EFF Receives Funding for Patent Fight May 17, 2004 (WEB HOST INDUSTRY REVIEW) According to reports, The Electronic Frontier Foundation ( EFF.org ), an advocate of civil liberties on the Internet, says it will intensify its efforts to have the US patent and trademark office re-examine some patents it says are overly broad and restrict rights to the use of publicly available knowledge. Jason Schultz, staff attorney for EFF, says a number of patents deserve to be re-examined, including one-click online shopping, online shopping carts, the hyperlink, internationalizing domain names, pop-up windows, targeted banner ads, paying with credit cards online, framed browsing, affiliate linking and video streaming. In support of its efforts, the EFF recently received a $50,000 grant from The Parker Family Foundation, an organization involved in battles over digital media technologies. The news comes as several organizations are preparing to square off in a fight over digital media technology patents. One of the most high-profile cases involves several adult Web sites in a fight with Acacia Media Technologies Corporation, a company that owns patents on the process of transmitting compressed audio or video. Acacia has attempted to collect licensing fees from several adult companies who use the technology.

In 1941, Miller and Dollard proposed a theory of social learning and imitation that rejected behaviorist notions of associationism in favor of drive reduction principles. It was a theory of learning, however, that failed to take into account the creation of novel responses or the processes of delayed and non-reinforced imitations. In 1963, Bandura and Walters wrote Social Learning and Personality Development With the publication of Social Foundations of Thought and Action: A Social Cognitive Theory , Bandura (1986) advanced a view of human functioning that accords a central role to cognitive, vicarious, self-regulatory, and self-reflective processes in human adaptation and change. People are viewed as self-organizing, proactive, self-reflecting and self-regulating rather than as reactive organisms shaped and shepherded by environmental forces or driven by concealed inner impulses. From this theoretical perspective, human functioning is viewed as the product of a dynamic interplay of personal, behavioral, and environmental influences. For example, how people interpret the results of their own behavior informs and alters their environments and the personal factors they possess which, in turn, inform and alter subsequent behavior. This is the foundation of Bandura's (1986) conception of reciprocal determinism , the view that (a) personal factors in the form of cognition, affect, and biological events, (b) behavior, and (c) environmental influences create interactions that result in a

ARDG report complete
The final report of the ARDG has been completed, and with it the work of the ARDG. The report, not yet available to the public, was announced at the final ARDG meeting in Los Angeles on January 13. It contains the self-assessments of the vendors or proponents of the ten proposed technologies, together with remarks by ARDG members, vendor responses, and general comments. Remarks and general comments were contributed by only three ARDG members Philips, EFF, and CDT. EFF's general comments, which will be included in the final report, are available on our web site
True to their word, the ARDG co-chairs have not engaged in any "editorializing", nor in any attempt to select, recommend, or endorse any proposed technology. They simply collected the views of the various participants, recounted the history of ARDG's meetings, stapled them together, and called it a day. In its new "Unintended Consequences" report released Thursday, the Electronic Frontier Foundation ( EFF Hollywood studios, record labels and other intellectual property holders lobbied hard for the law, fearing that the Internet would become a forum for rampant piracy because it allows people to easily copy and distribute digital products. Unlike analog copies, which lose resolution with each replication, digital copies of products maintain their high quality. In its report, the EFF said aggressive applications of the law have reached beyond the intention of the measure. The EFF said the DMCA has had a threefold effect: chilling free expression and scientific research; jeopardizing fair use; and impeding competition. The study lists more than a dozen cases where intellectual property holders have wielded the DMCA in ways the EFF says are overly aggressive and chilling. The study cites cases including those of Ed Felten, a Princeton professor who backed down from giving a speech about his research under threats from the record industry;

Washington December 2, 1999Privacy and consumers groups and a leading security expert today asked the Federal Trade Commission to require software makers to close a technical loophole in many popular e-mail systems that allows senders of bulk commercial e-mail to track the surfing behavior of people who merely read the e-mail. http://www.tiac.net/users/smiths/privacy/cookleak.htm on the Web. Many e-mail readers display e-mail messages using a Web browser. If the message contains graphics retrieved from the web when the mail is opened, the loophole allows the recipient to be assigned a unique serial number in a "cookie," which will later be silently transmitted as the recipient surfs the Web. Many companies encode the recipient's e-mail address in the URL (web address) of the graphic, so that their servers can match the cookie to the e-mail address. Jason Catlett, President of Junkbusters Corp. said "Cookie leaks are the bug from spammers that keeps on bugging. It's intolerable that e-mail can be used to silently zap a nametag onto you that might be scanned by a site you visit later. It's like secretly barcoding people with invisible ink."

EFF Defends Right to Publish Links to Electronic Voting Memos
Electronic Frontier Foundation Media Release
On October 10, 2003, electronic voting company Diebold, Inc., sent a cease-and-desist letter to the nonprofit Online Policy Group (OPG) ISP demanding that OPG remove a page of links published on an Independent Media Center (IndyMedia) website located on a computer server hosted by OPG. Diebold sent out dozens of similar notices to ISPs hosting IndyMedia and other websites linking to or publishing copies of Diebold internal memos. OPG is the only ISP so far to resist the takedown demand from Diebold. "What topic could be more important to our democracy than discussions about the mechanics and legitimacy of electronic voting systems now being introduced nationwide?" said EFF Staff Attorney Wendy Seltzer. "EFF won't stand by as corporations like Diebold chill important online debate by churning out legal notices to ISPs that usually just take down legitimate content rather than face the legal risk."

The complaints were filed Jan. 14 in an effort to block the Internet distribution of a software utility called DeCSS, which breaks the encoding system used in millions of digital versatile discs (DVD). DeCSS was originally created by Norwegian programmers who reverse-engineered the DVD Content Scrambling System (CSS) to give computers running the Linux operating system DVD playback capability. ALSO Film studios file suit against accused DVD hackers The plaintiffs in the case are Universal City Studios Inc.; Paramount Pictures Corp.; Metro-Goldwyn-Mayer Studios Inc.; Tristar Pictures Inc.; Columbia Pictures Industries Inc.; Time Warner Entertainment Co.; Disney Enterprises Inc.; and Twentieth Century Fox Film Corp., according to a statement issued last Friday by the Motion Picture Association of America (MPAA).
