"No Child Left Behind" backlash in Utah?

An article in today's Salt Lake Tribune reports that "opposition to President Bush's No Child Left Behind education law is gaining traction, and Republicanseven in GOP strongholds such as Utahare among those digging in deepest."
How can a state refuse the will of the Federal Government?
It's easy. Being that the feds have no business telling states how to run their schools (and they certainly lack the authority under the U.S. Constitution), all the state has to do is say "no thank you" to the millions of dollars in federal education programs. A Utah House committee last week unanimously advanced a bill sponsored by Rep. Margaret Dayton, R-Orem, to opt out of the law and forfeit at least $103 million it provides for programs and services that target disadvantaged students. House Bill 43 probably won't be debated on the floor until after a meeting Friday between lawmakers and officials from the U.S. Department of Education. The U.S. DoE folks will try to convince the Utah cadre that it's in their best interest to take the money, and comply with the regulations. We hope they politely decline.

The Associate in Science and Associate in Arts Degree are designed to meet the qualifications of the first two years of a Baccalaureate Degree. A student who transfers from College of Eastern Utah to a public four year institution of higher education in the State of Utah will be automatically cleared of all general education requirements if he or she has received an Associate in Science or Associate in Arts Degree. Most accredited four year institutions of higher education in the United States will accept the Associate of Science or Associate of Arts degree. Students are advised to examine the catalog of the institution to which they plan to transfer. General Education Requirements for AA and AS Degree Students entering the college as a freshman during the 1999-2000 academic year are required to satisfy the general education requirements outlined in this catalog. Students who began prior to 1998 under previous programs may continue to meet those requirements until the year 2003, after which time all students must complete program requirements according to the semester requirements of the year of graduation. Credit other than that intended wholly to meet the General Education requirements of the receiving institution will be applied on the basis of the appropriateness of credit to a particular institution’s specific degree program requirements, as determined by the receiving institution.

    The Utah State Archives is the repository for many permanent government records relating to education, including records from the State Office of Education and the Board of Regents. Records at the Utah State Archives are arranged by creating agency into record series.     Utah's Personal Watercraft Education Course

    A personal watercraft (PWC) is a boat and operator knowledge, skills, courtesies, and awareness are important factors in preventing accidents. State law allows youth 12 to 17 years of age to operate a PWC (Jet Ski, Wave Runner, Sea Doo, etc.), on their own under the following conditions:
    Successfully complete Utah's PWC Education Course. Upon completion, a brightly colored card will be issued and must be in the operator's possession while operating a PWC;
    In addition to the PWC education requirement, operators 12 through 15 years of age must be under direct supervision of a responsible person who is at least 18 years of age;
    A person who is under 18 years of age who has not met the above requirements may not operate a PWC unless accompanied, on board, by a responsible person who is at least 18 years old.

    The HEM staff has been considering pulling these listings. The main reason is that as homeschooling becomes more widely accepted, and as states are scrambling to reform their education system, the situation becomes more complex. This makes overviews, listings and rankings less valid. We have, however, decided to keep these listings in place because they carry, at a minimum, a link to your state government. Additionally we hope reading cited code and at least one homeschooler's interpretation will help start to demystify legislation and encourage you to investigate further. When talking to new homeschoolers we often hear concerns about the law. Is homeschooling legal? Who do I have to notify? What do I have to teach? While the legalities are a concern that should not be ignored, neither should our response be automatic and not thought out carefully.
    There is no single source, no one true homeschooling authority. We all own the responsibility to think through laws and regulations on homeschooling. Of course you'll find those who disagree - an entire industry has grown up around the fact that there are differences of opinion on homeschooling's legal matters. What we offer here are overviews of laws and regulations compiled by knowledgeable homeschoolers. These files are not legal advice nor the final word on the subject. They are simply a starting point. To maintain our freedom to homeschool we will each need to go far beyond any convenient compilation or synopsis. We need to continue to do our own learning, lead our own research, and decide on our own actions.
