Details: A bill was filed by Charles Pollock, a citizen of the State of Massachusetts, on behalf of himself and all other stockholders of the company against the Farmers' Loan and Trust Co., a corporation of the State of New York. The bill alleged that the defendant claimed authority under the provisions of the Act of August, 1894 (a statute providing for the imposition of a tax on incomes in excess of $4,000 received by individuals, associations, or corporations) to pay to the United States a tax of 2 per cent on the net profits of money in question including income derived from real estate and bonds of municipal corporations owned by it. Moreover, the bill alleged that such a tax was unconstitutional, in that the income from stocks and bonds of the states of the United States, counties, and municipalities therein is not subject to taxation.
Issue: Is this a direct tax? Did any partial unconstitutionality of the 1894 income tax law render it void in its entirety?
Decision: Yes (to both questions) (vote 5-4). Part of the opinion by Mr. Justice Fuller:: "If the revenue derived from municipal bonds cannot be taxed because the source cannot be, the same rule applies to revenue from any other source not subject to the tax; and the lack of power to levy any but an apportioned tax on real estate and personal property equally exists as to the revenue therefrom."

In Search of the Lost Civilisation Nearly all of the ‘lost civilisation’ theories have become associated with the legend of Plato’s ‘Atlantis’, thus the concept and its study have been largely ignored by the serious academic community. Yet ironically it is probably the legend of Atlantis itself, however fanciful, that has provided the foundation for the belief in the existence in a pre-historic civilisation to account for the out-of-place knowledge and artefacts detailed in previous chapters. Atlantis was first mentioned by Plato in his work, the ‘ Timaeus ’, in which he detailed the mighty island of Atlantis and its proud peoples who, is the course of "a single day and night" were swept by earthquake and flood into the depths of the ocean’. Despite his pupil Aristotle’s belief that the story was fantasy, invented to moralise on the nature and consequences of human ambition, Plato was adamant that the former existence of Atlantis was a matter of historical fact. Whatever the truth, the legend certainly was considered factual for many centuries with even mediaeval sea-charts showing unknown ‘Atlantis’ islands. Yet if there was a ‘lost civilisation’ (regardless of its connection with or not to the Atlantis legend) it would have had to have had a home, and any identified location would have to provide supporting evidence that a civilisation actually did live there, for, as Egyptologist Mark Lehner rightly points out, without evidence of remains, it would be safer to conclude that that there was no former civilisation, and the purported clues to its existence would have to be explained in some other way.

Contemporary interest in Atlantis
can be traced back to a self-educated American politician named Ignatius T. T. Donnelly
(1831-1901). After serving as the Lieutenant Governor of Minnesota and later as a congressman, Donnelly
retired from politics in 1870 after a defeat at the polls. He devoted the rest of his life to writing and research. Among his many theories were the argument that the Pleistocene Ice Age was caused by the collision of the earth with a comet, and the suggestion that it was Sir Francis Bacon who really wrote Shakespeare's plays. Both of these ideas have become the subjects of popular cult followings and are alive and well today.
Far more important was Donnelly's interest in Atlantis . More than any other writer

Atlantis
The most popular—and best known—of the lost continents is Atlantis, a land supposed to have lain in the middle of the Atlantic Ocean. First mentioned by Plato in his dialogues Timaeus Critias c 348 BCE, the idea of a lost continent to the west of Europe was introduced as part of a political fable. In this story, the ancient Athenians went to war with the ancient Atlanteans, whom they defeated. Both Athens and Atlantis were destroyed in “ earthquakes and floods of extraordinary violence... in a single dreadful day and night ” nine thousand years ago (i.e. c 9350 BCE). In the ancient world, Plato’s Atlantis was treated as a literary device, not an historical city and was consequently largely forgotten for centuries. It occasionally found its way onto maps, particularly after the discovery of the New World at the end of the fifteenth century led some writers to speculate that these new lands were the remnants of the island. However, it did not enter the popular imagination until the 1880s, when a lawyer from Philadelphia and congressman for Minnesota, Ignatius Donnelly (1831-1901), wrote Atlantis: the Antediluvian World . The book was so popular that it is still in print (in a paperback edition published by Dover Books in 1985). It is a remarkable book, showing a huge breadth of knowledge acquired through years of reading and research in the Library of Congress and it is no exaggeration to say that this book alone was responsible for the late nineteenth-century growth of interest in the lost continent. Donnelly picked up on the work of the Abbé Charles-Étienne Brasseur de Bourbourg (1814-1874), who had worked out a translation of the Troano Codex, half of one of only three Maya manuscripts to survive. His attempt at translation was completely misguided (he believed that Maya hieroglyphs were an alphabetic script), but he read the Codex as describing a volcanic catastrophe in which a land called Mu was destroyed. Donnelly took this translation seriously, identified the supposed Mayan Mu with the Greek Atlantis and began researching possible links between the Maya and the rest of the world.

DONNELLY
Donnelly is O Donnaile in Irish, from Donnail, a personal name made up of donn, meaning ‘brown’ and gal, meaning ‘bravery’. The original ancestor was Donnail O Neill, who died in 876, and was himself a descendant of Eoghan, son of Niall of the Nine Hostages, the fifth-century king who supposedly kidnapped St. Patrick to Ireland. Their territory was first in Co. Donegal, but they later moved eastwards into Co. Tyrone, where the centre of their power was at Ballydonnelly. Many of the family were hereditary bards, but their chief historical fame is as soldiers, especially in the wars of the seventeenth century. One modern bearer of the name who combined both traditional roles was Charles Donnelly (1910-37_, poet and republican, who was killed fighting with the International Brigade in the Spanish Civil War. Donnelly is O'Donnghaile in Irish, from Donnghaile. The prefix "O" denotes one who is the ancestor of Donnghaile. The word Donnghaile translates to "Brown Valor" or "Brown-haired Warrior." This name was given to someone who was dark and brave.
The Donnellys originally were a division of the clan Cineál Eoghain who derive their descent from Donnghal the fourth in descent from Domhnall, King of Aileach brother of Niall Glundubn and ancestor of the O'Neills, the chief family of ancient Ireland.

Au cours de "transes" il aurait eu des visions de l'Atlantide au temps de sa splendeur qui sont consignées dans ce qu'il est convenu d'appeler des "lectures". Selon ces "lectures", l'Atlantide (centrée sur les actuelles Bahamas) a été la civilisation la plus avancée que le monde a connu (et peut-être connaîtra...) . "Enfants de la Loi d'Un" et les "Fils de Bélial" Cette Atlantide "médiumnique" , ultra-moderne et moralisatrice a ses partisans, régulièrement confortés dans leur opinion par les prétendues "découvertes" de "murs de pierre" sous-marins ou de "routes" au large des îles des Bahamas, et en particulier de l'île de Bimini. La localisation exceptée (approximativement...), le reste est à ranger avec tout le fatras ésotérique, théosophique, occulte, paranormal, etc. qui accompagne inévitablement ( et malheureusement!) toute recherche "en marge" des connaissances établies.

Known History
Edward Donnelly was also a teacher; he taught school in Canada for a few years before enlisting in the Union Army in 1861. He was living on the family farm in 1860. I wonder whether he could have been "commuting" to a school on the other side of the river? Perhaps he was spending the summer helping with the farm when the census was taken in late August, and that he lived in Canada during the school year. In the War, he became the company clerk for Company F, 60th regiment of New York Volunteers. He reenlisted in 1864 and fought at Antietam and Gettysburg. He was a Sergeant when he was discharged in 1865, at the end of the war.
Name spellings
The spelling of the family name was different in nearly every census in NY: Donley, Donolly, Donnely, Donoly, Donaly and Donnelly, the current spelling. I have not yet seen any Irish records or spellings. I've adopted the convention of using the name Donley for those born in Ireland prior to the family's emigration to the US, and the name Donnelly for those born in the US. For example, Patrick Donley (born in Ireland) married Nancy Larkin and their son, Edward Donnelly (born in New York), was my great grandfather.

Literature: Apocalypse and Utopia Back to Bibliography Home Abrahams, Edward H. "Ignatius Donnelly and the Apocalyptic Style." Minnesota History Donnelly foresaw disaster for America if it refused to return to its innocent past. Donnelly's view was colored by the pre-1860 concepts of an agrarian rural democracy controlled by farmers and handicraftsmen of his youth. He believed in a classless society without social rank based on wealth. His political disappointments coupled with his writing of such catastrophe-tinged books as Atlantis: The Antediluvian World and its successor Ragnarok: The Age of Fire and Gravel , generated his thinking along apocalyptic lines in which he foresaw mass disaster for America if it refused to return to the innocent past. His Populist speeches and such works as Caesar's Column reflect this attitude. Other writings such as Doctor Huguet The Golden Bottle , and The American People's Money deal with Populist ideas to some extent.
