Tommy Chong, actor and comedian of "Cheech and Chong" fame, was sentenced today to serve nine months in federal prison after pleading guilty to drug paraphernalia trafficking. Chong, 65, had asked for leniency from the judge, saying he's been working with youth groups, teaching filmmaking and speaking out against drug use. In addition to prison time, Chong must pay a fine of $20,000 and forfeit more than $103,000 from his business selling "drug paraphernalia" such as his own line of artistic water pipes. Chong was nabbed in February 2003 during a series of DEA raids on internet head shops, retailers who sold smoking-related products. The raids resulted in 55 arrests. One might question the usefulness of prosecuting retailers in the never-ending War on Some Drugs. Also note that thousands of mainstream retail stores in the US sell similar products. At what point should these items cross the line from art or legal tobacco-smoking items to illegal drug accessories? Should online stores be raided for selling glowsticks, pacifiers, and fuzzy backpacks ? Is it possible or reasonable for the DEA to attempt to make a real dent in this large market? Sponsors

    Chong is to be sentenced Sept. 11 and faces a maximum sentence of three years in prison and a $250,000 fine. Federal sentencing guidelines call for six months to one year incarceration.

    Tommy Chong, who played one half of the dope-smoking duo in Cheech and Chong movies, pleaded guilty in federal court Tuesday to conspiring to sell drug paraphernalia.
    Chong also pleaded guilty on behalf of his business, Nice Dreams Enterprises, which made a line of marijuana bongs and pipes. Doing business as Chong Glass, Nice Dreams Enterprises sold glass pipes and bongs that Chong acknowledged were used to smoke marijuana.
    Chong's attorneys said he was accepting responsibility, but noted he was careful not to sell to minors.
    "This isn't his work. His work is that of a comedian and satirist," said attorney Richard G. Hirsch.

On September 11, 2003, comedian Tommy Chong was sentenced to nine months in prison, a fine of $20,000, and the forfeiture of about $120,000 in assets. He also had to give up his internet domain name of tommychong.com.
    Chong, best known as half of the famed pot-comedy duo Cheech and Chong, was the founder of a business called Nice Dreams, which manufactured and sold bongs under the name Chong Glass. The business was operated by Chong's son, Paris.
    In May 2003, Chong plead guilty to charges of "conspiring to distribute drug paraphernalia," after a sting operation in which federal agents in Pittsburgh ordered his bongs over the Internet, thus ensuring that the items were sent across state lines.
    Undercover cops also bought two of Chong's bongs at a store in Texas. They received Chong's autograph on the bongs, and got a t-shirt depicting Chong smoking from one.

    Early on the morning of February 24, 2003, the Pacific Palisades, CA, home of actor Tommy Chong was raided by federal officers. In classic "hey, man" fashion, Chong sleepily told the intruding officers that they must have the wrong house. The feds replied they most certainly had the right house, as well as a warrant to search it for glass pipes, of which they found a bunch, along with a pound of high-grade marijuana. When first asked if there were any pot on the property, Chong allegedly replied, "Of course ; I’m Tommy Chong."

The actor/comedian Tommy Chong was sentenced to 9 months and $20,000 for the sale of "illegal drug paraphernalia". As a condition of his sentence he also must relinquish the Internet domain name he used for the sale of his product and "forfeit" over $100,000. Alert Americans should see this for what it is: a sign of our country slowly becoming a fascist state.
    The manufacture and sale of pipes and bongs is completely legal in many states. Said articles only become illegal drug paraphernalia once they have been used in the consumption of illicit substances. There is no legal distinction between pipes intended for marijuana and pipes intended for tobacco, which can just as easily be used for marijuana. Tommy Chong was implicated in this case only after the DEA set up a sting business in a state where bongs are illegal and ordered products from his company. This is entrapment.
    Eliminating sources of paraphernalia in no way combats illegal drugs. Those seeking to stop the use of marijuana would better expend their energy and resources by targeting the traffic of the drug itself, and by educating the public about the drug.

    Tommy Chong Pleads Guilty to Drug Paraphernalia Charge Comedian and satirist Tommy Chong became the first defendant to plead guilty in federal court to selling drug paraphernalia as part of Operation Pipe Dreams. The maximum penalty is 3 years, but federal sentencing guidelines provide for 6 months to 1 year. He is also eligible for home detention rather than prison. His lawyer, Richard Hirsch (an excellent lawyer and friend of ours who practices in LA with another terrific lawyer, Michael Nasitir) said: Chong's attorneys said he was accepting responsibility, but noted he was careful not to sell to minors. "This isn't his work. His work is that of a comedian and satirist," said attorney Richard G. Hirsch. After the hearing, Chong said he did not use drugs. "I don't smoke; I quit," he said. This is the first federal prosecution in a decade for drug paraphernalia sales. As usual, Ashcroft is out of step, moving backwards. Putting bong sellers out of business and in jail is hardly going to equate to fewer people smoking pot. Here's more about Operation Pipe Dreams.
