In fact, as the Los Angeles Times reported October 10, Assistant U.S. Attorney Mary Houghton's court pleadings sought Chong's harsh punishment because he got rich "glamorizing the illegal distribution and use of marijuana" in films that "trivialize law enforcement efforts to combat drug trafficking and use." Chong must have wondered when such activities became criminal. Perhaps the FBI now will arrest Sean Penn for hilariously smoking grass in Fast Times at Ridgemont High . Then they can handcuff Denzel Washington for portraying a crooked narcotics officer in Training Day At last, the homeland is secure from Chong, a 65-year-old comic whose merchandise spared potheads from fumbling with rolling papers. Chong was facing charges in a Pittsburgh, Pennsylvania court over selling marijuana pipes, known as bongs, through his company Nice Dreams Enterprises, and through website advertisements giving his "celebrity" endorsement. He admitted his range of glass bongs and pipes, known as Chong glass, were used to smoke marijuana. Chong's lawyers said the star admitted responsibility for selling the accessories, but was careful not to sell them to minors. The actor, who appeared in a string of films about marijuana with Cheech Marin, said he did not personally use drugs. "I don't smoke; I quit," he said. New film Chong, 64, could face up to three years in jail and a fine of over $250,000 (£161,000) if found guilty. He comes up for sentencing on 11 September. He was released on a $20,000 (£12,900) bond. Prosecutors said they would not be pushing for a jail term, even though guidelines recommended a six months-to-one year sentence.

The 65-year-old writer and director of some of America's most beloved comedies is astonished to find that his movies, in part, earned him nine months in the federal pen. "They came after me because of the movies, Up in Smoke , Cheech & Chong, and because of my act since 1968," says Chong. "They took my character to be my real persona." Is that your real persona? I have to ask. "No," Chong chuckles. "It's a character. It's like the Furry Freak Bros. Cheech & Chong are like comic-strip characters. Everybody knows that the real Cheech isn't the Cheech from Up in Smoke, and the real Tommy Chong isn't the Tommy Chong from the 'Hey man' dude. "But I was selling bongs with my picture on 'em.
