The Roman Catholic Church in England and the Threat of Heresy
England's position in the Roman Catholic Church was the product of a number of distant historical events. In 1172 King Henry II was forced to concede under Papal pressure to recognize clerical rights of sanctuary and to have their cases heard in ecclesiastical courts. These extraordinary rights, called benefit of clergy, continued to be exercised by the "churchmen" until late in the fifteenth century when Henry VII was able to get them set aside in the cases of treason and murder. King John had been forced to surrender his kingdom to the Papacy in 1213; subsequently he received it back as a fief. Innocent III and subsequent Popes had claimed all English churches as papal property and England itself as a province of the Roman See. Nevertheless, the Statute of Mortmain in 1279 had attempted to regulate the sale or other transfer to the Church of lands held in tenancy to great seigneurs and even to the King. Tenants sometimes did this innocently, but other times it served as a means of escaping their obligations. Mortmain deprived them of this option by forcing all sellers to secure first a license from the King. This only slowed the expansion of the Church's landed wealth because it was not effectively or consistently enforced.

INTRODUCTION
“But this is the covenant that I will make with the house of Israel after those days, says the Lord. I will put my law in their minds, and write it on their hearts; and I will be their God, and they shall be my people. No more shall every man teach his neighbor, and every man his brother, saying, ‘Know the Lord,’ for they all shall know me, from the least of them to the greatest of them, says the Lord” (Jer. 31:33-34). A.G. Dickens wrote that: In England as elsewhere, the Protestant Reformation sought first and foremost to establish a gospel-Christianity, to maintain the authority of the New Testament evidence over mere church traditions and human inventions masquerading as universally approved truths and ‘unwritten verities.’” And, in England, it was Tyndale upon whom fell the burden of drawing the academic enterprise of humanism out of its university setting and bringing it to the people in the form of the English Bible. “In giving them the Scripture in the common tongue,” Hughes tells us, “he was giving them power to study and come to know God’s word themselves, that they would no longer need rely on the mediatorial role of a priestly clergy, but would know God’s word as it was written on their hearts.”

In that year, the Peerages of England and Scotland were replaced by one Peerage of Great Britain. Until the passage of the House of Lords Act 1999, all Peers of England could sit in the House of Lords. The ranks of the English peerage are Duke, Marquess, Earl, Viscount, and Baron. While most newer English peerages descend only in male line, many of the older ones (particularly older baronies) can descend through females. Having preached several times in the neigh­bourhood of the Old Church,’ to very unfeeling congregations, I rode to Dudley’s ferry, in order to cross York River, but was disappointed, the boat being on the opposite side. We returned to the widow Chapman’s, being unwilling to stay at the tavern, and had a congregation of sixty or seventy people: we then rode about five miles to a ferry, and passed over immediately. Arrived at the other side, we found the small-pox and camp-fever raging, and heard of several poor creatures, white and black, that had died on the road. Ah! we little know what belongs to war, with all its train of evils; churches converted into hospitals and barracks, houses pillaged or burnt,—whjch last has been the sad fate of the palace at Williamsburg. I met with five or six faithful souls on our fast day, and the Lord was present with us. There is considerable distress amongst our societies, caused by some of the local preachers, who are not satisfied unless they administer the ordinances without order or ordination, and the whole circuit appears to be more or less tinctured with their spirit. Utopia
(1516), whose delicate ironies would come to seem self-ironies, and whose playful negatives would curdle into the mean calculations of More's later years. For in the inverted island world of Utopia, divorce is permissible, and the inhabitants can follow any religion they like; these would become the two determinants of More's later fixity. The founder of Utopia, writes More, could see that religious differences sowed discord. Thus he allowed freedom of worship. He himself "might do the best he could to bring others to his opinion, so that he did it peacably, gently, quietly and soberly. . . . If he could not by fair and gentle speech induce them unto his opinions, yet he should use no kind of violence and refrain from displeasant and seditious words." This was not, alas, portable wisdom; More would punish religious dissent not only with "displeasant" words but with state violence, and would come to say that he would rather not have written Utopia than see one heretic prosper.
