The West Virginia Board of Education is established in the West Virginia Constitution. The Board is vested with general supervision of the state's 834 elementary and secondary schools. Its 11 members include nine citizens appointed by the governor and two non-voting ex-officio members the State Superintendent of Schools and the Chancellor of the West Virginia Higher Education Policy Commission. The State Superintendent is a constitutional officer who serves at the will and pleasure of the board. Board members serve overlapping terms of nine years, and no more than five citizen members may belong to the same political party. The board meets monthly to determine the educational policies of the elementary and secondary schools and to establish the rules that carry into effect state law regarding education. The State Board of Education also has general control, supervision and management of the business and educational affairs of the West Virginia Schools for the Deaf and Blind. Facts of the Case:
As part of instituting a required curriculum teaching American values, the state of West Virginia forced students and teachers to participate in saluting the flag. Failure to comply with this resulted in expulsion and the student was considered illegally absent until readmitted. A group of Jehovah's Witnesses refused to salute the flag because it represented a graven image that was not to be recognized.
Decision:
In an 8-1 decision, the Court ruled that the school district violated the rights of students by forcing them to salute the American flag.
Majority Opinion: (Justice Jackson)
The refusal of the students to say the pledge did not infringe on the rights of other students. The flag salute required students to declare a belief that was contrary to their faiths. The state did not claim that a clear and present danger would be created if the students remained passive during the pledge. Unlike the decision in Gobitis , this Court does not believe that allowing an individual's rights to be supported over government authority is a sign of a weak government. "Conscientious scruples have not, in the course of the long struggle for religious toleration, relieved the individual from obedience to a general law not aimed at the promotion or restriction of religious beliefs. The mere possession of religious convictions which contradict the relevant concerns of a political society does not relieve the citizen from the discharge of political responsibilities." Finally, compulsion is not a legitimate means for creating national unity.

The West Virginia Legislature was established by the West Virginia Constitution as the lawmaking branch of state government.
Our Legislature is comprised of 100 delegates and 34 senators, each elected to represent the voice of their constituents. These legislators meet in formal session for 60 days each year. During session, the city of Charleston becomes a mecca for people and groups promoting ideas they believe should become law. Bills which affect you, and affect every citizen of the state, are researched, drafted, discussed, changed, debated and voted upon during these 60 days. In essence, the future of the state of West Virginia is charted by these 134 individuals.

Praxis I and Praxis II tests are administered on approved test dates expressly for examinees who are seeking completion of board-approved programs leading to West Virginia certification. Native American Communities in West Virginia
(as originally published in 1999) In West Virginia, the contemporary Native American population can best be described as a statewide community, consisting of a far-reaching network of individuals with Native American ancestry. There are approximately 3000 Native Americans in West Virginia. The community includes individuals from at least 43 different bloodlines and tribal associations. These are descendants from the regional Native Americans, including Cherokee and Shawnee, and individuals who more recently relocated to West Virginia from throughout North America. Many people in West Virginia have Native American blood, but do not have a historical tribal association, and many individuals have mixed blood, that is, ancestry of different tribes as well as different races in addition to Native American. The contemporary community reflects those who are finding new pride in their native heritage, and Native Americans who are newcomers to this area and who represent the pan-Indian community. The Native American community has struggled with oppression, imposed disruption, and insecurity since the arrival of European settlers in West Virginia. Individuals were being shipped away to Oklahoma reservations as late as the 1950s. As recently as 1964, it was illegal for a Native American to own property in West Virginia. In spite of these hardships, vestiges of communities survived and their heritage is re-emerging with renewed pride.

Jewish Communities in West Virginia
(as originally published in 1999) Events in Russia in the 1880s began the second major wave of Jewish immigrants to America, and had a profound effect on the size of the Jewish population in West Virginia. Jewish settlers from Eastern Europe came from countries such as Russia, Poland, Hungary, Latvia, and Lithuania. During the period from approximately 1888 to 1930, almost three million Jews immigrated to America. The period also coincided with the coal boom, and many Jewish immigrant families moved into these new rural Appalachian communities in the vicinity of such towns as Beckley and Welch. Today there are numerous activities which promote heritage and strengthen bonds within the Jewish community. Religious life plays a primary role in preserving Jewish traditions and culture. A wealth of heritage is to be found in traditional Jewish services, and in community and family celebrations honoring religious holidays. These activities serve the dual role of maintaining tradition and bringing the local community together. The schedule of religious services varies from community to community, depending mostly on the size of the congregation. Larger communities hold a weekly cycle of religious services, while smaller communities might meet bi-weekly or monthly. Many of the smaller communities have services with visiting rabbis. In addition to religious services, the celebration of Passover, Rosh Hashanah, Yom Kippur, Purim, and other holidays and festivals are important aspects of Jewish traditional life which bring family and community together. Judaism is a family-oriented religion, and many of the traditional activities involve home-based celebrations. Significant life events, such as passage of youth into adulthood (bar mitzvah and bat mitzvah) are also opportunities for the community to come together.
