The Open Meetings Act (the "Act") requires that a "governmental body shall give written notice of the date, hour, place, and subject of each meeting held by the governmental body." Tex. Gov't Code Ann. § 551.041 (Vernon 1994); see also id. § 551.001(3) (Vernon Supp. 2004) (defining "governmental body" to include a county commissioners court, a municipal governing body, a deliberative body classified as a department, agency, or political subdivision of a county or municipality, a school district board of trustees, a county board of education, the governing board of a special district created by law, and water districts). The Act expressly states where notice shall be posted, although posting requirements vary according to the particular governing body posting notice. See id.

The Texas Automobile Theft Prevention Authority (the "Authority"), established under article 4413(37) of the Revised Civil Statutes, was initially created as a part of the criminal justice division of the governor's office. See Act of May 25, 1991, 72d Leg., R.S., ch. 243, § 1, 1991 Tex. Gen. Laws 1138, 1138-41. The agency was transferred to the Department of Transportation in 1997.     Secret fee allegation may lead to charges By Michael Ware A FORMER National Party ministerial adviser may face criminal charges over a secret payment he allegedly received to push through an approval for the luxurious Oyster Cove golf course development. Police organised crime taskforce officers have given the Director of Public Prosecutions a brief of evidence calling for criminal charges against ousted adviser Chris Nicholls and company officers. Investigations into the alleged money-for-influence scandal have centred on claims Mr Nicholls was paid up to $20,000 by the Gold Coast company behind the $350 million Oyster Cove project at Hope Island, 60km south of Brisbane. Mr Nicholls, who returned to South Australia after his sacking in 1997, has denied any wrongdoing in his dealings with the company. He said the investigation was part of a Criminal Justice Commission "smear" for evidence he gave naming its former senior crimefighter, Mark Le Grand, as the source of a confidential leak. The prospective prosecution has been held up for almost six months as DPP Royce Miller, QC, considers whether to lay charges.

ORDER REGARDING ATTORNEY FEES Summary Following Lockart v. New Hampshire Ins. Co., 1999 MT 205, counsel for a medical provider wrote an insurer asserting that the medical provider must be paid its fees without deduction of the 20% attorney fee lien which the Supreme Court had decided must come out of medical benefits when the attorneys work resulted in obtaining medical benefits in a disputed liability case. Counsel attempted to distinguish Lockart as applying only when other benefits were not sufficient to satisfy the fees. WCC ordered counsel to file objections in the WCC if this was the position his client took regarding payment of fees in this case. Counsel did not file objections and informed the Court his client had not appeared in the matter. Held Counsel's argument is frivolous under Lockart, which is unequivocal and forecloses his argument. Counsel may have avoided sanctions by not appearing in this case, but he will not be able to continue to make this frivolous contention in other matters without appearing in the WCC, which has exclusive jurisdiction over medical benefits disputes in workers' compensation cases.
