Supreme Court Justices Benjamin N. Cardozo (1870-1938) From 1891-1914, Benjamin Cardozo practiced law in New York City. He practiced with his brother Albert (Allie) Cardozo, Jr., until Allie's death in 1909. He lived at the family's home with his brother, sisters Nell and Lizzie, and his twin, Emily. In early 1932, Justice Oliver Wendell Holmes resigned from the Supreme Court due to advancing age (Holmes was 90.) Cardozo, then 61 (Holmes's age when appointed to the Supreme Court), was nominated by President Herbert Hoover to the Court. Less than two weeks later, the Senate unanimously approved Cardozo's nomination. In Fall 1932, in the midst of the Great Depression, former New York Governor Franklin Delano Roosevelt was elected President. FDR would, beginning in March 1933, usher in the New Deal. Various aspects of the New Deal were subject to constitutional challenge almost immediately. The Court was deeply divided during the time Cardozo was a member. Cardozo

Justice Benjamin N. Cardozo Justice Benjamin N. Cardozo was a distinguished jurist who had been appointed to the court by President Hoover to fill the seat of the legendary Oliver Wendell Holmes. Modest in demeanor and with a strong philosophical bent, he was the author of four volumes of essays on the philosophy of law prior to being appointed to the court. Cardozo's view of the Constitution was in sympathy with Hamilton's, which he expressed this way: " . . .the great generalities of the Constitution have a content and a significance that vary from age to age. The method of free decision sees thru the transitory particulars and reaches what is permanent behind them. "
One historian would describe his work this way: " Every law school graduate can recognize a Cardozo opinion by a quick perusal. His style is unmistakable: limpid clarity, conciseness suffused with a moral almost spiritual luminosity, and a command of historical material that is unrivaled in the entire common-law tradition. The beauty of his prose must be rated with those of the Greek and Roman classicists whose works he read in the original language for his own pleasure ."

Series Description
The first series contains correspondence and drafts of Cardozo's. The second series consists of two volumes of photocopies of holograph letters addressed to Joseph M. Paley, who was appointed Cardozo's secretary in 1918. The correspondence covers the period of 1918 to 1937, but there are only scattered letters after 1929. The letters are essentially personal-professional. The third series is a photocopy of a notebook entitled: Constitutional History of England. The fourth series contains photocopies of petitions for writs of certiorari U.S. Supreme Court, Oct. Term 1932. Photocopies of manuscripts, addresses and essays are included in the fifth group of papers.

Justice Benjamin Nathan Cardozo May 24 July 9 ) was a distinguished jurist who is remembered not only for his landmark decisions on negligence but also his modesty and philosophy. Cardozo began his career in New York, rising to the post of Associate Judge and later Chief Judge of the New York Court of Appeals, New York's highest court. Then-President Hoover appointed Chief Judge Cardozo to the US Supreme Court to succeed Justice Oliver Wendell Holmes Cardozo's opinion of himself shows somewhat of the same flair as his opinions:

Following are some brief introductions. Benjamin N. Cardozo (1870-1938) was one of the most acclaimed and influential judges of the twentieth century. After practicing law in New York City, he served as judge and then Chief Judge of the Court of Appeals of New York and was appointed an Associate Justice of the Supreme Court of the United States in 1932, where he served until his death. The Nature of the Judicial Process is a compilation of his classic series of lectures on jurisprudence. You may be interested in seeing his picture and comments about the writing style of his opinions and about his place in American jurisprudence , or a biographical sketch Arthur Linton Corbin (1874-1967) taught Contracts and other subjects at Yale Law School for forty years, from 1903-1943. "Corbin on Contracts" is a classic treatise and his writings there and elsewhere are cited frequently by judges and legal scholars. He contributed as Special Advisor and Reporter for the chapter on remedies of the (first) Restatement of Contracts. Learned Hand (1872-1961) was appointed to the District Court for the Southern District of New York in 1909 and to the prestigious United States Court of Appeals for the Second Circuit in 1924 where he served until 1951.
