Roger Ailes’s ‘Fair and Balanced’ lawsuit against Al Franken seems stupid — until you take a closer look
BY DAN KENNEDY ROGER AILES, the former Republican politico who created the Fox News Channel, surely knows all about unintended consequences. Yet the way his silly lawsuit against political satirist Al Franken has played out was so utterly predictable that all you’re left with are questions. Was this a monumental misjudgment by someone who’s ordinarily regarded as one of the shrewdest operators in the business? Or is this exactly what Ailes had intended? Consider what has happened since August 12, when a snickering news media reported that Fox News was suing Franken for infringing on its trademark for the phrase "fair and balanced" in the title of Franken’s new book, Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right (EP Dutton). • The book immediately shot to the upper reaches of Amazon.com’s sales rankings, even though it won’t be released until September 22. As of this past Tuesday, it was number six, after briefly hitting the top spot last week. And no, it didn’t do this well on its own merits. According to the Washington Post , it was number 489 before news of Fox’s suit became public.

I am not an expert on McCain-Feingold and other election laws which dangerously dance on the toes of the First Amendment , but isn't Air America in violation by putting corporate money directly towards Kerry election efforts. I say this not because they have a liberal line per se, but because comedian Al Franken has specifically said his show has one purpose: to un-elect Bush and put in a Democrat.

Comments I can't imagine McCain-Feingold applies to a radio host's opinion - if it did, things like newspaper editorial pages would be violations, too. Posted by: ceejayoz at May 14, 2004 09:23 AM Technically, the examples you've cited couldn't be interpretted as violating the law, since he's advocating against Bush, not explicitly for Kerry. Apparently that distinction matters. However, I'm sure that he does advocate for Kerry directly as well. I just don't think anyone cares. Every single conservative radio show I listen to (Rush, Hannity, Boortz) all explicitly emplore their listeners to vote for Bush. What would become of talk radio if they couldn't? (and as an aside, why didn't you mention them? Hannity is always going on about "intellectual honesty"... so shame on you.)

AUGUST 20Comedian Al Franken last month wrote an apology letter to Attorney General John Ashcroft, admitting that he was not truthful when he previously sought Ashcroft's views on abstinence. In June, Franken wrote to Ashcroft seeking the AG's story for "Savin' It," which the performer described as a book "about abstinence programs in our public schools." On its face, the letter (which you'll find below) reads like a joke, with Franken advising Ashcroft to "share a moment when you were tempted to have sex, but were able to overcome your urges through willpower and strength of character. Be funny!" Franken also asked, "Did a young woman ever think you were homosexual just because you wouldn't have sex with her? Be serious!" Franken's missive, written on letterhead from Harvard University's John F. Kennedy School of Government, claimed that he had already received abstinence stories from other prominent Republicans, including Condoleezza Rice and Senator Rick Santorum. However, in his July 11 apology , Franken admitted that he had not received those abstinence stories and called his solicitation to Ashcroft, "an imprudent attempt at satire."

Norm Coleman, R-Minn., in 2008 at better than 50-50, and said he would make a decision by late next year. "I've thought about it and discussed it with my family more," Franken told The Associated Press Saturday, before attending the annual White House Correspondents' Association dinner here.     Fox sought to halt distribution of author-comedian Al Franken's book. Story Tools NEW YORK (CNN) Saying "This is an easy case," a federal judge ruled Friday against Fox News in its lawsuit asserting that a book by liberal satirist Al Franken violates its trademarked slogan, "fair and balanced." Fox was seeking an injunction to halt distribution of "Lies and the Lying Liars Who Tell Them: A Fair and Balanced Look at the Right." U.S. District Judge Denny Chin, after listening to about half an hour of oral arguments, said the lawsuit was "wholly without merit, both factually and legally." The 377-page book, which originally had a late September release date, went on sale Thursday. Fox objected especially to its cover, which displays the "fair and balanced" phrase in its subtitle and an unflattering photograph of the news channel's most popular host, Bill O'Reilly. It argued that the cover layout "is likely to cause confusion among consumers as to the origin and sponsorship of the book." The judge disagreed.

He's sorry he got caught, but smugly silent about making fun of countless American kids who have taken abstinence vows. Thanks to Court TV's Smoking Gun Web site (www.thesmokinggun.com), we now know that the Saturday Night Live leftover abused his position as an "academic fellow" (now that's funny) at the Harvard University Kennedy School of Government's Shorenstein Center on the Press, Politics and Public Policy in a puerile attempt to trick Attorney General John Ashcroft into publicly sharing his personal experience with abstinence. Franken urged Ashcroft to share his abstinence story for "a book about abstinence programs in our public schools entitled, 'Savin' It!'" (lie). He assured Ashcroft that the book would document how the Bush administration is "setting the right example for America's youth" (lie). And he breezily informed Ashcroft that he had already "received wonderful testimonies from HHS Secretary Tommy Thompson, William J. Bennett, White House Press Secretary Ari Fleischer, Senator Rick Santorum, and National Security Advisor Condoleezza Rice" (lie, lie, lie, lie, lie).
