The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

Thursday, March 4, 2004; Page A01 The Bush administration announced plans yesterday to relax restrictions on single-sex public schools and classrooms, effectively ending three decades of federal attempts to enforce a nationwide policy of coeducation. New regulations drafted by the Department of Education will make it much easier to establish single-sex schools at taxpayer expense, and sweep away many of the legal obstacles to separate classes for girls and boys. At present, only a few dozen of the 93,000 public schools in the country offer same-sex classes in mainstream academic subjects. The move could lead to "an explosion in the number of single-sex schools," predicted Tom Carroll, who founded separate federally funded charter schools for boys and girls in Albany, N.Y., in 2002. "It eliminates many of the legal clouds hanging over us." The new regulations, which are open to public comment for 45 days, change the way the Education Department enforces Title IX of a 1972 education act, which prohibits sex discrimination in federally funded programs. Until now, successive administrations have interpreted this provision to mean that virtually identical opportunities must be provided to students of both sexes.

Friday, February 20, 2004; Page A01 The Bush administration moved yesterday to defuse mounting criticism of its landmark No Child Left Behind law by announcing a significant relaxation of testing requirements for students with limited knowledge of English. The new regulations will make it easier for schools to meet the annual targets set by the Department of Education and aimed at bringing the performance of all U.S. students up to grade level in math and reading by 2014. According to an independent study, about 28 percent of schools nationwide failed to meet the targets last year, triggering a mandatory set of costly remedial measures, such as supplemental tuition services and offers to move children to different schools if space is available. At a news conference, Education Secretary Roderick R. Paige said he is planning more changes over the coming weeks, including a new, more flexible interpretation of the requirement that all students be assigned a "fully qualified teacher." He previously agreed to changes in the way students with disabilities are treated under the law, allowing the most seriously disabled to be tested separately from other students.

    What Is the Review of Title IV Regulations?
    Title IV of the Higher Education Act (HEA) governs the federal student financial aid programs. Under Section 498(B) of the HEA , the U.S. Department of Education reviewed the Title IV regulations that are currently in effect and that apply to the operations or activities of any Title IV participant. We collected the views of our customers and partners, including students, schools, and financial institutions. We also conducted our own analysis of our regulations. We then synthesized the information we collected and presented it in a report to Congress. This review builds upon the information we have already collected through the negotiated rulemaking process and the Department's Customer Service Task Force, which conducted over 200 listening sessions and received over 8,000 comments.
