Teachers may make multiple copies for classroom use. Circular 21 No more than one copy per student. Usage must be: At the "instance and inspiration of a single teacher" and when the time frame doesn't allow enough time for asking permission. Only for one course in the school. No more than nine instances per class per term (current news publications such as newspapers can be used more often). Don't create anthologies. "Consumables" can't be copied. Don't do it every term (if time allows, seek permission). Can't be directed by "higher authority." Copying can't be substitute for buying. Copies may be made only from legally acquired originals.

The Feist Library of Congress Title 17, Section 105, United States Code provides that: The United States became a Berne signatory in , and the treaty entered into force with respect to the US on March 1, . The U.S. is also a party to TRIPS , which itself requires compliance with Berne provisions, and is enforceable under the WTO dispute resolution process. To meet the treaty requirements, protections were extended to architecture (where previously only building plans were protected from copying, not buildings), and certain moral rights of visual artists. Some legal scholars question whether the U.S. is fully in compliance with TRIPS or Berne requirements, particularly given the far reach of the fair use defense.
