It is important to keep in mind that the interpretation of laws is not a simple matterif it were, attorneys would be unemployed! We recommend that legal questions regarding home schooling be referred to the Home School Legal Defense Association.

State System of Public Education
53A-11-101. Responsibility for minor required to attend schoolPenalty for violation.
A person having control of a minor between six and 18 years of age shall send the minor to a public or regularly established private school during the school year of the district in which the minor resides.
It is a misdemeanor for a person having control of a minor under Subsection (1) to willfully fail to comply with the requirements of this chapter.
A local board of education shall report cases of willful noncompliance to the appropriate juvenile court.
Officers of the juvenile court shall immediately take appropriate action.

Utah System of Higher Education Approved in 1997, this document states the purpose, policy, and procedure for the Utah Sytem of Higher Education's General Education program. To assure full value and reciprocity among all USHE institutions, the number of credit hours required in General Education ranges from 30 to 39 semester credits, including credits required in the core areas of composition, quantitative literacy, and American Institutions. The state policy provides consistency in the structure of general education at USHE institutions while allowing latitude for institutions to establish and preserve unique requirements which reflect emphases of the institutions, strengths of faculties, and varying interests of students. Delta College Whether through traditional transfer or some other enrollment pattern, an increasing number of students participate in formal learning experiences at two or more institutions. Several challenges associated with swirling enrollment are addressed in Delta College's General Education program, including academic assessment and outcomes. Illinois Articulation Initiative iTransfer supports the Illinois Articulation Initiative's (IAI) mission to facilitate student transfer from one participating Illinois college/university to another in order to complete a degree. iTransfer's goal is to make planning and gathering transfer information simple. The iTransfer website highlights the IAI General Education Core Curriculum (GECC) and Major recommendations.

CREATION The office of Attorney General was created within the Executive branch in 1896. The Attorney General is to "be the legal advisor of the State officers, and shall perform such other duties as may be provided by law." (State Constitution, Article 7, Section 18). The Attorney General inherited functions previously performed by the United States District Attorney and Territorial Attorney General. FUNCTIONS As of 1998, the Attorney General's duties include the following: 1. Prosecute or defend all causes in which the State or a state agency is a party. 2. Initiate legal proceedings on behalf of the state. 3. Direct the process of executions on judgments. 4. Account for state funds which come into possession of the office. 5. Keep a file on each case, civil or criminal, in which the Attorney General is required to appear. 6. Act as supervisor to district and county attorneys within the state. 7. Give opinions on questions of law to state agencies and to county or district attorneys. 8. Assist district or county attorneys when required by public service or by the Governor.

CREATION Washington County's nineteen school districts were consolidated into the Washington County School District in June 1915. Shortly after hiring Superintendent Kolene F. Granger in 1996, the district adopted the following mission statement: "Together: Pioneering New Horizons in Teaching, Learning, and Leading." During the term of Superintendent Steve Peterson (1984-1996), the district's mission statement read: "Proceed on the premise of what's best for kids." FUNCTIONS Washington County School District provides public education for students in kindergarten through twelfth grade. Reported enrollment for the 2001-2002 school year is 18, 775. District offices are located in St. George, Utah. The district has 29 schools18 elementaries, one sixth grade center, one sixth-seventh intermediate, four middle schools, and six high schools. The district includes the communities of St. George, Washington, Santa Clara, Ivins, Hurricane, LaVerkin, Dammeron Valley, Central, Veyo, Pine Valley, Leeds, Hildale, Virgin, Enterprise, Springdale, Toquerville, and Winchester Hills. It covers 2,425 square miles. ADMINISTRATION The district is governed by a five-member, elected Board of Education. Voters in each of the district's five precincts elect one member to serve as their representative on the Board of Education. School Board elections are held in November in conjunction with the general election. The board members elect a president and vice president at the time new members are sworn into office. The district is also subject to the general oversight of the Utah State Office of Education.

The project will capitalize on existing partnerships and create new alliances within the educational community, with parents and other consumers, and with other state agencies to improve the overall quality of services delivered to students with disabilities. The State Improvement Grant has three primary goals:
  • Implement a decision-making infrastructure that will systematically and progressively improve access to and quality of instructional services at every level of the state educational delivery system. Implement changes in policy, technical assistance to administrators, and personnel preparation activities to ensure that the students with disabilities have access to, placement in, and progress within the general curriculum. Provide technical assistance and personnel preparation activities that will ensure students with disabilities have access to needed effective, proactive behavioral/social interventions that provide individuals with the attitudes and competencies needed to be successful, caring members of society.

    Students interested in teaching in the secondary schools of Utah (grades 6-12) can complete course work leading to a Secondary Teaching License in the State of Utah. Interested students are required to complete a Composite Teaching Major or an academic Teaching Major and a Teaching Minor in one or more of the University's academic colleges. In addition, a minimum of 29 semester hours of professional education course work must be completed in the department of teacher education. A Utah teaching license (elementary or secondary) is recognized by almost all other states and territories in the United States. Secondary Block courses and Student Teaching will be offered in separate semesters. Students will not be admitted to the Secondary Educational Professional Blocks unless 95 percent of their academic major and minor are completed. I have been out of town and am just now able to respond to your request. As a scholar and journalist, you will undoubtably appreciate that much of the information that you have requested is available via the Utah Education Network home page. The address is www.uen.org. You will find various links to the information available. However, to save you some time, specific links will access some of the specific information which you have requested. I have listed several of these below. 1. The Acceptable Use Policy can be found at www.uen.org/cgi-bin/websql/utahlink/policy.hts. You will also note that there is a general Utah Education Network (Network) acceptable use policy and policies for each of the public school districts in the state. 2. The report to the State Board of Education was actually a report to a subcommittee of the Board and was generally verbal in nature. The minutes of the subcommittee might be available to you; however, we are not the `owners' of that information and do not have direct access to it. 3. Computer log files of Internet sites accessed through our network. Each of the school districts chooses (completely at their discretion) whether or not to filter and can select sites to filter (or which they would choose not to filter) for their district and for each of the schools within their district. Each log is maintained by the Network for and in behalf of the districts. The districts are the `owners' of the data contained in the logs. The Utah Education Network acts only as the custodian of the data and is not authorized to release those detailed logs. The information which you request can be obtained only by requesting it from the owners and then only if it is not considered and/or designated as `private' under the referenced statute. Generally, the logs could be considered as `private' inasmuch as they reflect individual student and/or teacher accesses to the information available on the Internet. 4. Records of sites `blocked' are a part of the above addressed logs. 5. Obviously, the logs referenced in the Associated Press story are the same logs as noted above. 6. The public school districts in the state of Utah have the legal obligation to determine the curriculum materials which are available to the students in their schools. The Utah State Board of Education has polices that specifically address the kinds of materials with are deemed not to be appropriate for the classroom. The schools districts in the state are acutely aware of the challenge of providing the students which they serve with `world-class' educational opportunities while not introducing or permitting to be introduced materials which are in violation of the State Board's Policies or which may violate the `community standards' regarding pornography. Libraries and Institutions of Higher Education generally do not filter materials available to their students, faculty, or patrons. However, libraries may institute similar criteria as they might presently utilize in building and/or maintaining their collections. There are several software packages which permit libraries to implement criteria which is inclusive of sites and information which is aligned with their selection criteria. Additional informational regarding filtering categories and statistics in aggregate form for the public schools of the state is available at www.helpdesk.k12.ut.us/filtercon.htm. 7. As noted earlier, the public school districts have the option as to whether or not to filter. The decision is under their direct control and specifically related to their policies regarding curriculum materials available to their students. Additionally, they have the option to select to either permit or to preclude access to any specific site. 8. Filtering is a service which is offered to the public school districts of the state and is provided as a function of the Networks's Help-desk facility. 10. There is not a document which `orders' the Utah Education Network to provide `filtered Internet access'. As noted, it is service which is available to the public school districts. It should also be noted that legislative language requiring all school districts in the state to filter Internet access was introduced in the 1997 Legislative Session. The bill was modified to establish a commission which reviewed the present procedures and options available to the districts. The commission determined that the process, procedures and options available to the districts were adequate and were appropriately aligned with state law and the policies of the State Board of Education.
