A home inspector is an individual who, for compensation, examines the observable systems and components of improvements to residential real property that are readily accessible. No individual may act as a home inspector, use the title "home inspector", use any title or description that implies that he or she is a home inspector or represent himself or herself to be a home inspector unless the individual is registered under Chapter 440, Subchapter X, Wis. Stats. This registration does not apply to any of the following situations. 1. An individual who conducts a home inspection while lawfully practicing within the scope of a license, permit or certificate granted to that individual by a state governmental agency.

An advanced practice nurse prescriber (APNP) is an advanced practice nurse who has been granted a certificate to independently issue prescription orders under s. 441.16(2), Wis. Stats. An advanced practice nurse means a registered nurse who has a current license to practice professional nursing in this state; is currently certified by a national certifying body approved by the board as a nurse practitioner, certified nurse-midwife, certified registered nurse anesthetist or clinical nurse specialist; and for applicants who receive national certification as a nurse practitioner, certified nurse-midwife, certified registered nurse anesthetist or clinical nurse specialist after July 1, 1998, the registered nurse holds a master's degree in nursing or a related health field granted by a college or university accredited by a regional accrediting agency approved by the board of education in the state in which the college or university is located. An APN may not independently prescribe unless he or she holds a current APNP certificate granted by the Board of Nursing.

The Nuclear Regulatory Commission (NRC) and Governor Doyle have approved an agreement transferring regulatory authority over byproduct, source and special nuclear materials to the State of Wisconsin. Wisconsin became the 33rd agreement state on August 11, 2003. Under the agreement, the Department of Health and Family Services (DHFS) is responsible for licensing and inspecting radioactive materials commonly used in medicine, industry, research and education. The new state licensing requirement also applies to naturally occurring and accelerator produced radioactive material (NARM). See Radioactive Materials Program for addition information.

Madison, Wisconsin 53707 Dear Governor Thompson, This letter is in response to your letter of August 30, 1990, to Secretary Cavazos. You have asked for a Department opinion on the applicability of Part B of the Education of the Handicapped Act, 20 U.S.C. 1401 et seq. (EHA-B), and Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. 794 (Section 504), to the Milwaukee Parental Choice Program (Choice Program). We have reviewed Wisconsin Statute, Section 228. 119.23, “Milwaukee Parental Choice Program,” to determine whether and to what extent the EHA-B and Section 504 apply. In brief, the Choice Program provides that up to 1000 low-income pupils, grades K-12, who reside in Milwaukee may attend, at no charge, participating nonsectarian private schools. The pupils, or their parents, who wish to participate in this program apply directly to the private school of their choice; participating private schools must accept Choice Program students on a random basis. The State Department of Education (SEA) pays to the private school the funds it would have provided to Milwaukee, approximately $2500 per pupil. Our understanding is that all funds paid to the schools are State, rather than Federal, funds. The Department has determined that the EHA-B public placement requirements do not apply to placements in private schools resulting from parents’ decisions to participate in the Choice Program, as long as a free appropriate public education (FAPE) is available to each handicapped child in the public school. Because it is the parent’s decision to participate in the Choice Program, handicapped children in this program are “private school handicapped children” under the EHA-B and as such are not entitled to a FAPE. See 34 C.F.R. 300.450. These children are still eligible for any “equitable services” that may be available to them, in the same manner as other handicapped children enrolled in participating or nonparticipating private schools.

On April 7 2004, National Public Radio's Morning Edition program broadcast a thoughtful commentary on single-sex education by Margaret Erhart, a writer and teacher living in Flagstaff, Arizona. On March 3 2004, the Department of Education proposed new regulations for single-sex education in the United States. You can hear a reasonably fair discussion of the new regulations, with perspectives pro and con, on the NPR program Talk of the Nation . The program (originally broadcast March 8 2004) began with an overview of the new regulations from someone who really knows them: namely, Ken Marcus, the director of the Office of Civil Rights (OCR). The second speaker was Professor David Sadker of American University. Professor Sadker strongly opposes single-sex education in public schools.

Local Efforts Many local districts are working on distance learning technology projects in the state. Approximately 22 groups are planning fiber optics-based systems. An additional 20 Instructional Television Fixed Services (ITFS) sites are in operation, and local districts are planning the expansion and operation of several of these sites. The state has decided not to create a state-level, distance learning system or network, but to allow projects to be created at a local or regional level. Then a backbone infrastructure would be created to link these projects. State Efforts The Wisconsin Educational Communications Board (ECB), the licensee of six of the state's eight public television stations, coordinates telecommunications planning efforts among state education institutions. ECB works with the University of Wisconsin system, the Department of Public Instruction, and the Vocational, Technical, and Adult Education (VTAE) system. In August 1989, the state legislature created a 15-member Information Technology Advisory Board (ITAB) to manage a comprehensive study and make recommendations for improving Wisconsin's data processing and telecommunications systems, including education services. The ITAB published a report in November 1990 entitled Information Technology Management in Wisconsin. One of the report's major recommendations was the formation of a statutory board on information technology under the governance of the Department of Administration. Another priority identified in the ITAB report is the implementation of strategic business and information technology planning throughout all state agencies. A recommendation affecting education was to provide a centralized support for the independent, regional educational telecommunications initiatives that have been established throughout the state.
