HERALD Staff Writer
Virginia Delegate Richard H. Black, a parishioner of St. Catherine of Siena Church in Great Falls, announced recently that he "wholeheartedly supports the initiative launched by the Virginia Catholic Education Association to strengthen Catholic schools in the Arlington and Richmond dioceses." The announcement coincided with the one year anniversary of the Supreme Court Case, "Agostini v. Felton," that upheld the right of religious schools to receive state funds on an equal basis with public schools, providing the funds are not used for religious education. "The ‘Agostini v. Felton’ decision has created a favorable climate for the initiatives of the Virginia Catholic Education Association to bear fruit in Virginia," said Black. "I believe that the timing of the initiative is providential." Black would like to pursue legislation on a dual lobby track consisting of the Catholic and Protestant school lobby. He said that if both school systems are covered, much of the voting population will be involved and thus will emerge the necessary support for the legislation.

Registration/Licensing/Accreditation: Curriculum Recordkeeping/Reports: Length of School Year/Day: Instruction in English: Curriculum Special Education: Health: Safety: Transportation: Home Schooling: The person or persons providing the instruction shall annually obtain an academic assessment of the child for the previous school year. This can be satisfied by an approved standardized test; a written narrative indicating that a portfolio of samples of the child's work has been reviewed by a certified teacher or other person mutually agreed upon by the parent and the superintendent, and that the child's academic progress is in accordance with the child's abilities; or evidence of an alternative assessment of the child's proficiency mutually agreed upon by the parent and the superintendent. The Virginia Council for Private Education (VCPE), a private umbrella organization of associations whose membership is comprised of private schools, accredits private schools. The Board recognizes accreditation by VCPE member organizations. et seq Recordkeeping/Reports: Length of School Year/Day: Discrimination: Special Education: et seq Schimmel ex rel. Schimmel v. Spillane , 819 F.2d 477 (4th Cir. 1987). Health: Safety: Transportation: Home Schooling: Local school boards may permit part-time attendance of home schooled and private school students. Students may be allowed to enroll in classes in English, mathematics, science, history/social science, foreign language, vocational education, and fine arts. Participation in certain interscholastic activities such as varsity sports is governed by policies of the Virginia High School League. Other extracurricular activities are governed by policies of the local school board. It is not required that children being taught at home be allowed to participate in extra-curricular or special programs offered by the school division. In the absence of program guidelines for the specific request, local school board policy prevails.

Parochial Schools: Out of Cities, Into the Suburbs Tim Cornell, Special to The Christian Science Monitor PHILADELPHIA Suburban waiting lists In Arlington, Va., the waiting list for the elementary schools runs into the thousands. In the Minneapolis suburbs, the archdiocese is building a major building every year, and still can't keep up with the demand. The growing enrollment may seem good, but the flood of students presents many problems. At Our Lady of Mercy, the parish set up trailers to house the extra students until it built a $4 million addition this year. But the school is still overfilled. "Parents complain about the class size, which is about 34," says Sister Virginia Pfan, the school principal. "We just don't have room for anyone else." The schools' popularity doesn't always stem from good facilities. Few schools offer computers in the classroom and many work with vintage science equipment. Students still sit in silent rows, and the schools stress that education is a result of individual effort.

Eligibility for kindergarten is based upon the following state law:
As prescribed in the regulations of the Board of Education, the requirements of this section may also be satisfied by sending a child to an alternative program of study or work/study offered by a public, private, denominational or parochial school or by a public or private degree - granting institution of higher education. Further, in the case of any five-year-old child who is subject to the provisions of this subsection, the requirements of this section may be alternatively satisfied by sending the child to any public educational pre-kindergarten program, including a Head Start program, or in a private, denominational or parochial educational pre-kindergarten program.

Every prospective homeschooler approaches Virginia homeschooling law with questions, concerns, and a little apprehension. Yet no part of our state's homeschooling law seems to provoke more confusion or strong emotional feelings as the sections about kindergarten-aged children.
Following are some frequently asked questions about homeschooling kindergarten-aged children in Virginia:
Q: How old does my child have to be before I have to officially register him as a homeschooler in Virginia?
A: Virginia's compulsory attendance law (22.1-254, subsection A) states that all children who are five years old on or before September 30 of the school year must attend school. This could include public school, private school, a public or private preschool program, a private tutor, or home instruction.
Q: What if I don't think my five-year-old is ready for school yet?
