Kevin Murray (D-Los Angeles) the same lawmaker who authored and promoted California's spam law that punishes illegal spammers with up to $1 million in fines per incident and a corresponding California Assembly bill from Kevin McCarthy (R-Bakersfield) both would impose the penalties on Internet users who share commercial recordings or audiovisual work electronically. Washington, DC February 9, 1998 Dear Senator McCain: I write on behalf of the Electronic Frontier Foundation (EFF) to urge that the Senate make no further attempts to regulate speech on the Internet. Existing federal and state legislation covering such matters as the creation and distribution of child pornography and the solicitation of minors for sexual activity already provide sufficient tools to protect America's children. The new legislation under discussion will inevitably run afoul of the free speech protections of the First Amendment, just as Congress' attempt to impose an "indecency" standard on the Internet was struck down last year in Reno v. ACLU. Indeed, as the Congress considers new legislation it is worth noting the Supreme Court's warning that: The record demonstrates that the growth of the Internet has been and continues to be phenomenal. As a matter of constitutional tradition, in the absence of evidence to the contrary,we presume that governmental regulation of the content of speech is more likely to interfere with the free exchange of ideas than to encourage it. The interest in encouraging freedom of expression in a democratic society outweighs any theoretical but unproven benefit of censorship. EFF is particularly concerned about the possibility that the Congress may seek to block access to "indecent" or "harmful" online material to schools receiving Universal Service Funds by requiring the use of filtering software. Filtering and blocking software is not the panacea that some of its advocates have suggested.

By EFF Nov 3, 2003, 17:52 Email this article Printer friendly page Diebold has delivered dozens of cease-and-desist notices to website publishers and ISPs demanding that they take down corporate documents revealing flaws in the company's electronic voting systems as well as difficulties with certifying the systems for actual elections. Swarthmore students Nelson Pavlosky and Luke Smith have published an email archive of the Diebold documents, which contain descriptions of these flaws written by the company's own employees. Diebold threatened not only the ISPs of direct publishers of the corporate documents, but also the ISPs of those who merely publish links to the documents. In one such instance, the ISP Online Policy Group (OPG) refused to comply with Diebold's demand that it prohibit Independent Media Network (IndyMedia) from linking to Diebold documents. Neither IndyMedia nor any other publisher hosted by OPG has yet published the Diebold documents directly. "As an ISP committed to free speech, we are defending our users' right to link to information that's critical to the debate on the reliability of electronic voting machines," said OPG's Colocation Director David Weekly. "This case is an important step in defending free speech by helping protect small publishers and ISPs from frivolous legal threats by large corporations."

(415) 436 9333 ext. 102 The Electronic Frontier Foundation (EFF) has joined the FoodSpeak Coalition a diverse group of civil liberties, consumer and environmental organizations, which has been formed to contest "Food Disparagement" laws that restrict free speech rights to discuss food related issues. The formation of FoodSpeak Coalition was announced today at a Washington DC press conference. Thirteen states have passed such laws, which are also popularly known as "veggie-libel laws." Many of these laws establish an extremely low legal standard for agribusiness to meet when it brings defamation actions against those critical of its products. In a highly publicized case, Texas cattlemen unsuccessfully sought to apply the Texas Food Disparagement law to talk show host Oprah Winfrey. Now the cattlemen are appealing and also suing Oprah in another action, this one in a state court. "EFF welcomes the opportunity to join as a founding member of the FoodSpeak Coalition," said its President Barry Steinhardt. "EFF is an organization dedicated to preserving the Free Speech rights on the Internet and the food defamation laws pose a direct threat to those rights on and off-line," Steinhardt continued.
