August 19, 2003 New Traffic Laws Take Effect Driving-related legislation taking effect September 1, 2003:
  • SB 45 makes it a state jail felony to drive while intoxicated with a passenger younger than 15.
    SB 193 requires drivers nearing stopped emergency vehicles-with lights activated -to either slow down or change lanes. The law states a driver must either vacate the lane closest to the stopped emergency vehicle if the road has multiple lanes traveling in the same direction or slow down 20 miles per hour below the speed limit. (If the speed limit is below 25 mph the driver must slow down to 5 mph.) Emergency vehicles include police, emergency medical service and fire vehicles. A violation is punishable by a maximum fine of $200. If the violation results in property damage, the maximum fine increases to $500. If the violation results in bodily injury, the offense is enhanced to a Class B misdemeanor.

Information on Texas driving law and Texas traffic laws... Operating a motor vehicle is a privilege. If this privilege is abused by violating Texas traffic laws it may result in driver's license suspension or revocation. Updates New driving laws and traffic laws in Texas took effect on September 1, 2003. HB 1330 of Texas driving law allows a drivers license applicant to voluntarily list on their license any health condition that might impede communication with peace officers. The applicant must supply DPS with a written statement from a licensed physician. This law takes effect Jan. 1, 2004. An erroneous e-mail has circulated claiming that HB 281, which would have outlawed talking on a cell phone while driving—or without using a hands-free device—had passed and was to take effect September 1. The bill did not pass and did not take effect.

Keeping Your Driver's License
In order to keep your driver's license, you must drive safely at all times. Under Connecticut driving law, you can lose your license for: 1. Leaving the scene of an accident in which you are involved, without identifying yourself. 2. Giving false information when you apply for a driver's license. 3. Attempting to change the information on your license or using someone else's license when attempting to purchase an alcoholic beverage. 4. Failing to appear for a re-examination. 5. Failure to comply with DMV requests. 8. Using a motor vehicle to commit a felony or taking the life of someone in a motor vehicle accident. 9. Letting someone else use your driver's license or identity documents to obtain a license or ID card. 10. This information is from a variety of sources including the 1987 Fahren Lernen driver's education manual and the 1993 official Straßenverkehrs-Ordnung (Road Traffic Ordinances) distributed by the Federal Transport Ministry as well as numerous contributions by readers. Special thanks to Tino Haderlein and Wolfgang Meyenberg for their review of these pages. CONTENTS

The most important section here for foreigners is the right-of-way discussion. LICENSING If you are visiting Germany and will not be establishing residency, then your current driver's license is valid in Germany indefinitely. If you will be residing in Germany, your driver's license is valid for six months from the date when permanent residency is established. After that, you will have to obtain a German driver's license. (If your residency will be for longer than six months but less than one year [you will need proof of this], you can obtain a six month extension to use your existing license.) If you're using a foreign license to drive in Germany, you're supposed to carry an official translation of your license in addition to the license itself, but if you speak the language well enough, I've found that you should be OK. If you should get into a situation where you need to have a translation, you can get one from the ADAC automobile club for about €40. If you want to have a bit of "insurance", you can take care of this before arriving by getting an International Driver's License (IDL) in your home country. In the US, these are available from AAA for about US$20. (My recommendation: get an IDL before you go better safe than sorry.) Keep in mind that an IDL does not replace your official driver's license it is just a translation of it in an internationally recognized format. You must carry your official license with your IDL.

Super Bowl Sunday 2004 Update
  • Super Bowl Sunday has become a major problem day for impaired driving in DC and across the country. Nationwide, Super Bowl Sunday now rivals New Year's Eve in the number of alcohol-related traffic crashes and fatalities. This year's Super Bowl game, between the Carolina Panthers and New England Patriots, kicks off at 6:25 pm on Sunday, February 1. In DC, the Metropolitan Police Department will be conducting a sobriety checkpoint, and neighborhood patrol officers will be paying special attention to suspected impaired drivers before, during and especially after the game. The MPDC checkpoint is one of a series of sobriety checkpoints being conducted throughout the region as part of the "Checkpoint Strikeforce" initiative. The message to motorists on Super Bowl Sunday: you can be stopped anywhere, at any time ... so don't drink and drive!

If your blood alcohol concentration (BAC) level is 0.10 or higher (0.04 in a commercial vehicle) and you are in control of a moving or parked vehicle, you can be arrested for driving while intoxicated (DWI). If a law enforement officer can prove that alcohol caused you to commit driving errors, you can be convicted of DWI at lower alcohol concentrations. Penalties and Driver License Sanctions
Each year, more than 30,000 people are arrested in Minnesota for DWI. Each person may experience unique criminal penalities in addition to administrative license sanctions, depending on the arrest situation and previous driving violations and criminal record. To assist the public in understanding Minnesota's impaired driving laws, a guide for penalties and sanctions you may experience if your are arrested for impaired driving has been created. There are additional laws, penalties and sanctions for individuals under age 21. These guidelines are based on offenses that occur within 10 years.

Occurrence and Consequences
  • Alcohol-related motor vehicle crashes kill someone every 30 minutes and nonfatally injure someone every two minutes (NHTSA 2003a).

    In 2001, more than 1.4 million drivers were arrested for driving under the influence of alcohol or narcotics (FBI 2001). That’s slightly more than 1 percent of the 120 million self-reported episodes of alcohol–impaired driving among U.S. adults each year (Dellinger 1999).
    Drugs other than alcohol (e.g., marijuana and cocaine) have been identified as factors in 18% of motor vehicle driver deaths. Other drugs are generally used in combination with alcohol (NHTSA 1993).
    Nearly two-thirds of children under 15 who died in alcohol-related crashes between 1985 and 1996 were riding with the drinking driver. More than two-thirds of the drinking drivers were old enough to be the parent of the child who was killed, and fewer than 20% of the children killed were properly restrained at the time of the crash (Quinlan 2000).
