proportion of homemaking mothers is up; marital fertility appears to be on the rise. Research suggests that married adults are more committed to marital permanence than they were twenty years ago. A new generation of children of divorce appears on the brink of making a commitment to lifelong marriage. In 1977, 55 percent of American teenagers thought a divorce should be harder to get; in 2001, 75 percent did.

In a 4-3 ruling, the Massachusetts high court held that the millennia-old, cross-cultural definition of marriage as the union of a man and a woman is utterly irrational. Using the lowest level of scrutiny (the "rational basis" test, which almost always results in deference to the legislature), four well-educated judges could not think up any reason other than "animus" why the people of Massachusetts and their elected representatives might not want same-sex marriage. Only a fool or a madman (or a bigot), they implied, could possibly disagree. The judges gave the state legislature 180 days to respond, presumably by revising marriage laws to include same-sex couples. At this writing, it is 179 days and counting until gay marriage comes to America. Massachusetts governor Mitt Romney responded by endorsing an amendment to the state constitution, but given the complicated amendment process, the soonest Massachusetts citizens could vote to overturn gay marriage is November 2006.

By Maggie Gallagher amesh Ponnuru (writing in the July 28, 2003 issue of National Review ) is right about several things: We are poised to lose the gay-marriage battle badly. Arguments about a slippery slope to polygamy are not untrue, but ineffectual, signs of a profound weakness in our culture of marriage. Polygamy is not worse than gay marriage, it is better. At least polygamy, for all its ugly defects, is an attempt to secure stable mother-father families for children. What is missing from this and many other analyses on this issue is a declaration of the stakes. Gay marriage is not some sideline issue, it is the marriage debate. Losing it (as John O'Sullivan makes abundantly clear ) means losing marriage as a social institution, a shared public norm. Marriage will become (as it is in Sweden) a religious rite, with little public or social significance. As a legal institution, marriage will lose its coherence. By embracing gay marriage the legal establishment will have declared that the public purposes of marriage no longer include anything to do with making babies, or giving children mothers and fathers. Legitimating same-sex marriage amounts to an official declaration that, as Evan Wolfson put it in a debate with me in a just-released book

By Maggie Gallagher I n Massachusetts, legislators are frantically debating the wording of various state constitutional amendments that would overturn the Goodridge decision, in which, by the slimmest of 4-3 margins, the state's highest court declared it could find no rational reason why anyone would not want gay marriage. The first "constitutional convention" met February 11, voted down several versions, and adjourned to March 11. Now influential opponents of gay marriage appear to be ready to sign on to a truly disastrous "compromise," a constitutional amendment that would a) declare "married" to be a unique status consisting of a man and a woman and b) simultaneously declare civil unions to be, now and forever, the exact legal and constitutional equivalent. Some legislators are even quoting me in defense of this bill. "Civil unions," I wrote in the Weekly Standard , are "one bad step" away from a marriage culture, while gay marriage is "the end of the road."
