  • European Commission Adopts Decision Recognizing Adequate Privacy Protections in EU-US Passenger Data Disclosures. In its Decision, the Commission considers that the data on air passengers transferred to US authorities enjoys the "adequate protection" required under the EU Data Protection Directive for data sent to countries outside the EU. The Decision will enter into force once the US signs its Undertakings and once the international agreement that will complement the Commission's adequacy finding has been signed by the Council of the EU and the US Department of Homeland Security. For the European Parliament, however, the Undertakings do not offer adequate protection. If the Council concludes the agreement, the Parliament has the option to seek the annulment of the international agreement, or of the adequacy finding, or both, before the Court of Justice of the European Communities. January 21, 2003 This week, as the United States celebrates the life of slain civil rights leader Dr. Martin Luther King, Jr., Oxfam's US partners continue the struggle, calling for the US Department of Agriculture to end decades of damaging racial discrimination.
The USDA's record of racial discrimination is well documented. In 1997, the USDA Civil Rights Action Team (CRAT) revealed decades of racial discrimination that had put thousands of African-American farmers out of business. By denying or delaying loans essential to financing their crops, and by withholding other federal farm support on a widespread basis, USDA employees forced African American farmers to lose their land, their livelihoods, and their communities. According the CRAT report, "In the Southeast, for example, in several states it took three times as long on average to process African-American loan applications as it did non-minority applications." "In 1994, 94% of all county committees [that grant these loans] had no female or minority representation." That pattern of non-representation continues today.
Discrimination by the USDA has contributed to the dramatic decline in the number of minority farmers over several decades. In 1920, there were 925,000 African American farmers in the United States; by 1992, there were fewer than 18,000. Fifteen years before the CRAT report, the U.S. Civil Rights Commission had warned, "unless government policies of neglect and discrimination are changed, there may be no black farmers by the year 2000."

WASHINGTON (UPI) - The Supreme Court ruled 5-4 along ideological lines Tuesday that private individuals do not have a right to sue under the federal Civil Rights Act when they claim they are targets of discrimination in a government program. The case involves a Mexican immigrant who sued Alabama because it administers drivers' tests in English only. (Road signs in Alabama are, of course, in English only.) Title VI of the 1964 Civil Rights Act orders that no one "on the ground of race, color or national origin be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity" covered by the law. Title VI authorizes federal agencies to enforce its mandate in federally subsidized programs. The question before the Supreme Court in the Alabama case, however, was whether an individual had the right to sue under Title VI.

Pictures of the slaying shocked the world. Two white men charged with murder - Roy Bryant and his half brother, J.W. Milam - were acquitted by an all-white jury. Both men have since died. R. Alexander Acosta, assistant attorney general for civil rights, said a recent public television documentary about the killing and other new information brought to the Justice Department's attention suggests that additional people still alive were involved in the killing. "This brutal murder and grotesque miscarriage of justice outraged a nation and helped galvanize support for the modern American civil rights movement," Acosta said. "We owe it to Emmett Till, and we owe it to ourselves, to see whether after all these years some additional measure of justice remains possible."

Financial institutions (FIs) such as banks and asset managers can and must play a positive role in advancing environmental and social sustainability. This declaration calls on FIs to embrace six main principles which reflect civil society's expectations of the role and responsibilities of the financial services sector in fostering sustainability. The following civil society organizations call on FIs to embrace the following principles, and take immediate steps to implement them as a way for FIs to retain their social license to operate. Can the Rights of People Simply Disappear by Presidential Order? What does it mean when the President of the United States can on his own designate a citizen in the U.S. as an “enemy combatant,” and order the military to hold that person incommunicado, indefinitely, and without charges? The U.S. Supreme Court is now deciding whether the courts even have the right to question the President’s action. What does it mean when the U.S. military internationally can literally snatch people off the street, designate them as “enemy combatants,” and assert that they are beyond the reach of either U.S. or international law? Many are transported to a facility under total U.S. control and funded by Congressional appropriations, where they are held incommunicado, indefinitely, without charges and some are threatened with trials before a military commission that falls short of basic standards of justice. If the Supreme Court upholds these actions, it will condone the President’s claim of virtually unlimited “wartime powers” without a formal declaration of war by the Congress, and with no or extremely limited oversight by the courts or the Congress. On April 20 the U.S. Supreme Court will hear oral arguments on the President’s alleged right to create a “law free zone” at the Guantanamo detention center in Cuba. And on April 28, the Court will hear oral arguments on the President’s asserted right to designate citizens as “enemy combatants,” hold them at the U.S. Navy base in Charleston, SC, and deny them the ability to challenge the lawfulness of their detention.
