TEXAS RULES OF CIVIL PROCEDURE
ORDERED that: 1. Pursuant to Article XVI, Section 50(r) of the Texas Constitution, as amended by S.J.R. 12, 76 th Leg., R.S., approved November 2, 1999, the Supreme Court of Texas amends Rules 735 and 736 of the Texas Rules of Civil Procedure to read as follows. These amendments to Rule 735 and 736 provide for expedited proceedings related to the foreclosure of certain liens under Article XVI, Section 50(a)(7) of the Texas Constitution relating to reverse mortgages. These amendments to Rules 735 and 736 were recommended by a task force appointed by the Court to advise it regarding the promulgation of such rules, see Misc. Order No. 99-9233, dated December 1, 1999, with modifications recommended by the Supreme Court Rules Advisory Committee. 2. These amendments, with any changes made after public comments are received, take effect April 15, 2000. 3. The Clerk is directed to file a copy of this Order with the Secretary of State forthwith, and to cause a copy of this Order to be mailed to each registered member of the State Bar of Texas by publication in the Texas Bar Journal BY THE COURT, IN CHAMBERS this

Profile
Robert Casad joined the faculty of the Law School in 1959 and was named John H. and John M. Kane Professor of Law in 1981 in recognition of his internationally known scholarship in civil procedure, jurisdiction and conflict of laws. His work is often quoted and often cited. He received the university's Balfour Jeffrey Research Achievement Award in 1984 and the law school's Rice Prize for Faculty Scholarship in 1977, 1983, 1984, 1985, 1988, 1989, and 1991. An active member of the American Law Institute and the International Association for Procedural Law, Casad has been a frequent participant in IAPL conferences in Europe. He has been a visiting scholar/lecturer at universities in Europe, Asia, and Central America and a visiting professor at UCLA, Illinois, Hastings, Vienna, Michigan and Emory. In 1997 he retired from classroom teaching but not from research and writing.

Viewed as a way to encourage health care providers to provider free care to underserved populations, states have removed the threat of civil suits against providers who are acting in good faith.     Restatement of the Law Governing Lawyers Another important relationship between the Restatement and the ethics codes is that between decisional law and statutory law. The Restatement draws heavily on decisional law, while the ethics codes in almost all jurisdictions have the form and force of statutes, or at least administrative regulation. On subjects directly addressed in the ethics codes, the Restatement frequently tracks this statutory language literally, or at least without material change. In many instances, however, the Restatement significantly departs from the code formulations. Carefully considered and extensively debated, many of these departures simply clarify the underlying intention of the code provisions, while other departures seek to supersede drafting mistakes. Still other departures reflect the recognition that experience with the codes has revealed better resolutions on a variety of issues.
