Several basic questions permeate the discussion of statutory rape laws. A clear understanding of these questions will help put proposed legislation in context and focus discussion of the legislation. We encourage legislators and their staff to consider the following:
  • What is the purpose of statutory rape laws?
    What does criminal prosecution mean?
    Are the purposes furthered through the criminal laws?
    What other State efforts and policies need to be considered?
      What is the purpose of statutory rape laws? Laws making sex with minors a crime and the proposed changes to these laws may have more than one purpose. Generally, the more specific a State can be in outlining a law s purpose or purposes, the better. Knowing the specifics will further discussion and help the State develop and pass laws that accurately address what the State determines to be prosecutable.

    Family communication about sexuality is an important factor in young people's healthy sexual development, but families do not always find it easy to communicate about sexuality. Planned Parenthood affiliates and other community organizations sometimes try to address this need by conducting educational programs for parents and their children or teens. It is important to evaluate programs to assess their effectiveness with your community. Evaluation results can help you revise the program for the next group. Tips on evaluation follow.
    • In parent-child workshops, at least two groups are involved in the evaluation process (parents and young people), and these groups will likely need separate evaluation tools. If one objective is to increase family communication about sexuality, the evaluation should go beyond assessing knowledge levels to determine how the program affected family dynamics or communication among family members.

    Sexual orientation is determined by the sex or sexes you are romantically, physically, emotionally, and sexually attracted to. Heterosexuals are individuals attracted to the opposite sex, homosexuals are individuals who are attracted to the same sex, while bisexuals are people who are attracted to both sexes. Homosexual men are usually referred to as gay while homosexual women are referred to as lesbians.

    Discovering your sexual orientation can sometimes be confusing. Most people don't just wake up one day and decide their sexual orientation. It takes time and its normal not to be sure. Teen behavior is an expression of what is happening developmentally. It is natural for teens to question and test the values they have been raised with. Adolescence brings with it an increased ability to think abstractly. Teens use this ability to question values from every angle. They talk it out and they act it out. According to Dr. Harriet Heath, developmental psychologist and author of Using Your Values to Raise Your Child to Be an Adult You Admire , "This exploring is part of their developmental task of establishing who they are and by what values they wish to live." Teenagers need the love, support, and guidance of their parents to keep in touch with life as it really is and to have a secure base from which to question. According the Heath, teens need parents to discuss issues without jumping to the conclusion that their child is experimenting with something just because he is exploring the issue verbally; they need parents to discuss issues calmly without becoming defensive or judgmental. "This kind of verbal exploration is vital for teenagers," she writes. "Being able to explore questions with a trusted adult who knows them well, as well as with friends, teachers, and others who may be available, puts the teenager in a better position to face the issues squarely."
