August 1, 2003 COUNTRY DESCRIPTION: Sri Lanka is a presidential parliamentary democracy with a developing economy. A civil war and related urban terrorism have seriously disrupted the country since 1983. On February 22, 2002, The Government of Sri Lanka (GOSL) and the Liberation Tigers of Tamil Eelam (LTTE) signed an indefinite cease-fire agreement. Peace talks have stalled, but the cease-fire has not been broken to date. In the past, however, the LTTE have abandoned peace talks and reverted to terrorist activities. Despite the armed insurgency, Sri Lanka’s beaches and archeological sites attract tens of thousands of visitors from around the world. The capital city of Colombo, the Cultural Triangle (Kandy, Anuradhapura, and Polonnaruwa), and the west and southwest coasts all have good tourist facilities. ENTRY/EXIT AND REGISTRATION REQUIREMENTS: A passport and onward/return ticket and proof of sufficient funds are required. A no-cost visit visa, valid for 30 days, will be granted to tourists at the time of entry into Sri Lanka. Business travelers are required to have a visa prior to arrival. Visitors staying more than 30 days for any purpose must pay residency visa fees. Travelers need yellow fever and cholera immunizations if they are arriving from an infected area. All travelers departing Sri Lanka (except diplomats and certain exempted travelers) must pay an airport tax, in cash. Sri Lankan law requires all persons, including foreigners, who are guests in private households to register in person at the nearest local police station. Individuals who stay in private households without registering may be temporarily detained for questioning. This requirement does not apply to individuals staying in hotels or guesthouses.

Joint Statement on Situation in Sri Lanka
General Context The island of Sri Lanka is situated off the southern tip of India. Centuries of local and European colonisation have left it with a mixed ethnic and religious make-up. The main religion is Buddhism but there are also Hindus, Christians and Muslims and three official languages: Sinhala, Tamil and English. Most Hindus and Muslims are Tamil speaking. Sri Lanka’s main industry is textiles and clothing but it also exports tea, rubber and coconut. Sri Lanka is a member of regional organisation SAARC (see ‘Organisations’ above). The civil conflict Sri Lanka has had to cope with ethnic tensions since its independence in 1948. The conflict has been between the Sinhalese-dominated government and factions of the Tamil minority in the North who are seeking an independent Tamil state (Eelam). Since the 1980s the Tamil militant group Liberation Tigers of Tamil Eelam (LTTE or Tamil Tigers) has resorted to violence to achieve this end. Several ceasefires organised by local and global actors have failed to produce a lasting peace.

GOVERNMENT
Per the 1978 Constitution, the president of the republic, directly elected for a 6-year term, is chief of state, head of government, and commander in chief of the armed forces. Responsible to Parliament for the exercise of duties under the constitution and laws, the president may be removed from office by a two-thirds vote of Parliament with the concurrence of the Supreme Court.
The president appoints and heads a cabinet of ministers responsible to Parliament. The president's deputy is the prime minister, who leads the ruling party in Parliament. A parliamentary no-confidence vote requires dissolution of the cabinet and the appointment of a new one by the president.
Parliament is a unicameral 225-member legislature elected by universal suffrage and proportional representation to a 6-year term. The president may summon, suspend, or end a legislative session and dissolve Parliament. Parliament reserves the power to make all laws.
The 1978 Constitution clearly envisaged a system where the president and the prime minister were from the same party. Since the December 2001 Parliamentary elections, however, the President and the Prime Minister have been from different parties. This has led to serious cohabitation strains. In November 2003, for example, President Kumaratunga suddenly took over three key ministries (Defense, Interior, and Mass Communications), precipitating the most serious cohabitation crisis yet between the two sides. As of January 2004, the impasse between the President and the Prime Minister had not yet been resolved.

The Bad News
  • Sri Lanka is not a State Party to the Mine Ban Treaty.
  • Sri Lanka is a highly mine-affected country: some 700,000 mines, planted by government forces and the Liberation Tigers of Tamil Eelam (LTTE) during two decades of conflict, contaminate its roads and farmlands.
  • More than 300 new mine casualties were reported in 2001 (though many more occur and go unreported.
  • There is no coordinated national policy for victim assistance and rehabilitation.
The Good News
  • There have been no reports of landmine use since the cease-fire by both sides in December 2002.
  • The Sri Lanka Campaign to Ban Landmines handed over one million signatures appealing to the Government of Sri Lanka to accede to the Mine Ban Treaty, and calling upon the LTTE to stop using antipersonnel landmines, in November 2001 as part of its Citizen Anti-landmines Petition.
  • Before the whole UN on October 2002 Sri Lankan Ambassador Prasad Kariyawasam recognized that the Ottawa Convention was an important step towards the total elimination of anti-personnel mines. At this same meeting before the UN Sri Lankan Prime Minister Ranil Wickremasinghe announced that Sri Lanka will be reviewing its position on the Ottawa Convention with a view to becoming a party to it!

  • Sri Lanka As many as 800,000 Sri Lankans were internally displaced at the end of 2001. Another 144,000 Sri Lankans were refugees in India. Most Sri Lankan refugees and displaced persons were Hindu Tamils, although thousands of Muslims and some Buddhist Sinhalese were also displaced.
    In 2001, more than 11,000 Sri Lankans applied for asylum in Europe (the largest number, 5,465, in the United Kingdom), while 2,789 applied in Canada. More than 600 Sri Lankans requested asylum in the United States during fiscal year 2001, which ended September 30. Since the late 1990s, European governments have increasingly returned rejected Tamil asylum seekers to Sri Lanka.
    Sri Lanka is not a party to the UN Refugee Convention and has no domestic system for determining refugee claims. Although Sri Lanka allows UNHCR to conduct refugee status determinations, the government does not grant legal status to refugees or asylum seekers, and does not permit them to work or attend school. UNHCR pursues resettlement in other countries for recognized refugees.
    Conflict and Displacement
    UNHCR and Refugees International both estimated that 800,000 Sri Lankans remained internally displaced at the end of 2001. The Sri Lankan government reported that it was providing food assistance to nearly 705,000 internally displaced persons, including in areas controlled by the LTTE, but that it needed increased international aid to feed the remaining 100,000.

    Sexual relationships in Southeast Asia

    Southeast Asia is about more than Buddhist monks, tropical fruit, and white-sand beaches. It is also about the most beautiful women in the world, and excellent prospects for Western men to enter into meaningful sexual relationships. And I have to stress: I do not mean frequenting prostitutes. Of course, the wide range options for meaningful sexual relationships that exists in Southeast Asia is not obvious to the tourist or occasional business visitor. Like most of the Western men who live permanently in Southeast Asia, I myself have moved to this part of the world in search of paradise… not on palm-fringed beaches, but in the embrace of young beautiful women (and no, not the same one for years on end).     SRI LANKA: Tamils demand self-government
    Chris Slee The Tamil National Alliance will contest the April 2 Sri Lankan parliamentary elections on a platform calling for the creation of an interim self-governing authority for the north-eastern part of the island. The TNA, an alliance of four Tamil parties, hopes to win an overwhelming majority of the vote in Tamil-majority areas, thereby demonstrating the support of Tamils for self-government. Ever since Sri Lanka became independent in 1948, successive governments have discriminated against the Tamil minority. Tamil plantation workers who were born in Sri Lanka but whose ancestors had come from India were deprived of citizenship rights. The Tamil language was denied equal status with Sinhalese, the language spoken by the majority of Sri Lanka's population. Anti-Tamil riots were instigated by racist Sinhalese politicians, culminating in a massive pogrom in 1983. After peaceful protests failed to end the discrimination and oppression, an armed organisation, the Liberation Tigers of Tamil Eelam, was formed to fight for an independent Tamil state. War between the LTTE and the Sri Lankan army continued with brief interrruptions between 1983 and 2001.
