2000 Edition Texas Property Tax Code The Property Tax Code was enacted into law by the 66th Texas Legislature in 1979 (Senate Bill No. 621, 1979 Tex. Laws. p. 2217, ch. 841, Sec. 1). The historical notes following some sections in this publication refer to amendments made to the Code in subsequent legislative sessions. October 20, 2003 Vol. 4 No. 21 Texas Attorney General's Ruling Undermines Public Access Published On: 10/20/2003 04:54 PM On Oct. 6 the Texas Attorney General rejected the Sunshine Project’s request for access to University of Texas Medical Branch (UTMB) Institutional Biosafety Committee (IBC) records under the Texas Public Information Act. This decision prohibits the public from accessing information regarding human health and environmental damages that might result from IBC's research on biological weapons agents. The Sunshine Project has been seeking information on the committee’s membership, policies, meetings and decisions for over a year. UTMB contends these documents contain intellectual property and are so sensitive that a judge may not view them. The IBC was established under federal National Institutes of Health (NIH) Guidelines for Research Involving Recombinant DNA Molecules and the committee reviews and approves the use of biological agents on the UTMB campus. The NIH guidelines for research safety mandates public access to the minutes of IBC meetings, requires a mechanism for public commentary on IBC decisions, and encourages UTMB to open its IBC meetings to the public. Under the Texas Public Information Act , there are no exemptions that would prohibit disclosure of the material requested.

Indicates new addition since last update REVIEW REQUIREMENTS REFERENCE COMMENTS FORMS Filing Standards Prior Approval of Policy Forms and Endorsements - Large Risk Exemption Article , Texas Insurance Code An insurance policy form or endorsement may not be delivered or issued for delivery in this state unless the form has been filed with and approved by the commissioner. Each filing shall be made not later than the 60th day before the date of any use or delivery for use. Policy forms for use with large risks are exempt from filing for prior approval if the forms are to be used with a "large risk". "Large Risk" is defined as an insured that has total insured property values of $5 million or more; an insured that has total annual gross revenues of $10 million or more; or an insured that has a total premium of $25,000 or more for property insurance, $25,000 or more for general liability insurance, or $50,000 or more for multiperil insurance. Applications Not Required to be Filed For Approval Arbitration Limited to Coverage Disputes Article , Texas Insurance Code The arbitration is to be limited to coverage disputes. The arbitration agreement will not affect or cover third party claimants. The cost of arbitration is to be split equally between parties. Arbitration agreements are not to apply to rates. Language used in arbitration agreements is to be consistent with that of the policy: to wit, don't use the word "parties" when you actually mean insured(s) and insurer. Binding arbitration is okay. This is to say that the results of an arbitration decision may be made binding on both parties to it. Arbitration agreements may be mandatory. This is to say that it is permissible to require coverage disputes to be handled by arbitration. Arbitration must be held in Texas for Texas policyholders unless mutually agree on an alternate.

The author is not licensed to practice law in states other than Texas, and the following should not be taken as statements of what the law is outside that state. The General Partnership A general partnership is exactly that: An enterprise between two or more partners. It is perhaps the simplest of business entities. In Texas, two statutes are especially important concerning partnerships; The Texas Uniform Partnership Act and the Texas Revised Partnership Act. On this page, the term "partnership" means a general partnership. Different rules apply for limited partnerships. Forming a partnership is easy. All that one has to have is an association between two or more partners that they will associate for a common enterprise, and share the profits and losses from that enterprise. A partnership does not have to use a special name, and it does not have to file anything with the Secretary of State of Texas to begin its existence. A partnership may exist even when there is no written or oral agreement to form one; the mere association and sharing of profits and losses can create a partnership. A partnership may be perpetual in nature, although typically the partnership agreement limits its term.
