To those exposed to the Panglossian euphoria of Net enthusiasts during the 1990s, this vision seems unbelievable. After all, wasn’t the Internet supposed to be the defining example of empowering technology? Freedom was allegedly built into the very bones of the Internet, designed to withstand nuclear blasts and dictatorial attempts at control. While this cyberslack has its downside—porn, credit-card fraud and insincere bids on eBay—it was considered a small price to pay for free speech and friction-free business models. The freedom genie was out, and no one could put it back into the bottle.

Clouds gather over Amsterdam as I ride into the city center after a day at the headquarters of DigiCash, a company whose mission is to change the world through the introduction of anonymous digital money technology. I have been inundated with talk of smart cards and automated toll takers and tamper-proof observer chips and virtual coinage for anonymous network ftps. I have made photocopies using a digital wallet and would have bought a soda from a DigiCash vending machine, but it was out of order. My fellow passenger and tour guide is David Chaum, the bearded and ponytailed founder of DigiCash, and the inventor of cryptographic protocols that could catapult our currency system into the 21st century. They may, in the process, shatter the Orwellian predictions of a Big Brother dystopia, replacing them with a world in which the ease of electronic transactions is combined with the elegant anonymity of paying in cash.

But some computer-security experts warn of the possibility of stolen elections By Steven Levy Newsweek Nov. 3 issue - After the traumas of butterfly ballots and hanging chad, election officials are embracing a brave new ballot: sleek, touch-screen terminals known as direct recording electronic voting systems (DRE). States are starting to replace their Rube Goldbergesque technology with digital devices like the Diebold Accu-Vote voting terminal. Georgia uses Diebolds exclusively, and other states have spent millions on such machines, funded in part by the 2002 federal Help America Vote Act. Many more terminals are on the way. advertisement
Unforunately, the machines have “a fatal disadvantage,” says Rep. Rush Holt of New Jersey, who’s sponsoring legislation on the issue. “They’re unverifiable. When a voter votes, he or she has no way of knowing whether the vote is recorded.” After you punch the buttons to choose your candidates, you may get a final screen that reflects your choices—but there’s no way to tell that those choices are the ones that ultimately get reported in the final tally. You simply have to trust that the software inside the machine is doing its job. It gets scarier. The best minds in the computer-security world contend that the voting terminals can’t be trusted. Listen, for example, to Avi Rubin, a computer-security expert and professor at Johns Hopkins University who was slipped a copy of Diebold’s source code earlier this year. After he and his students examined it, he concluded that the protections against fraud and tampering were strictly amateur hour. “Anyone in my basic security classes would have done better,” he says. The cryptography was weak and poorly implemented, and the smart-card system that supposedly increased security actually created new vulnerabilities. Rubin’s paper concluded that the Diebold system was “far below even the most minimal security standards.” Naturally, Diebold disagrees with Rubin. “We’re very confident of accuracy and security in our system,” says director of Diebold Election Systems Mark Radke.

They chronicle the 54 days that Lawrence Lessig, the Elvis of cyberlaw, helped Judge Thomas Penfield Jackson with the mother of all tech litigation: Department of Justice v. Microsoft . It was to be Lessig's greatest moment. Once a "right-wing lunatic," he's become a fire-breathing defender of Net values.

In late 1997, after reading a profile of the super-brainy professor in the Harvard Law Bulletin , Judge Jackson had tapped Lessig to sort out the technical aspects of the case. "He was as knowledgeable as they come," says Jackson, who sits on the US District Court in DC. For the next two months, Lessig and his overqualified clerk, fellow Harvard Law professor Jonathan Zittrain, worked almost nonstop to produce a report. Lessig's time logs, which document the 278 hours he spent on the case (billed at $250 per hour, a bargain rate for someone with his credentials), reveal only one day off: Christmas. Some days he clocked 11 hours.
