The class clown, the space cadet, the rude or disrespectful teenager, the "children described as immature, unmotivated, lazy, inconsistent, irresponsible"1. . . . For years, teachers, principals, and parents have tried and failed to motivate and discipline these children. Ultimately, they blame the children themselves for their school failure, saying they just don't try hard enough or care enough to study and behave. Recent medical research suggests that many of these children may not be unmotivated, lazy, or irresponsible at all. Instead, they may suffer from a neurobiological disorder called attention deficit hyperactivity disorder (ADHD), and they can be helped to succeed in school. In fact, the school system is legally obligated to locate and evaluate children who have this disorder, and if the children are found to be eligible, to provide special education and/or related services to meet their needs.2 Unfortunately, many teachers, administrators, and other school based professionals have had little opportunity to learn about the disorder, how to identify and treat it, or their legal responsibilities to do so. Their lack of knowledge may put children with ADHD at risk of school failure and may expose schools to lawsuits.

Special  Learning  Needs  Consultant Estimates of the percentage of U.S. school-age children with learning difficulties are as high as 30 percent. [1]  In its 1987 report to Congress, the Interagency Committee on Learning Disabilities summarized a review of available learning disabilities prevalence research and concluded that: In the absence of good prevalence data, the Committee believes that 5 percent to 10 percent is a reasonable estimate of the percentage of persons affected by learning disabilities.  It is clear the prevalence is somewhat higher among socio-economically disadvantaged populations. [2] In studies conducted by the President’s Committee on Employment for People with Disabilities it was found that 10 to 14 percent of adults in the workplace have learning disabilities. [3] A survey of 567 adults with learning disabilities conducted by the association for Children and Adults with Learning Disabilities (now Learning Disabilities Association of America) found that 210 (37 percent) were unemployed. [4]

    Judy Achre's children always ask her what they should tell people she does. "They say, 'Everyone else's mother has a 9-to-5 job. What do you do?' I say, tell them I'm a professional volunteer," Mrs. Achre said. As the executive director of the Mercer County Association for Children with Learning Disabilities, Mrs. Achre is usually either out working with her special education students or on the phone with concerned parents. During the school year, the ACLD helps learning-disabled students with their homework and prepares them for tests, but during the five-week summer program the students can get the special attention they need. "No two learning-disabled students are alike," Mrs. Achre said. "Some can't read, some have attention problems, some are disorganized, some have trouble with math. We can zero in on the problem area and play catch-up over the summer." Mrs. Achre said the idea for the ACLD "came out of my own frustration." One of her children was very intelligent, but had problems with coordination and often reversed his letters when writing. He showed classic symptoms of dyslexia, but there were no programs for learning-disabled kids.

To articulate this demand on a public forum, oragizations like Action Aid, Ability Foundation, the TN Association of the Physically Handicapped, Action Aid and Vidya Sagar organized a solidarity rally on 14th November - Children's Day. The "Education for All" campaign, a world wide movement, of which India is a participant, includes provisions stressing the education of girls and children with special needs and in particular encourages interventions to suit local contexts. In order to effectively include children with disabilities into the mainstream program, adaptations in designs have to be made to increase access, enrolment, retention and achievement through various innovative methods, including enrolment drives, special camps, alternate schools, monitoring of attendance and follow-up of dropouts and conduct of special coaching classes.

    The Shelby County School District offers a comprehensive instructional program for approximately 45,000 students enrolled in grades K-12. The district is dedicated to the belief that each student is a unique person. The Shelby County School System tries to maximize the achievement of each and every student by offering extensions of classroom instruction in every school.     SUPREME COURT DECIDES CASE THAT CAN BE USED
    TO HELP DISABLED STUDENTS
    Brentwood Academy v. Tennessee Secondary School Athletic Association On February 20, 2001, the U.S. Supreme Court decided a case, Brentwood Academy v. Tennessee Secondary School Athletic Association , that can help in a longstanding battle on behalf of students with disabilities, The private Brentwood Academy was penalized by the Tennessee Secondary School Athletic Association for violating a recruiting rule. Brentwood sued, under 42 U.S.C. 1983, claiming that the TSSAA was a state agency and had violated the school's constitutional rights. The TSSAA defense was that they were a private entity, not a governmental agency, and that they did not have to follow any federal or constitutional duties. This is a constant problem, all across the United States, that has plagued students with disabilities. One of Reed's earliest cases was against the Texas Interscholastic League, Doe v. Marshall, in which a disabled student was not allowed to play football because of a violation of an Interscholastic League regulation. The Texas agency basically argued that they were "private" and "above the law" and could do whatever they wished. The federal court disagreed, recognizing not only that the Texas athletic association was a "governmental" entity that was subject to the Federal laws (Reed was suing under Section 504) but that the student's rights could only be met by allowing him to play football, which kept him motivated and attending school.

That law guarantees an equal and appropriate education for the nation's nearly 7 million children with disabilities. The improved measures would reduce the paperwork that's frustrated schools and parents and promote mediation instead of the courts as a way to resolve disputes. They'd also give teachers needed flexibility in disciplining students with special needs, as long as their conduct is not a result of their disability.

    What is Vocational Rehabilitation?
    Vocational Rehabilitation (VR) is a Federal/State-funded program providing services to help individuals with disabilities enter or return to employment. It is designed to help individuals of work age with disabling physical and/or mental disabilities compete successfully with others in earning a livelihood. Vocational Rehabilitation programs take an active leadership role in advocating for the rights of individuals with disabilities, removing the physical and attitudinal barriers which often confront them, and publicizing their abilities and accomplishments to society at large. In Tennessee, the Vocational Rehabilitation agency and Services for the Blind and Visually Impaired are combined as part of the Division of Rehabilitation Services (DRS) within the Department of Human Services. The program has been expanded and strengthened through the years with the goal of empowering individuals with disabilities by increasing opportunities for informed choice and high quality employment outcomes.
