The West Virginia Board of Education is established in the West Virginia Constitution. The Board is vested with general supervision of the state's 834 elementary and secondary schools. Its 11 members include nine citizens appointed by the governor and two non-voting ex-officio members the State Superintendent of Schools and the Chancellor of the West Virginia Higher Education Policy Commission. The State Superintendent is a constitutional officer who serves at the will and pleasure of the board. Board members serve overlapping terms of nine years, and no more than five citizen members may belong to the same political party. The board meets monthly to determine the educational policies of the elementary and secondary schools and to establish the rules that carry into effect state law regarding education. The State Board of Education also has general control, supervision and management of the business and educational affairs of the West Virginia Schools for the Deaf and Blind.     There are two clauses regarding religion in the First Amendment. One is the Establishment Clause, which prohibits the government from establishing any sort of official religion (see next document); the other is the Free Exercise Clause, which forbids the government from restricting an individual's religious practices. Free exercise claims often overlap claims to freedom of expression, and several of the most important religion cases mixed issues of free speech and free exercise together. A key element in religion clause jurisprudence is the dichotomy between belief and action originally enunciated by Chief Justice Morrison Waite in 1879. While the First Amendment absolutely prohibits government efforts to restrict beliefs, it does not prevent the state from forbidding practices that threaten public order or safety. In the example Waite used, if a sect believed in human sacrifice, the government could do nothing to restrict that belief; but it could, without violating the Free Exercise Clause, bar the actual sacrifice. While this belief/action analysis remains useful even today, the Court came to recognize that in some areas belief and action overlapped. The Jehovah's Witnesses are a relatively small sect in the United States, but they are responsible for some of the most important cases establishing religious freedom. The Witnesses claimed a right to proselytize, an action, without state regulation, as essential to the free exercise of their creed, a belief. In several cases the Court upheld these claims, but primarily on speech rather than religion clause grounds, yet these decisions are in fact the basis for modern jurisprudence on the Free Exercise Clause.

    Facts of the Case:
    As part of instituting a required curriculum teaching American values, the state of West Virginia forced students and teachers to participate in saluting the flag. Failure to comply with this resulted in expulsion and the student was considered illegally absent until readmitted. A group of Jehovah's Witnesses refused to salute the flag because it represented a graven image that was not to be recognized.
    Decision:
    In an 8-1 decision, the Court ruled that the school district violated the rights of students by forcing them to salute the American flag.
    Majority Opinion: (Justice Jackson)
    The refusal of the students to say the pledge did not infringe on the rights of other students. The flag salute required students to declare a belief that was contrary to their faiths. The state did not claim that a clear and present danger would be created if the students remained passive during the pledge. Unlike the decision in Gobitis , this Court does not believe that allowing an individual's rights to be supported over government authority is a sign of a weak government. "Conscientious scruples have not, in the course of the long struggle for religious toleration, relieved the individual from obedience to a general law not aimed at the promotion or restriction of religious beliefs. The mere possession of religious convictions which contradict the relevant concerns of a political society does not relieve the citizen from the discharge of political responsibilities." Finally, compulsion is not a legitimate means for creating national unity.

    The West Virginia Higher Education Policy Commission is responsible for developing, establishing, and overseeing the implementation of a public policy agenda for higher education. It is charged with oversight of higher education institutions to ensure they are accomplishing their missions and implementing the provisions set by state statute.
    The Commission consists of nine members; seven of whom are appointed by the governor, and two ex-officio members; the secretary of education and the arts, and the state superintendent of schools.

    Article 2A. §18-2A-4. Execution of contracts; bond.

    When the selection and approval of the multiple list have been properly made, it shall be the duty of the state board to furnish contracts for the selected items with the vendors within thirty days of the approval and adoption of the multiple list, prepare a list of the adopted items on the multiple list and publish same, and send a copy to each county superintendent and vendors who submitted bids for the particular adoption group not later than January fifteenth of the year of the county adoption. Such contracts for adoption shall run for a period of time as designated by the state board of education.
    Each vendor awarded a contract by the state shall enter into a bond payable to the state of West Virginia in the penal sum of not less than two thousand dollars and not more than ten thousand dollars to be approved by the state board of public works, such bond to be executed as surety by some responsible surety company authorized to carry on its business in West Virginia. Such contract shall be prepared by the attorney general in accordance with the terms and provisions of this article. Such contract shall be executed in triplicate, one copy to be held by the vendor, one by the state board of education and one attached to the bond filed with the board of public works.

    West Virginia State Board of Education vs. Barnette in the news The most important U.S. Supreme Court legal victory won by the Jehovah's Witnesses was in the case West Virginia State Board of Education vs. Barnette , in which the court ruled that school children could not be forced to pledge allegiance or salute the U.S. flag . This decision, issued on Flag Day June 14 made an important contribution to later decisions concerning burning the flag. In the majority decision, Associate Justice Robert Jackson wrote: :"If there is any fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion." The Barnette decision overturned an earlier case, Minersville School District vs. Gobitis (1940), in which the court had held that Witnesses could be forced against their will to pay homage to the flag.

In 1881, they founded Zion's Watch Tower Bible and Tract Society, it was registered in 1884 with Russell as president. The name is today Watch Tower Bible and Tract Society of Pennsylvania. Later, in 1914 they founded International Bible Students Association in the UK, and in 1931, when Joseph Franklin Rutherford was president of the society, they adopted the name Jehovah's Witnesses.

    Reporting of Scores
    Praxis I and Praxis II tests are administered on approved test dates expressly for examinees who are seeking completion of board-approved programs leading to West Virginia certification. Therefore, if you test at a center in West Virginia, scores are automatically sent to the West Virginia Department of Education.     Hazo William Carter, Jr., president of West Virginia State College, became its ninth president on September 1, 1987. He is an educator who is beginning his 25th year as a college administrator, and 18th year as a chief executive officer of an institution of higher education. Mr. Carter began his career at Norfolk State University where he served as executive assistant to the president, assistant vice president for student affairs, and a tenured associate professor of journalism. Prior to coming to West Virginia State College, Mr. Carter was president and professor of education at Philander Smith College in Little Rock, Ark.
