Discussion of the Issues:
Issue #1: Internet Service Provider Liability: Title II
1) Passive transmission - automatic transmission, routing or providing connections for subscribers infringing material through an ISP’s system without modification of the content. This “safe harbor” is automatic.
5) Indemnification for misrepresentation - the misrepresentation to an ISP that material infringing or non-infringing renders the party providing the false information liable to the ISP for damages stemming from reliance on the misrepresentation. This safe harbor is automatic.
6) Wrongful takedown - an ISP’s good faith compliance with DMCA’s directions for removing or disabling access to allegedly infringing material shields the ISP from liability to subscribers or third parties for wrongfully taking down or blocking access. See the pre-requisites listed below for exemption of liability.

Assigning an Agent:
If the ISP receives a notice that substantially complies with the DMCA requirements, the ISP must act expeditiously to remove or block access to the allegedly infringing material in order to remain eligible for liability exemption.

Discussion of the Issues:
Network Architecture Plan:
As noted in the planning document for FY99 (especially the UEN Technical Networking Strategic Plan 1998-99 and the attached Network Fusion Overview Document), the Network has reached a critical point at which the network architecture and infrastructure must be examined and potentially reinvented in order to meet the critical challenge of “fusing” the EDNET and UtahLINK services into a single network infrastructure. “Fusing” of these services into a common delivery system will help the Network to meet the ever increasing needs of educators in utilizing technology in support of the instructional/learning process while helping to control costs.
It has been anticipated that the present network implementation, where virtually every high school in the state has two separate, non-shared or statically divided connections, would at some point be replaced with networking facilities that would include high bandwidth capabilities which could be dynamically allocated to service the needs of the schools/institutions. This would facilitate both synchronous and asynchronous teaching/learning environments. The philosophy is that as large bandwidth requirements necessary to carry video applications are needed in an institution or school, the bandwidth could be allocated and guaranteed dynamically to that application; and when the need terminated, the bandwidth would become available and could be reallocated for servicing the other telecommunications needs of the school or institution.

Many of the other problems we face are the result of this lack of trust. Legislators, parents, and others do not trust teachers to teach, and the legislators, teachers and their unions, and others do not trust parents to direct their children's education. Until we solve this problem of trust, we are unlikely to solve the educational dilemma we find ourselves in. Rebuilding trust in education relies on two pillars:
  • Restoring teaching to a profession , rather than a babysitting job. Teachers are qualified, capable, and have a desire to succeed. What stands in their way is a laundry list of regulations. Teachers are professionals, but it has been a long time since they were treated as such. We must: Returning control over a child's education to their parents . As we return teaching to a profession, accountability must be achieved. We can achieve this by allowing parents a choice over where and how their children's education takes place. Any parental choice program for Utah Education must:

What specific changes will you propose / support to improve the quality of education? I will pursue school trust land swaps so that our natural resources (oil shale in Eastern Utah, coal and natural gas in Southern Utah, for example) can be developed, and billions of dollars can get to Utah's schools. I also propose to drastically reduce state and federal control over our classrooms by limiting the power of the State school board over local school boards, cutting state education regulations, and forgoing federal funds, if necessary, in order to get federal bureaucratic regulations out of our classrooms, and free up our teachers to really teach, rather than just ride herd. As a means of achieving the accountability that bureaucrats and legislators desire, I will put choice back into the hands of parents, starting with a pilot voucher program, implementing that program statewide as it shows itself successful, as I believe it will. 2.     CREATION FUNCTIONS ADMINISTRATION The district is governed by a five-member, elected Board of Education. Voters in each of the district's five precincts elect one member to serve as their representative on the Board of Education. School board elections are held in November in conjunction with the general election. The board members elect a president and vice president at the time new members are sworn into office at the first board meeting in January. The district is also subject to the general oversight of the Utah State Office of Education. The superintendent appointed by the board is the executive officer of the board. ORGANIZATIONAL HISTORY Murray residents objected to the consolidation of Salt Lake County Schools in 1905, which would have split the population of the newly incorporated city (residing in county school districts 24 and 25) between Granite District on the north and Jordan District on the south. Through annexation, the population of Murray was increased above the necessary threshold to qualify as a city of the second class.       4.1. Program Description - UCOPE is a State supplement to increasingly inadequate grant and work assistance from Federal Government student financial aid programs. In Utah Code , the Legislature finds "that the general welfare and well-being of the state are directly related to the educational levels and skills of the citizens of the state, and that limited financial aid for students with demonstrated financial need to help finance costs of attendance at Utah postsecondary institutions is a necessary component for ensuring access to postsecondary education and training as the state enters its second century of statehood." Program funds may be used for either grants or work-study awards to students with demonstrated financial need, with no more than 3.0% of funds allocated to an eligible institution permitted to be used for administrative costs. These are the only purposes for which program funds may be used.

The information requested includes the following: the student's first and last name; social security number; date of birth; address; full/part-time status; and institution attended. You ask whether FERPA would permit the Utah Board of Regents to disclose the requested information to the State Auditor. As you are aware, FERPA is a Federal law that protects an eligible students

Riverdale Elementary has been inspected for asbestos materials. The results of the inspections are contained in the Asbestos Management Plan. IMMUNIZATIONS: Effective July 1, 1992, the Utah State Immunization Law mandates that student immunization records must be complete and on file at the time of registration in order for a student to attend school.
