SOME CHARTER COMMITTEE MEMBERS FEAR COMPETITION Today, the state's charter school study committee met for the second time, and on the agenda were a slate of speakers addressing various aspects of charter school legislation and management. But one theme seemed to bother some members of the committee during the morning session - and that was the possibility that charter schools could introduce an element of competition into the education marketplace. First on the agenda were three speakers coordinated by Vermonters for Better Education (the sponsor of this newsletter): Art Woolf, an economist with Northern Economic Consulting, Inc. and former economic adviser to Governor Kunin; Jeanne Allen, president of the pro-charter-school Center for Education Reform; and Lyle Skillen, charter school liaison for the Arizona Department of Education.

SPECIAL EDUCATION
(Updated 3/1/04) OVERVIEW
The department’s special education consultants provide technical assistance to schools and other organizations to help ensure that schools understand and comply with federal and state laws and regulations related to providing special education services. In addition, the special education division offers a due process procedure to parents who have concerns about the services offered to their children.
Under the federal Individuals with Disabilities Education Act, or IDEA, Vermont is required to identify and evaluate students who have disabilities and to offer them individualized education programs (IEP) for special education and related services. Decisions regarding the services that are included in an IEP are made by a team using a process specified in the law. An IEP team includes a student’s classroom teacher, special educator, parent(s) and a representative of the school district who is empowered to commit resources such as staff time or funding. By law, schools are required to carry out provisions outlined in a student's IEP. LINKS TO CURRENTLY AVAILABLE INFORMATION

RFP FOR CHOICE STUDY SHOULD BE READY THIS WEEK The Vermont Department of Education should be ready this week to issue a call for proposals to study the state's nascent and extremely limited high school choice program, according to Policy Analyst Peter Thoms. The department has been working on the RFP for several months. The public school choice law went into effect recently and only allows a handful of students from each public high school to choose another public high school with whom the sending school has formed a collaborative agreement.

Restrictions apply on several other bodies of water around the state. Read carefully the Water Resources Board regulations for information on Lakes, Ponds and Reservoirs. When Should I Carry a Personal Flotation Device (P.F.D.)?
Anytime you use your boat. (Throwable) Persons less than 12 years of age, must wear a Type I, II, or III U.S. Coast Guard approved P.F.D. while on board a vessel, while underway and the person is on an open deck. Federal Requirements for Carriage of PFDs. a. Coast Guard regulations in Part 17 of Title 33, Code of Federal Regulations require personal flotation devices in the following three situations: (1) No person may use a recreational boat less than 16 feet in length or a canoe or kayak unless at least one personal flotation device (PFD) of the following types is on board for each person: (1) Type I PFD, (2) Type II PFD, or (3) Type III PFD. (2) No person may use a recreational boat 16 feet or more in length, except a canoe or kayak, unless at least one personal flotation device of the following types is on board for each person: (1) Type I PFD, (2) Type II PFD, or (3) Type III PFD.

Abstract
Act 60 is the controversial law that defines how we pay for public schools in Vermont. There has been a great deal written about Act 60 and education finance in general, but most of what has been written is far from objective in tone. As a school board member, I wanted access to an unbiased account of how Act 60 works and why it was enacted. Although I found pieces of the story in various places, I didn't find an integrated synthesis of the literature on this important topic, so I decided to undertake the task myself in a semester-long independent study project at Vermont College. My goals for this study were to acquire a thorough understanding of Act 60, to develop respect for the concerns of its opponents and proponents, and to write a document that could help others understand Act 60. The three essays in this portfolio concern the history of education finance in Vermont, a detailed analysis of Act 60, and a comparative review of modern education finance solutions in other states.

ONE BID WINS QUALITY STUDY The National Center on Education Finance (NCEF), a branch of the National Conference of State Legislatures, was awarded a contract from the Vermont Department of Education (VDOE) to perform an education quality study for the Vermont legislature. NCEF was virtually alone in putting in a successful bid. According to Bill Talbott, director of the VDOE's financial office, requests for proposals were sent to eight organizations and posted on the VDOE's web site. This generated three responses - one from Odden and Picus Associates, who decided the money allocated for the study ($50,000) wasn't enough, one from Augenblick, Palaich and Associates, who said they could do it using VDOE resources and staff, and the successful bid from NCEF.

Significant Federal Register Submissions of Interest to Veterans

  • Payment for Non-VA Physician Services Associated with Either Outpatient or Inpatient Care Provided at Non-VA Facilities - The Department of Veterans Affairs (VA) published a final rule in the Federal Register on July 23, 1998 to amend VA medical regulations concerning payment for non-VA physician services that are associated with outpatient or inpatient care provided to eligible VA beneficiaries at non-VA facilities. Generally, when a service-specific reimbursement amount has been calculated under Medicare's Participating Physician Fee Schedule, VA would pay the lesser of the actual billed charge or the calculated amount. Also, when an amount has not been calculated or when the services constitute anesthesia services, VA would pay the amount calculated under a 75th percentile formula or, in certain limited circumstances, VA would pay the usual and customary rate. Consistent with statutory requirements, the regulations specify that VA payment constitutes payment in full.
    Effective Date: August 24, 1998.
