    A will is the written, dated and signed and witnessed instructions left by a person for the distribution of his estate after his death. The executors appointed in the will can only carry out its requests once it has been validated and they have been given authority to act. Before 12 January 1858 there were more than 300 church and other courts with jurisdiction to validate (grant probate) of wills. The chief of these was the Prerogative Court of Canterbury. To find out which court served the places where your ancestors lived and died look at the county maps in C Humphery-Smith, The Phillimore Atlas and Index of Parish Registers (Phillimore, 2nd edn 1995). The coloured boundaries indicate which courts might be relevant. Then look at J Gibson, Probate Jurisdictions: Where to Look for Wills (Federation of Family History Societies, 4th edn 1997), to find their whereabouts, those of other courts serving the county as a whole, and any printed indexes. A number of local probate court indexes are available at the Family Records Centre (FRC). Wills after 12 January 1858 have been proved in civil probate registries, copies of which are lodged with the Principal Registry of the Family Division (Probate Registry). There are microfiche copies of the national probate indexes from 1858-1943 at the FRC, but the wills themselves can not be searched there. The Probate Search Room is at First Avenue House, 42-49 High Holborn, London WC1V 6NP (020 7947 6000).

    EDITOR'S NOTE: This article is the thirteenth in our continuing series "Family History Made Easy: Step by Step." Watch for more articles in this series to be posted in coming weeks. As you may have discovered by now, genealogy is not a quick hobby. At this point, every trip to the library is no longer rewarded with three more generations of new material, and letters from distant cousins anxious to exchange information rarely come in the mail. In short, family history research is work. And like any work, it becomes easier if the correct tools to do the job are at hand. In this series, it has been our goal to provide tools that can be of help. In this step, we want to introduce another valuable tool: wills and probate records. Wills also furnish the researcher with relationships between people that were previously a mystery. In many wills, relationships are clearly stated.

    Who can make a will? Generally, anyone 18 or older can make a will. To make a valid will, you must be "of sound mind" which means that you understand such things as the general nature and value of your estate, the people who would be the natural objects of your affection, and to whom you are leaving your estate in your will. Back to Top Who should make a will? Every adult who has or expects to have any accumulation of property or who has a spouse or children should have a properly prepared will. Everyone, whatever his or her circumstances, should seriously consider making a will. Back to Top What is a will? A will is a written legal document. In a will, you can do such things as:
    • Name the people and organizations that you choose to receive your property - both personal property and real estate; Name the person you wish to be guardian for your unmarried children under 18 in the event there is no surviving parent;
