TEXAS CRIME VICTIM RIGHTS A victim of a violent crime is someone who (1) has suffered bodily injury or death or who has been the victim of sexual assault, kidnapping, or aggravated robbery, (2) the close relative (spouse, parent, or adult brother, sister or child) of a deceased victim, or (3) the guardian of a victim. The following rights are from Chapter 56, Article 56.02 of the Texas Code of Criminal Procedure. (a) A victim, guardian of a victim, or close relative of a deceased victim is entitled to the following rights within the criminal justice system: (1) the right to receive from law enforcement agencies adequate protection from harm and threats of harm arising from cooperation with prosecution efforts; (2) the right to have the magistrate take the safety of the victim or his family into consideration as an element in fixing the amount of bail for the accused; (3) the right, if requested, to be informed:

Chapter 58. Records; Juvenile Justice Information System
Subchapter C. Automatic Restriction of Access to Records.
In this subchapter, "department" means the Department of Public Safety of the State of Texas.
The following records are exempt from this subchapter:
sex offender registration records maintained by the department or a local law enforcement agency under Chapter 62, Code of Criminal Procedure; and records relating to a criminal combination or criminal street gang maintained by the department or a local law enforcement agency under Chapter 61, Code of Criminal Procedure.
The department shall certify to the juvenile court or the juvenile probation department to which a referral was made that resulted in information being submitted to the juvenile justice information system that the records relating to a person's juvenile case are subject to automatic restriction of access if: the person is at least 21 years of age;

Ch. 618] A person commits an offense if the person operates a passenger car or light truck and transports a child who is younger than five years of age and less than 36 inches in height and does not keep the child secured during the operation of the vehicle in a child passenger safety seat system according to the instructions of the manufacturer of the safety seat system. (a) [2 Versions: Amended by 77th Leg. Sess. Ch. 910] A person commits an offense if the person operates a passenger vehicle, transports a child who is younger than four years of age or less than 36 inches in height, and does not keep the child secured during the operation of the vehicle in a child passenger safety seat system according to the instructions of the manufacturer of the safety seat system. (b) An offense under this section is a misdemeanor punishable by a fine of not less than $100 or more than $200.

Article 2 (Gambling Offenses) in Chapter 66 (Offenses Against Public Health and Decency) states that it is an offense to engage in unlawful gambling, BUT that it is an "affirmative defense" to prosecution for the person to claim having been part of a "social game".
A "social game" is defined as gambling in a home where no house player (barring Home Craps and other home casino games), no house bank, and no house odds exist, and where there is no house income (rake) from the operation of the game. No House and no rake means that home gambling is a defense against unlawful gambling, and legal in the state of Alaska.

While on adjudicated probation, the offender may be required to participate in any program deemed appropriate, such as an intensive supervision program or residential placement. Adjudication Hearing : Hearing held after the announcement hearing where it is determined whether the child committed the offense named in the petition; the juvenile equivalent of a criminal trial. Announcement Hearing : The first hearing in the Juvenile Court process at which time the judge determines if the Court needs to appoint an attorney, or if the family can retain their own. Appeal : A complaint to a higher Court urging that it overturn the decision of a lower Court. Certification Hearing : Hearing held to determine whether the juvenile court will waive its jurisdiction so that an accused juvenile felony offender can be prosecuted as an adult. Certification is permissive and not mandatory under Texas law. Depending upon the type of felony committed, a juvenile as young as either 14 or 15 years of age can be certified to stand trial as an adult.

Unfortunately , Federal government does not require that the states implement any access provisions, not do they require that states enforce access. The statute to which you probably refer is Section 25.03 of the criminal code which was passed as a means of dealing with parental kidnapping, but written in such a manner as to also imply "visitation" denial. The last legislative session rewrote the criminal code and altered the penalties for many crimes, including parental kidnapping (25.03). Some members of the committees through which the enacting bill passed used that opportunity to read legislative intent into the law, making 25.03 apply to "visitation" denial as well as other forms of parental kidnapping. Will the new interpretation be used? The threat of its use by prosecuting attorneys has resulted in some NCPs reestablishing contact with their children. Several assistant district attorneys would like to use it to prosecute denial of "visitation" but have been overruled within their own office meaning that it is only a matter of time until an office begins to make full use of the statute. And, when one does, soon another will. Texas does provide other provisions for enforcing access: the offending party and all that assisted them in the denial can be sued; a lawyer can be appointed to file papers to enforce access by contempt, and the offending party must pay that lawyer; a Friend of the Court can be appointed to enforce access, using counseling, mediation, social workers, contempt, or any other vehicle, and the offending party must pay that attorney's fees; and, of course, now there is 25.03.

Finding Texas law in the Tarlton Law Library
Prepared by Beth Youngdale Researching “the law” on a particular topic is generally a multi-step process that involves checking a number of sources - statutes, cases, and, sometimes, administrative rules or regulations. Very rarely is there a simple answer to a legal question or a single book that will provide an answer. Discovering what “the law” is in a given situation means finding the rule that is applicable - usually a statute, or in some instances a case - and then applying the rule to the facts of the situation. Case law is generally used to see how courts have applied the rule in other situations. The key is finding a case with facts that are analogous to your own.
Getting started
Where you start depends largely on what information you already have about the area of law you are researching. If you already have a citation - to a statute or a case - you are, to a certain extent, ahead of the game. Statutes and cases provide excellent jumping off points to additional sources of the law. If you don't have a citation, or are unfamiliar with an area of law, secondary sources are a good place to start. These sources, which are not the law, provide background information, an introduction to the terminology of a particular topic, and valuable citations to primary sources of law (statutes, cases, administrative rules).
