The court dismissed a class action case filed which contended that Quicken's online banking functions would not operate after 31 December 31 1999 and because of this all Quicken online users were entitled to compensation. In the ruling, the judge said that as noone had experienced any form of damage from Intuit's software products and that as there was no proof that any such damage would take place before Intuit had the opportunity to provide a remedy to software users, the complaint should be dismissed, notes Multimedia News. AVOIDING THE SCOURGE OF Y2K LITIGATION Author: Christopher Hamel-Smith Many countries are bracing themselves for a scourge of Y2K litigation. It is disturbing that many analysts believe that global Y2K litigation costs will actually exceed the total expenditure on efforts to avoid Y2K problems in the first place. In the U.S.A. the perceived threat of Y2K litigation is so significant that American business leaders made the enactment of a new law to limit Y2K law suites one of their top legislative priorities for 1999. After extensive lobbying, they achieved this objective on July 20, 1999 when the President signed the new legislation into law. In doing so, the President described it as "extremely time-limited legislation designed to deal with exceptional and unique circumstances". (Incidentally, instead of using traditional ink signatures on paper, this was the first time that Congressional leaders used digital signature technology and e-mailed the legislation to the President. Since the legal acceptability of digital signatures is critical in electronic commerce this is a topic to which we shall return in this series.) Litigation is always unpleasant and unproductive. Commercial litigation is usually extremely expensive. This is so not only in terms of the direct legal costs incurred but also because it can divert internal resources from your core business, destroy commercial relationships and negatively impact your commercial reputation. Even as we continue to hope for the best, we should therefore plan for the worst. This means using preventative legal techniques before the Year 2000 to help us to avoid the scourge of litigation altogether or, if not, to protect ourselves from the worst effects of any litigation. Despite my fairly optimistic views about the likely levels of Y2K litigation in Trinidad and Tobago, I strongly advocate that companies specifically address the risk of possible Y2K-related disputes and litigation as an integral part of their Y2K contingency planning.

I served as a panelist on two of those occasions, where lively discussion occurred regarding ethics and malpractice issues as a component of the larger Y2K picture. In addition to discussion of some of the office practice management matters, the hot topic emerged as the evolving and amorphous standard of care to which lawyers might be held. Perhaps one of the most fitting (and laugh-provoking) suggestions came from someone in the audience. Other states and territories have no plans to invoke similar legislation, believing existing laws will be sufficient to cover any problems. Only the ACT is adding to existing emergency laws. A general-purpose Emergency Management Bill currently before the ACT Assembly includes provisions for "major and systemic technological failure". The Victorian move comes after the Longford gas explosion last year revealed Victoria's disaster provisions to be outdated. The laws go beyond existing emergency measures by giving the Government extraordinary powers to deal with any computer-related breakdown in vital infrastructure. Fall 1998 The Y2K claims and losses can occur in a wide variety of circumstances, for example: Bodily injury resulting from the failure of electronic safeguards utilizing intelligent chips with the Y2K error; Claims from shareholders based on the failure to disclose that the business would not operate properly or a failure to disclose the costs required to repair the Y2K problem; A claim against hardware/software manufacturer for selling defective hardware or software which, in turn, caused the loss of income to the customer; or A claim against consultant for negligently recommending hardware or software which was not Y2K compliant, resulting in an economic loss to the customer. Just as there are a variety of circumstances under which a claim or loss relating to the Y2K problem can occur, there are also a variety of types of insurance coverages available in the United States. Since the terms and conditions of these coverages vary substantially between insurers, and since the applicable law often varies by jurisdiction, this article must, by its nature, be somewhat generalized. This article will focus on five different types of coverage, at least four of which are currently owned by most businesses. However, before proceeding into a discussion of these types of insurance, a specific exclusion must be mentioned.

According to Webster's Third New International Dictionary, 'martial law' is: "... the law based on necessity or policy that is applied to all persons and property in occupied territory during invasion or occupation and is executed by the military authority of a belligerent acting directly or through civil courts;" or "... military rule exercised by a nation or state over its citizens or subjects in a situation where they are not legal enemies and when an emergency justifies such action." The Duke of Wellington's definition is more concise: "Martial law," he told the English Parliament, "is neither more nor less than the will of the General who commands the army.
