SERIES 16 REGULATIONS FOR THE EDUCATION OF EXCEPTIONAL STUDENTS (2419)
§126-16-1. General.
1.1. Purpose: The Individuals with Disabilities Education Act Amendments of 1997 requires that the State set forth policies and procedures to assure that there is a goal of providing full educational opportunity to all students with disabilities birth through 21 years of age. The State of West Virginia reaffirms the goal to provide full educational opportunities for all students with disabilities, aged birth through 21. The State works toward the realization of this goal through the implementation of, and compliance with, the Individuals with Disabilities Education Act Amendments of 1997 (P.L. 105-17). 1.2. Scope: These regulations apply to preschool, early childhood, middle childhood, adolescent and adult students whose educational programs require special education and related services. These apply to three year olds, as of their third birth date, through five year olds with disabilities and those who are between five and 21 years of age prior to September 1 of such school year, unless the student has met graduation requirements as specified by the Individualized Education Program and within the state/local policy pertaining to graduation requirements.
1.2.1. West Virginia's mandatory special education statute legislates a child identification effort by county boards of education. Chapter 18, Article 20, Section 2, of the West Virginia Code states, "The board of education of each county is empowered and is responsible for providing suitable educational facilities, special equipment and such special services as may be necessary. Special services include provisions and procedures for finding and enumerating exceptional children of each type..." The mandated target group for the state child find requirements includes individuals with disabilities between birth and 21 years of age, gifted students from first through eighth grades, and exceptional gifted in grades nine through 12. Part C of the Individuals with Disabilities Education Act (IDEA) requires interagency collaboration in child find activities targeting children from birth through 5 years of age.

Boating Safety Course The Nautical Know How Basic Boating Course is a NASBLA approved course. Successful completion of this course meets Virginia's requirement for boating safety education. This section contains information on Virginia Boating Regulations that are in addition to the Federal Requirements covered in the Basic Boating Course . If you have not reviewed the course material, please do so now. All Federal Requirements in the basic boating course apply to Virginia; this section lists Virginia Boating Requirements that are above and beyond Federal Requirements. Age Restrictions: PWC operators must be at least fourteen years old. Effective 01/01/99, PWC operators between the age of 14 and 16 must have proof of successful completion of an approved Boating Safety Course in order to operate a PWC. Successful completion of this Basic Boating Course meets Virginia's boater education requirements.
Personal Flotation Devices: There must be at least one wearable life jacket (PFD) for each person onboard. The PFD must be Coast Guard approved, in good and serviceable condition and of the proper size for the person. In addition, boats 16 feet and greater must also carry a throwable flotation device (ring buoy or seat cushion) Coast Guard approved and in good and serviceable condition. All personal watercraft (PWC) operators and passengers must wear an approved Type I, II, III or V PFD.

INTRODUCTION TO THE COURT OPINION ON THE WEST VIRGINIA BOARD OF EDUCATION V. BARNETTE CASE
There are two clauses regarding religion in the First Amendment. One is the Establishment Clause, which prohibits the government from establishing any sort of official religion (see next document); the other is the Free Exercise Clause, which forbids the government from restricting an individual's religious practices. Free exercise claims often overlap claims to freedom of expression, and several of the most important religion cases mixed issues of free speech and free exercise together. A key element in religion clause jurisprudence is the dichotomy between belief and action originally enunciated by Chief Justice Morrison Waite in 1879. While the First Amendment absolutely prohibits government efforts to restrict beliefs, it does not prevent the state from forbidding practices that threaten public order or safety. In the example Waite used, if a sect believed in human sacrifice, the government could do nothing to restrict that belief; but it could, without violating the Free Exercise Clause, bar the actual sacrifice. While this belief/action analysis remains useful even today, the Court came to recognize that in some areas belief and action overlapped. The Jehovah's Witnesses are a relatively small sect in the United States, but they are responsible for some of the most important cases establishing religious freedom. The Witnesses claimed a right to proselytize, an action, without state regulation, as essential to the free exercise of their creed, a belief. In several cases the Court upheld these claims, but primarily on speech rather than religion clause grounds, yet these decisions are in fact the basis for modern jurisprudence on the Free Exercise Clause.

Hunting Licenses and Permits License Requirements All persons, except those listed below, must purchase the proper licenses before hunting or trapping. Everyone, including those listed below, choosing to take more than the license year limit (see deer bag limit on page 45) must purchase and use bonus deer permits or use special permits (DCAP and DMAP) which are valid only on private land and authorized public land.
  • Resident or non-resident landowners, their husband or wife, children, minor grandchildren (under the age of 18) and their parents do not need a license to hunt, trap or fish within the boundaries of their own lands and inland waters. Tenants, on the land they rent and occupy, are not required to have a license, but must have the written permission of the landowner. Residents, 65 years of age and over, do not need a license to hunt or trap on private property in their county of residence.
