A thousand thank yous to those of you who've called, emailed, sent flowers, or in some way let me know you were thinking of Mazie and me. I'm doing about as well as I could be, I imagine. Funeral's tomorrow. Tomorrow night will hopefully bring a long night's sleep. Hopefully I'll be up to writing more about Mazie sometime soon. But in the meantime, I want to point out that Howard Swindle died a few hours after Mazie. From 2000 until he entered hospice care a couple months ago, Howard sat across the aisle from me at the Morning News. Let me tell you, that man was a hell of a journalist. Overhearing his phone calls was a journalistic education he could get anybody to tell him anything . And he was an honest man with an underdog's spirit. These three grafs in the DMN obit tell the story: "One of his secrets to getting information was that he was so likeable," said Eric Miller, a former colleague. Mr. Miller, now an investigator in Washington, said he learned from Mr. Swindle that the soft-sell works. "He never talked down to people, and treated everyone with respect, whether they lived in trailer parks or mansions. I marveled at how he could get anyone to talk." [Managing editor Stu] Wilk said he, too, was struck by Mr. Swindle’s ability to befriend even those he investigated.

    What is fair use?
We would all appreciate a clear, crisp answer to that one, but far from clear and crisp, fair use is better described as a shadowy territory whose boundaries are disputed, more so now that it includes cyberspace than ever before. In a way, it's like a no-man's land. Enter at your own risk. and their lawyers agree that fair use is so hard to understand that it fails to provide effective guidance for the use of others' works today. But the fact is, we really must understand and rely on it. So wouldn't Guidelines help? Many people who think so recently gathered in Washington to negotiate Guidelines for Educational Uses of Digital Works in a two-year-long Conference on Fair Use ("CONFU") . For many, the Guidelines that emerged satisfied the need for clarity; but for some, considerable objections remained. Some CONFU participants and their constituents complained that the Guidelines were too narrow; others that they were too broad; or unfounded in the law; or too premature; or too long; or unclear; and so on. In the minds of many, the Guidelines asked the right questions, but for some, they provided the wrong answers. larger strategy Copying, modifying, displaying, performing or distributing another's work beyond the suggestions of the Rules of Thumb may still be a fair use, so we'll use the four-factor fair use test to determine that. FOREWORD
In 1990, when the last state plan for the education of gifted students was adopted by the Texas State Board of Education, the mandate to identify and serve these students had just been implemented. That plan was designed to provide program guidance and to assure that all students had the opportunity to be fairly and accurately assessed for advanced level services. This new Texas state plan, adopted by the State Board of Education in November 1996, builds on that effort and takes districts and campuses to the next level of program implementation: refining existing services and creating additional curricular options that lead to exceptionally high levels of student performance. Welcome to the Texas Highway Patrol Education and Awareness page. Our goal is to educate our citizens and visitors on crime prevention and to gain voluntary compliance with traffic laws. By educating the public, we hope to reduce crime and to reduce the number of injury causing crashes on Texas Highways. Please use the information on our website as a resource for class discussions, safety meetings, or general discussion. You may also contact a Trooper for safety presentations for your school, organized group, or business. OVERVIEW The Texas Legislature created the Safety Education Service (SES) in 1957. The service was a part of the Traffic Law Enforcement Division of DPS. Troopers in this service were charged with the duties of educating the public concerning the States traffic laws, thereby stimulating voluntary compliance. In September of 2003, the Safety Education Service became a component of the Texas Highway Patrol Service as a part of reorganization in the Traffic Law Enforcement Division. The name of the Division will change to the Texas Highway Patrol Division.
