Compulsory School Attendance 18-8-1 Commencement and termination of compulsory school attendance; exemptions. Compulsory school attendance shall begin with the school year in which the sixth birthday reached prior to the first day of September of such year or upon enrolling in a publicly supported kindergarten program and continue to the sixteenth birthday.
Exemption from the foregoing requirements of compulsory school attendance shall be made on behalf of any child for the following causes or conditions, each such cause or condition being subject to confirmation by the attendance authority of the county.

Covington, of Brooklyn, N.Y., for appellees. Mr. Justice JACKSON delivered the opinion of the Court. Following the decision by this Court on June 3, 1940, in Minersville School District v. Gobitis, 310 U.S. 586 , 60 S.Ct. 1010, 127 A.L.R. 1493, the West Virginia legislature amended its statutes to require all schools therein to conduct courses of instruction in history, civics, and in the Constitutions of the United States and of the State 'for the purpose of teaching, fostering and perpetuating the ideals, principles and spirit of Americanism, and increasing the knowledge of the organization and machinery of the government.' This site is intended to be viewed at a screen resolution of 600 X 800 West Virginia, Land of Diversity West Virginia is a land of wide diversity. Mountains and valleys, deep forests, coal mines and expansive orchards all describe parts of the state. We were originally part of Virginia but in 1861 the people voted for succession and the state was split in 1863 to become the 35th state to enter the Union. Charleston is the state capitol. West Virginia is found entirely within the Appalachian Mountain chain. It is bordered by Pennsylvania, Maryland, Virginia, Kentucky and Ohio and has a land area of 62,761 square kilometers or 24,232 square miles. The highest point, Spruce Knob, is 1482 meters high (4861 feet) and the lowest point, Harper's Ferry, is only 75 meters (247 feet). With an average altitude of 457 meters (1,500 feet), West Virginia has the highest average elevation of any state east of the Mississippi River. The beauty of the state lies in the tall mountains, deep valleys and expansive forests. That beauty has also caused the state to be isolated due to the difficulty of building roads and transportation of materials. Trees cover three-quarters of the state. The steep inclines of the rivers prevent navigation of many of the waterways due to rapids and rocks. However, those mountains and forests provide a wealth of raw materials for the industry of the state.

General 1.1. Scope. This rule sets the requirements for schools in West Virginia to be harassment and violence free. 1.2. Authority. W.Va. Constitution, Article XII, §2, and W.Va. Code §§18-2-5, 18-2-5a, and 18-2-7b. 1.3. Filing Date. December 16, 1996 1.4. Effective Date. January 16, 1997 1.5. Repeal of former rule. None §126-18-2. Purpose. 2.1. The purpose of these regulations is to prevent racial, sexual or religious/ethnic harassment or violence, toward students and staff, to protect the academic environment, and to assure that our educational institutions respond to harassment and/or violence incidents when they occur in a manner that effectively deters future incidents and affirms respect for individuals. These regulations require county boards to design and implement prevention and response programs, to outline investigatory and reporting procedures and to delineate penalties for violations of this policy. To the extent possible, county boards will collaborate with other state and local agencies in carrying out the purpose of this rule. Registration/Licensing/Accreditation: Curriculum Recordkeeping/Reports: Length of School Year/Day: Instruction in English: Curriculum Special Education: Health: Safety: Transportation: Home Schooling: The person or persons providing the instruction shall annually obtain an academic assessment of the child for the previous school year. This can be satisfied by an approved standardized test; a written narrative indicating that a portfolio of samples of the child's work has been reviewed by a certified teacher or other person mutually agreed upon by the parent and the superintendent, and that the child's academic progress is in accordance with the child's abilities; or evidence of an alternative assessment of the child's proficiency mutually agreed upon by the parent and the superintendent. Equal Pay The Wage Payment and Collection Act requires the payment of wages and fringe benefits within 72 hours to employees who are discharged and payment by the next regular payday for employees who have resigned or are laid off. Although the Act does not require employers to provide fringe benefits to their employees, it does assure that employers follow through by providing the benefits they have included in their own company policy. Other provisions include requiring employers to meet their payroll at least once in every two weeks unless provided a special agreement; prohibiting unauthorized payroll deductions unless the employee has agreed to the deduction through a legal wage assignment and other issues regarding employer-employee responsibilities. Wage Bonds The Act also requires that, with the exception of those who have been doing business in this state for over five consecutive years, and are engaged in construction work or the severance, production or transportation of minerals must furnish a bond to protect the wages and benefits of their employees.

Following the [ Gobitis ] decision, the West Virginia legislature amended its statutes to require all schools therein to conduct courses of instruction in history, civics, and in the Constitution of the United States and of the State "for the purpose of teaching, fostering and perpetuating the ideals, principles and spirit of Amercanism, and increasing the knowledge of the organization and machinery of the government." The Board of Education on January 9, 1942, adopted a resolution containing recitals taken largely from the Court’s Gobitis opinion and ordering that the salute of the Flag become "a regular part of the program of activities in the public schools," that all teachers and pupils "shall be required to participate in the salute honoring the Nation represented by the Flag; provided, however, that refusal to salute the Flag be regarded as an Act of insubordination, and shall be dealt with accordingly." The resolution originally required the "commonly accepted salute to the Flag" which it defined. Objections to the salute as "being too much like Hitler’s" were raised by the Parent and Teacher’s Association, the Boy and Girl Scouts, the Red Cross, and the federation of Women’s Clubs. Some modification appears to have been made in deference to these objections, but no concession was made to Jehovah’s Witnesses. What is now required is the "stiff-arm" salute, the saluter to keep the right hand raised with palm turned up while the following is repeated: "I pledge allegiance to the Flag of the United States of America and to the Republic for which it stands; one Nation, indivisible, with liberty and justice for all."
