I. Statement of the Case
The Arbitrator found that the Agency committed an unjustified or unwarranted personnel action in failing to timely pay two grievants certain wages and benefits.
II. Background and Arbitrator's Award
It is undisputed that the grievants were owed backpay. While the facts are sparse, the Agency notes in its exceptions that it "did not challenge the grievants' right to collect the backpay in issue," and that each of the grievants has experienced "administrative delay in receiving a payment." Exceptions at 4, 7. The parties stipulated that the Arbitrator was to consider the following: 1. Did the agency violate laws, rules, regulations, past practice, the negotiated agreement, Agency decisions and/or earlier FLRA/Arbitration decisions by failing to pay the grievants in a timely manner and by failing to pay interest on backpay? If so, what should the remedy be? 2. In regard to each grievant:

I. Statement of the Case
This matter is before the Authority on exceptions to an award of Arbitrator Mary Bass filed by the Agency under section 7122(a) of the Federal Service Labor-Management Relations Statute (the Statute) and part 2425 of the Authority's Regulations. The Union filed an opposition to the Agency's exceptions. The Arbitrator determined that the Agency had committed an unjustified or unwarranted personnel action in this matter when it failed to pay the grievant her living quarters allowance (LQA) in a timely manner. As such, the Arbitrator awarded the grievant interest pursuant to the Back Pay Act on this unpaid amount. For the reasons that follow, we find that the Agency has failed to show that the Award is deficient under section 7122(a) of the Statute. Therefore, we deny the exceptions.

Background This is a proceeding initiated by the United States Department of Education ("ED"), through the Assistant Secretary for Special Education and Rehabilitative Services ("Assistant Secretary") to withhold, pursuant to 20 U.S.C. § 1416, Fiscal Year 1995 ("FY 1995") funds made available to the Virginia Department of Education ("VaDOE" or "Applicant") under Part B of the Individuals with Disabilities Education Act, 20 U.S.C. § 1400 et seq. ("IDEA" or "IDEA-B"). ED has proposed to withhold such funds because of the Applicant's failure or refusal to mandate local educational agencies' provision of special education services to students with disabilities suspended long-term or expelled for conduct unrelated to their disabilities. VaDOE has challenged the proposed withholding on several grounds. It argues that ED may not withhold FY 1995 IDEA-B funds for Virginia's conceded refusal to mandate special education services to the above students because to do so amounts to ED's imposition of a new grant condition subsequent to its conditional approval on October 29, 1992, (with conditions not herein relevant) of Virginia's 1993-1995 IDEA-B plan. The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.

An Interview with Lem Marshall (1) Describe some of the major changes that are in the new regulations. How has the VREB made the new regulations more user-friendly? The Board established three overriding goals when it began the recently completed regulatory review. First and most important, the new regulations must enhance the competence of Virginia's licensees. Second, the regulations must be reorganized to deal coherently with the major points of regulation. For that reason we now have advertising, escrow management and oversight, and standards of conduct and practice each dealt with in a single place, rather than with bits and pieces of each scattered about the regulations. Third, we wanted to shorten the regulations by removing unnecessary provisions and being more concise throughout. (2) What new responsibilities do brokers need to be made aware of?

VIRGINIA OPOSSUM T he opossum probably is a newcomer to Colorado. Settlers on the Great Plains planted trees to shelter their farms from wind and to beautify their towns. Control of floods and prairie fires allowed woodlands to grow along major rivers. These changes extended habitat for opossums westward from their range to the east and southeast parts of Colorado. The species first appeared in the southeastern corner of the state in 1903; its present range is in the eastern two-fifths of the state. T he opossum is about the size of a house cat, with a total length up to 2 feet and weighing as much as 7 ½ pounds. Its long, coarse fur is gray. Its ears are naked, and the tail is nearly so. The nose pad is pink; the big toe is clawless and works like a thumb. Opossums den in burrows made by other animals, or under rocks, brush, buildings or in hollow trees. They are active at night and do not hibernate. A opossum will bite if annoyed, but most often will "play possum" if frightened, sprawled out with eyes closed, tongue out and heart rate reduced to almost nothing – a most convincing performance. O O possums are marsupials, like kangaroos and koalas, so the female has a pouch in which the young are carried. Breeding begins in January. Females have two litters of five to 15 honeybee-sized young each year, but there are only 13 nipples in the pouch, so the excess young die. The young remain in the pouch for 90 to 100 days and mature at eight months. Average life span for opossums is about 16 months and rarely exceeds two years. Many are killed on highways.
