THE TEXAS EDUCATION AGENCY
July, 1999 Introduction
The Office of Special Education Programs (OSEP) has specifically stated that the complaint management system is supposed to be a less costly, but equally effective, alternative to filing a request for a due process hearing. Therefore, any issue that would be appropriate to take to a hearing is also appropriate for the complaint management system. In many instances, the parent should try to resolve the complaint with the school district by going to an Admission, Review and Dismissal (ARD) meeting before filing a complaint with TEA. For example, if the parent believes that the school district staff is not implementing the modifications called for in the Individualized Education Program (IEP), the parent should bring that to the attention of the ARD Committee and complain to TEA if it continues to be a problem.

FILING A COMPLAINT WITH THE TEXAS EDUCATION AGENCY July, 1999
Introduction Parents, and other interested persons, who have complaints about the special education services being provided by a school district may file a complaint with the Texas Education Agency (TEA). TEA is required to operate a complaint management system for addressing any violation of Part B the Individuals with Disabilities Education Act (IDEA), including the identification, evaluation, or placement of a student with a disability, or the provision of a free appropriate public education (FAPE) to the student. Organizations may also file complaints. Complaints may be about services being provided to one student with a disability or to a group of students with disabilities. While a parent, organization, or any other interested person may file a complaint, this handout will refer to the person sending the complaint as "parent." In 1999 the Texas Legislature passed SB 103 which required that, in order to graduate, every high school student must pass an exit science examination (TEKS ) in the 11th grade covering "...at least biology and integrated chemistry and physics." The Texas State Board of Education (SBOE) responded by eliminating Earth Science from the list of courses accepted for core science graduation credit. SB 103 also provided that statewide testing of Earth Science comprehension would be shifted from the eighth grade to the fifth grade. These changes significantly deemphasized Earth Science in the Texas high school curriculum. Unfortunately, the Texas Earth science community allowed these changes to occur without objection. Last fall the American Geological Institute, under the leadership of Marcus Milling and Ed Roy, organized a letter-writing campaign to the chair of the SBOE urging a revision of the core science requirements to reinstate Earth Science for high school graduation credit and a concomitant revision of TAKS. More than fifty individual geoscientists sent letters to SBOE members. Also, please refer to the "Comment" page (p.5) in the September 2001 issue of Geotimes " (No) Earth Science in Texas At the urging of David Dunn, Ms. Miller, Chair of the SBOE Committee on Instruction, agreed to hold a public hearing on the issues raised by the letter writers. Marcus Milling, Ed Roy, David Dunn and Stan Pittman constituted a working group to solicit testimony and orchestrate the presentations. On January 10, 2002, the hearing was held in Austin, Texas. Thirty witnesses from across the State of Texas testified in favor of reinstating Earth Science as a high school core science course for graduation credit; none opposed the proposal.

Many states are implementing legislation requiring early assessment of reading in grades K-2. These laws typically require "ongoing" assessment to be given to each child individually. A few states (LA) require that districts use a specific assessment or set of assessments, but most states do not stipulate a specific assessment that must be given, but instead require that each district select an assessment (or assessments) that tests the child's knowledge in certain areas (e.g. phonics decoding, phoneme awareness, or reading comprehension). In some states (AR, TX), a list of specific assessments is "recommended" (but not required) , and in other states, while there is no explicit list of assessments that the state recommends or endorses, teachers are provided with state-funded training in administration of certain assessments. Teachers are not required to use those assessments in their classrooms, but the state implicitly endorses those specific assessments by ensuring teacher training in the administration and interpretation of those assessments.
