    Member, House of Delegates You inquire as to the legality of the circumstances surrounding the appointment of a new member to the School Board of Rappahanock County. You ask several questions, and I will answer them in order: 1. May the members of the School Trustee Electoral Board eliminate an "at large" position on the school board? Section 22-61 of the Code of Virginia (1950), as amended, provides in pertinent part as follows: "Except as otherwise provided by law, the county school board shall consist of tIle same number of members from each district in the county as there are members of the board of Supervisors from each district in the county, each school board member to be appointed by the school trustee electoral board.     Fuqua School, Virginia
    Fuqua School of Farmville, Virginia, seventy miles west of Richmond, has a population of nearly 700 students from pre-kindergarten to grade 12. In 1994, a general purpose building was added to the lower school campus. True to Fuqua Schools dedication to science and technology, alternatives were explored to determine the most efficient system for heating and cooling the new building. While projected cost savings were a major reason for choosing geothermal, Fuqua School realized many other benefits as well. Fuqua's 18,000 square foot lower school's general purpose building is designed to fit diverse needs. It consists of classrooms, a computer center with 20 computers, a music and art center, a media center with 14 additional computers, administrative offices, a library, a science lab, and a 7,000 square foot auditorium/gymnasium which is also used as a lunchroom for children pre-kindergarten through grade five. The installation at Fuqua has a closed-loop, 52 ton, water source system. There are 36 wells, 6 inches in diameter and 285 feet deep. There are 1,625 gallons of water with no antifreeze solution added. Two-thirds to three quarters of the energy needed to run the heat pumps comes naturally from the ground. The temperature is 57 degrees Fahrenheit below 32 feet. There are more than 4.7 miles of 1and 2 inch piping installed below the surface.

    First Amendment Court Allows Minute of Silence to Continue in Virginia Schools A federal appeals court ruled that a Virginia law implementing a mandatory minute of silence in public schools is constitutional. A panel from the 4 th Circuit U.S. Court of Appeals issued a 2-1 opinion in the case Brown v. Gilmore , rejecting a constitutional challenge to the Commonwealth’s "minute of silence" law. The Virginia law was passed in the General Assembly last year and was in place for the 2000-2001 school year. The legislation mandated that public schools must begin the school day with a minute that allowed students to meditate, pray or engage in any other silent activity. The ACLU challenged the law by filing a lawsuit on behalf of a handful of students. The lawsuit argued that the minute of silence was an attempt to encourage students to pray and therefore violated the First Amendment. The appeals panel disagreed. "By providing this moment of silence, the state makes no endorsement of religion," Judge Paul V. Niemeyer ruled in the majority opinion. "Recognizing that the Religion Clauses of the Constitution are intended to protect religious liberty, Virginia’s minute of silence is no more than a modest step in that direction."

    Regulation 5-10.1 STUDENTS Admission Requirements: General
    A. Age/Residence
    A person of school age who resides in Virginia Beach is eligible for admission on a nontuition basis. A person of school age will be deemed to reside in the school division:
    1. When the person is living with a natural parent, or a parent by legal adoption;
    2. When the parents of such person are dead and the person is living with a person in loco parentis who actually resides within the school division;
    3. When the parents of such person are unable to care for the person and the person is living, not solely for school purposes, with another person who resides in the school division and is either (i) the court-appointed guardian or legal custodian of the person; or (ii) acting in loco parentis pursuant to placement of the person for adoption by a person authorized to do so under § 63.1-220.1;
    4. When the person is living with a parent, guardian, or person in loco parentis in a temporary shelter in the school division, not solely for school purposes. Where a "temporary shelter" is (i) any home, single or multi-unit dwelling or housing unit in which persons who are without housing or a fixed address receive temporary housing or shelter or (ii) any facility specifically designed or approved for the purpose of providing temporary housing or shelter to persons who are without permanent housing or a fixed address; or

    Attorney General Jerry Kilgore and 7 th "These are two common sense pieces of legislation," Kilgore said. "The General Assembly has spoken overwhelmingly. Governor Warner should sign these bills into law." "It makes no sense to validate illegal behavior by providing this essential form of identification without restriction. A driver’s license is a passport to all sorts of places and behaviors – including, of course, boarding an airplane," Kilgore said, noting that seven of the nineteen September 11 th hijackers held fraudulently-obtained Virginia driver’s licenses. "While the General Assembly has already closed a loophole in the law that allowed these men to receive this identification, there is still more work to be done." The other legislation makes it clear in the Code of Virginia that illegal immigrants are ineligible for in-state tuition rates at public colleges and universities. The average in-state student at a Virginia school is subsidized by the taxpayers an average of over $6,000 per year. While recognizing that immigration is a federal issue, the Attorney General has advised school administrators that they should not, as a matter of policy, admit illegal aliens in the first place. If schools choose to admit illegal immigrants, however, the Attorney General has advised them that the students are ineligible for in-state tuition. While Virginia law states that illegal aliens are unable to establish legal residency, Kilgore felt a clarification was necessary. Del. Thelma Drake (Norfolk) sponsored HB 2339, which passed the House 88-to-10 and the Senate 27-to-13.

This Office administers FERPA and is responsible for providing technical assistance under the law.     The purpose of general education requirements is to provide a fund of common knowledge and essential skills for the educated citizen. All students, regardless of their majors, should be required to study such basic subjects as English, a foreign language, history, philosophy, mathematics, and science. These subjects form a basis for what educated Americans should know. They are the essential ingredients for an informed and thoughtful life. Studies, however, point to a staggering deficit in what undergraduates really know, and what colleges expect them to know. In 1989, the National Endowment for the Humanities and the Gallup Organization conducted a survey on what college seniors knew. One-fourth of undergraduates surveyed could not locate Columbus' discovery in the correct half-century, and more than 44 percent did not know when the Civil War took place. Roughly 25 percent thought that Karl Marx's statement"from each according to his ability, to each according to his need . . . "was from the U.S. Constitution. The majority could not identify the major works of Plato, Dante, Milton, Jane Austen, and Dostoevsky. This paucity of undergraduate knowledge led to the 1989 report, 50 Hours: A Core Curriculum for College Students, wherein the NEH makes recommendations for a model general education program. The report noted that college educators throughout the 1980s spoke of increasing fragmentation of undergraduate curricula, and a need for more structure and coherence.

    The West Virginia Board of Education is established in the West Virginia Constitution. The Board is vested with general supervision of the state's 834 elementary and secondary schools. Its 11 members include nine citizens appointed by the governor and two non-voting ex-officio members the State Superintendent of Schools and the Chancellor of the West Virginia Higher Education Policy Commission. The State Superintendent is a constitutional officer who serves at the will and pleasure of the board. Board members serve overlapping terms of nine years, and no more than five citizen members may belong to the same political party. The board meets monthly to determine the educational policies of the elementary and secondary schools and to establish the rules that carry into effect state law regarding education.
