In addition to forming a statewide legislative library network, the library groups agree to assist the State Library Division, tell the library story, cooperate and collaborate with libraries statewide and to use valuable library resources and staff. The Utah Legislature wrapped up the 2004 legislative session with some challenges for Utah libraries. State Library Division general fund base budgets were approved and allocated as submitted for 2005.
State Library Division / Public Libraries Legislation This year Utah lawmakers passed 419 bills, among them, House Bill 341. HB 341 makes Utah the first state to pass a filtering bill modeled on the federal Children's Internet Protection Act (CIPA). Passage of the bill signed by Governor Olene Walker on March 18, 2004 requires no state funds be provided to libraries that do not filter the Internet on library computers used by the public, specific-ally children. As with CIPA, Internet-accessible comput-ers for minors must block child pornography, obscenity and "harmful to minors" materials, while those for adults must block child pornography and obscenity. HB 341 allows the technology protection measure to be disabled by library staff at the request of an adult patron to enable access for research or other lawful purposes. The bill passed the House 69 – 2 and the Senate 23 – 2. It contains no funding for implementation and becomes law on May 3, 2004. Funding sources to cover the cost of filtering are yet to be determined. The cost could be high and affect existing programs. As of April 1, 2004, Utah has less than five public libraries that are not filtering Internet access computers.

It could result in a major increase in the number of Utahns who become active members of AHA and perhaps result in the formation of more local chapters for Humanists of Utah. The American Humanist Association and the Fund of Chapter Expansion has been very complimentary of the success of our project.

Congress can require libraries receiving federal funds to filter out lewd and obscene Internet sites, the U.S. Supreme Court ruled Monday.
Many Utah libraries already filter online access but offer to unblock sites if patrons request it.
That is the policy at Salt Lake County libraries, the state's largest system, with 18 branches. The county also plans to install software within six months allowing patrons to decide what level of Internet access they want; parents, who already must sign forms to get their children library cards, would set their kids' level of access.
"It really puts the responsibility on parents and individuals to choose the access level that's appropriate for them," said Jim Cooper, the county's library director. "We believe the tools we intend to employ will bring us into compliance" with the ruling.

Peter Kraus The State of Utah Libraries: The 2003 Legislature The 2003 session of the Utah Legislature was pressured, filled with agonized debates about how best to deal with unpleasant financial realities. In fact, tough decisions began almost as soon as the 2002 session concluded. Legislators were called into session repeatedly to deal with declining state revenues for the current year budget - FY 2003. Budgets for the coming year, FY 2004, took those reductions as a starting point. Utah State Library Overall, the State Library Division's General Fund appropriation was reduced by 9.9% or $441,400. Although the Division's total budget is higher than last year, the increase is solely due to anticipated increases in LSTA funds and in dedicated credits (the Division's revenue from contractual services). The loss in General Funds will be particularly difficult for the Division to absorb, since the Division has had no budget increases for services since 1995, has lost 3 FTE since FY 2000, and has large fixed costs associated with the bond payment on the current building. Public Libraries The General Fund losses in the State Library Division budget also reduce the amount available for Public Library Development grants. The reduction is $125,600 for FY 2003 and $191,600 for FY 2004. The magnitude of this loss raises a serious policy issue: how to allocate the cuts. Prior - and smaller - losses in grant funds have been distributed on the same percentage basis among all eligible libraries. However, the development grants are especially critical to smaller and poorer libraries. For example, of Utah's 70 libraries, 14 rely on the grants for more than 20% of their operating budget; at the other end of the scale, the grants are less than 5% of the budget for 35 libraries. As a result, the State Library Board has directed the Division staff to scale the reductions so that those libraries most dependent on the grant will take the least reduction. Exact figures have been communicated directly to library directors.
